whereas the cable operator must, therefore, obtain the authorization from every holder of rights in each part of the programme retransmitted;

Države članice zagotovijo, da se pri kabelski retransmisiji oddaj na njihovem območju spoštujejo avtorska in sorodne pravice in da se takšna retransmisija odvija na podlagi individualnih ali kolektivnih avtorskih pogodb med imetniki avtorske pravice, imetniki sorodnih pravic in kabelskimi operaterji.

Cable retransmission right 1. Member States shall ensure that when programmes from other Member States are retransmitted by cable in their territory the applicable copyright and related rights are observed and that such retransmission takes place on the basis of individual or collective contractual agreements between copyright owners, holders of related rights and cable operators.

Države članice zagotovijo, da se pri kabelski retransmisiji oddaj na njihovem območju spoštujejo avtorska in sorodne pravice in da se takšna retransmisija odvija na podlagi individualnih ali kolektivnih avtorskih pogodb med imetniki avtorske pravice, imetniki sorodnih pravic in kabelskimi operaterji.

(27) Whereas the cable retransmission of programmes from other Member States is an act subject to copyright and, as the case may be, rights related to copyright; whereas the cable operator must, therefore, obtain the authorization from every holder of rights in each part of the programme retransmitted; whereas, pursuant to this Directive, the authorizations should be granted contractually unless a temporary exception is provided for in the case of existing legal licence schemes;

2.3.2.2 Another key issue with regard to the framework structure for the system is the issue of possible threats to individual privacy. It should be pointed out that the GALILEO system does not, in itself, pose any threat to privacy since it does not receive any information from users (there is no "uplink"). On the other hand, information received by the user can be retransmitted by another system — e.g. mobile phones — thereby making it possible to pinpoint the location of the user. Responsibility for regulating such use of information provided by the GALILEO system does not in any way lie with the EU programme management structures but rather with national authorities. The attention of the national authorities should be drawn to the measures which they are responsible for taking in order to regulate the use of the GALILEO system and — forthwith — the use of the GPS system.

2.3.2.2 Drugo pomembno vprašanje na področju vključevanja sistema zadeva morebitne grožnje za zasebno življenje. Treba je opomniti, da sam sistem GALILEO ne pomeni nikakršne grožnje za zasebno življenje, saj ne prejema nobenih informacij o svojih uporabnikih (ni naraščajoče povezave). Nasprotno pa lahko uporabnik prejete informacije pošilja prek drugih sistemov – prenosnega telefona GSM, na primer, kar omogoči njegovo lokalizacijo. Odgovornosti za ureditev takšne uporabe informacij, ki jih pošilja GALILEO, nimajo evropske strukture za vodenje programa, ampak nacionalne oblasti, ki morajo paziti na predpise, ki jih morajo sprejeti za določitev uporabe GALILEA in že sedaj GPS-a.

2. A Member State which, on the date mentioned in Article 14 (1), has a body with jurisdiction in its territory over cases where the right to retransmit a programme by cable to the public in that Member State has been unreasonably refused or offered on unreasonable terms by a broadcasting organization may retain that body.

Država članica, ki ima na datum iz člena 14(1) telo, ki je na njenem ozemlju pristojno za primere, ko je pravica javne retransmisije oddaje po kablu v tej državi članici iz neutemeljenih razlogov zavrnjena oziroma ponujena pod neutemeljenimi pogoji s strani RTV organizacije, tako telo lahko obdrži.

(2) Where a communication received by telecopier is incomplete or illegible, or where the Office has reasonable doubts as to the accuracy of the transmission, the Office shall inform the sender accordingly and shall invite him, within a period to be specified by the Office, to retransmit the original by telecopy or to submit the original in accordance with Rule 79 (a). Where this request is complied with within the period specified, the date of the receipt of the retransmission or of the original shall be deemed to be the date of the receipt of the original communication, provided that where the deficiency concerns the granting of a filing date for an application to register a trade mark, the provisions on the filing date shall apply. Where the request is not complied with within the period specified, the communication shall be deemed not to have been received.

