In the light of the rise in HIV infection rates and the creation of the EDCTP, can the Council provide information on what funding Member States have provided to the EDCTP, and as a result, which microbicide clinical trials are currently being funded by the EDCTP?

(10) A Mol Földgázszállító Rt. ("MOL Transmission"), outra filial a 100% da MOL, não é adquirida pela E.ON no âmbito da presente operação. Em vez disso, a MOL dispõe de uma opção de venda que lhe permite obrigar a E.ON a adquirir 25% mais uma acção ou 75% menos uma acção da MOL Transmission nos próximos dois anos.

(10) Mol Földgázszállító Rt. ("MOL Transmission"), another solely-controlled subsidiary of MOL, is not acquired by E.ON through the present transaction. MOL is instead granted a put option under which MOL can require E.ON to purchase a 25% plus 1 share or a 75% minus 1 share interest in MOL Transmission during the next two years.

(43) A MOL Transmission possui e gere a rede de gás de alta pressão na Hungria. A participação minoritária de 25% + 1 que a MOL manteria na MOL WMT constitui um incentivo para a MOL Transmission reforçar a estratégia de restrição de acesso aos inputs de gás, em detrimento dos concorrentes a jusante da E.ON, graças a um comportamento discriminatório na concessão de acesso à rede de transporte.

(43) MOL Transmission owns and manages the high pressure grid in Hungary. The 25%+1 minority shareholding that MOL would retain in MOL WMT gives MOL Transmission an incentive to reinforce the gas input foreclosure strategy to the detriment of E.ON’s competitors downstream through discriminatory behaviour in granting access to the transmission network.

(62) Em segundo lugar, nos termos dos compromissos, a MOL não exercerá a opção de venda da participação de 25% + 1 acção da MOL Transmission. Além disso, a MOL não venderá à E.ON, nem a qualquer das suas filiais, por um período de 10 anos, enquanto a E.ON for o accionista maioritário da WMT e da MOL Storage, qualquer participação na MOL Transmission que não conduza à aquisição de um controlo exclusivo ou conjunto da MOL Transmission pela E.ON.

(62) Secondly, pursuant to the commitments, MOL will not exercise the put option for the 25% + 1 share interest in MOL Transmission. In addition, MOL will not sell to E.ON or any of its affiliates, for a period of 10 years as long as E.ON is a majority shareholder of MOL WMT and MOL Storage, a share interest in MOL Transmission that would not result in the acquisition of sole or joint control over MOL Transmission by E.ON.

(413) Since neither of the two Scottish operators has submitted comments to the Commission in the context of these proceedings, the analysis is based on documents available to the public. For Scottish and Southern Electricity, the Commission used the figures provided in its 2003 Seven-year Statement [66]. For Scottish Power, the Commission used the figures provided in its April 2003 Transmission Seven-year Statement [67].

(7) O modo de funcionamento dos mercados de equilibração também deve ser considerado como um indicador. Com efeito, "um interveniente no mercado que não consiga facilmente adaptar a sua carteira de produção às características dos clientes corre o risco de ficar exposto à diferença entre o preço ao qual o ORT (operador de redes de transporte) vende a energia de equilibração e o preço ao qual adquire a produção excedentária. Estes preços são quer directamente impostos pelo regulador ao ORT, quer, em alternativa, fixados através de um mecanismo baseado no mercado, no âmbito do qual o preço é determinado em função das propostas de outros produtores, de forma a regular a sua produção quer em alta quer em baixa […]; os pequenos operadores são confrontados com grandes dificuldades quando existe o risco de uma diferença importante entre o preço de aquisição do ORT e o preço de venda. Tal acontece em determinados Estados-Membros e é provavelmente prejudicial ao desenvolvimento da concorrência. Uma diferença importante pode indicar um nível de concorrência insuficiente no mercado da equilibração, que pode ser dominado por apenas um ou dois grandes produtores. Essas dificuldades são agravadas quando os utilizadores da rede não conseguem adaptar as suas posições em tempo quase real" [9]. Desde a introdução dos mecanismos BETTA (British Electricity Trading and Transmission Arrangements), existe um mercado de equilibração unificado para a Inglaterra, na Escócia e no País de Gales. Além disso, as suas principais características (tarifação em função do mercado, encerramento a cada meia hora e diferença relativamente pequena) são de tal ordem que devem ser consideradas como indicadores de exposição directa à concorrência.

(7) The workings of the balancing markets should also be considered as indicators. In fact, "any market participant who cannot easily match its generation portfolio to the characteristics of its customers may find itself exposed to the difference between the price at which the TSO (transmission system operator) will sell imbalance energy, and the price at which it will buy back excess production. These prices may either be directly imposed by the regulator on the TSO; or alternatively a market based mechanism will be used in which the price is determined by bids from other producers to regulate their production upwards or downwards … a key difficulty for small market participants arises where there is the risk of a large spread between the buying price from the TSO and the selling price. This occurs in a number of Member States and is likely to be detrimental to the development of competition. A high spread may be indicative of an insufficient level of competition in the balancing market which may be dominated by only one or two main generators. Such difficulties are made worse where network users are unable to adjust their positions close to real time." [9] Since the introduction of the British Electricity Trading and Transmission Arrangements (BETTA) there has been a unified balancing market for England, Scotland and Wales. Furthermore, its main characteristics (market based pricing, half-hourly gate closures and a fairly low spread) are such that it should be taken as an indicator of direct exposure to competition.