Če je sporočilo, prejeto po telefaksu, nepopolno ali neberljivo ali če Urad utemeljeno dvomi o natančnosti prenosa, Urad o tem obvesti pošiljatelja in ga v roku, ki ga določi Urad, pozove, naj original ponovno pošlje po telefaksu ali pa ga predloži v skladu s pravilom 79(a). Če se tej zahtevi ugodi v določenemu roku, se datum prejema ponovljene pošiljke ali originala šteje za datum prejema originalnega sporočila pod pogojem, da se, če pomanjkljivost zadeva odobritev datuma vložitve prijave registracije znamke, uporabljajo določbe o datumu vložitve. Če zahteva v določenem roku ni izpolnjena, se šteje, da sporočilo ni bilo prejeto.

European law already prohibits incitement to hatred on grounds of race, sex, religion or nationality in broadcast[7]. This includes third country programmes (mostly satellite television) if they use either a frequency, satellite capacity or an uplink appertaining to a Member State[8]. Member States are responsible for the implementation of these rules and the recent cases of prohibition to retransmit channels like Al-Manar or Sahar-1 within Europe[9], show that the effective application of these rules works quite well.

Evropska zakonodaja že prepoveduje spodbujanje k sovraštvu na podlagi rase, spola, veroizpovedi ali narodnosti v oddajah[7]. To vključuje programe tretjih držav (najpogosteje preko satelitske televizije), če uporabljajo frekvence, satelitske zmogljivosti ali priključitve, ki pripadajo državi članici[8]. Države članice so odgovorne za izvajanje teh pravil in zadnji primeri prepovedi prenašanja kanalov, kot sta Al-Manar ali Sahar-1, v Evropi[9] kažejo, da učinkovita uporaba teh pravil precej dobro deluje.

3. A cable distributor shall not have the right provided for in paragraph 2 where it merely retransmits by cable the broadcasts of broadcasting organisations.

1. The central authority of the Member State of the person’s nationality shall store all information transmitted under Article 4, in order to be able to retransmit it in accordance with Article 7.

(31) Whereas for a transitional period Member States should be allowed to retain existing bodies with jurisdiction in their territory over cases where the right to retransmit a programme by cable to the public has been unreasonably refused or offered on unreasonable terms by a broadcasting organization; whereas it is understood that the right of parties concerned to be heard by the body should be guaranteed and that the existence of the body should not prevent the parties concerned from having normal access to the courts;

Where appropriate, each Member State retransmits to the NEAFC Secretariat data received from its vessels, in accordance with Articles 4, 6 and 10; subject to the following amendments:

Insofar as pursuant to this Convention industrial and commercial secrets or other confidential pieces of information are transmitted in conformity with domestic laws, the receiving Contracting Parties shall observe the secrecy of this information by not using it for any other purposes than those stipulated in this Convention, publishing it, or making it available to third parties. In case any one Contracting Party feels unable to comply with this obligation regarding confidential information that has been transmitted to it, it shall inform the transmitting Contracting Party about it without any delay and retransmit the transmitted information. Personal data shall be transmitted to Contracting Parties in conformity with the domestic law of the transmitting Contracting Party. The receiver shall use personal data only for the purpose indicated and under the conditions specified by the transmitting side.

Če se v skladu s to konvencijo industrijske in poslovne skrivnosti ali drugi zaupni podatki sporočajo v skladu z domačimi zakoni, pogodbenice prejemnice teh podatkov upoštevajo njihovo tajnost in jih ne uporabljajo le za tiste namene, ki so določeni v tej konvenciji, ter jih ne objavljajo ali dajejo na razpolago tretjim strankam. Če katera od pogodbenic meni, da ni sposobna izpolniti te obveznosti v zvezi z zaupnimi podatki, ki jih je prejela, o tem nemudoma obvesti pogodbenico pošiljateljico in prejete podatke vrne. Osebni podatki se pošljejo pogodbenicam v skladu z domačo zakonodajo pogodbenice pošiljateljice. Prejemnica osebne podatke uporablja le za dogovorjeni namen in po pogojih, ki jih določi pošiljateljica.

In case any one Contracting Party feels unable to comply with this obligation regarding confidential information that has been transmitted to it, it shall inform the transmitting Contracting Party about it without any delay and retransmit the transmitted information.

Če katera od pogodbenic meni, da ni sposobna izpolniti te obveznosti v zvezi z zaupnimi podatki, ki jih je prejela, o tem nemudoma obvesti pogodbenico pošiljateljico in prejete podatke vrne.
