Turning to the scope of application, it should be noted that Regulation 3911/92 applies to the cultural goods listed in its Annex; the goods are divided into 14 categories, including archaeological objects, paintings, engravings, books, photographs, etc. The criteria for an article to qualify as a “cultural object”, which vary according to the category, are the age (more than 100, 75 or 50 years, depending on the case) and the minimum financial value of the goods (from 0 Euro for certain cultural goods up to 150.000,00 for paintings.21 Directive 93/7 covers cultural goods which — as they belong to the categories mentioned in its Annex (i.e. the same as those listed in the Annex to the Regulation) — are classified as national treasures possessing artistic, historical or archaeological value under the terms of the legislation or administrative procedures of the Member States. Except for public collections and inventories of ecclesiastical institutions, national treasures that are not “cultural goods” within the meaning of the Annex are excluded from the Directive and are thus governed by the national legislation of the Member States in accordance with the rules of the Treaty.

En ce qui concerne le champ d'application, il convient de noter que le règlement 3911/92 s'applique aux biens culturels figurant dans son annexe, les marchandises sont divisés en 14 catégories, y compris les objets archéologiques, des peintures, gravures, livres, photographies, etc... Les critères pour qu'un objet soit considéré comme un objet «culturel», qui varient selon la catégorie, sont l'âge (plus de 100, 75 ou 50 ans, selon le cas) et la valeur financière minimale de la marchandise (à partir de 0 euro pour certains biens culturels à 150.000,00 pour les peintures. la directive 93 / 7 couvre les biens culturels qui - comme ils appartiennent à des catégories mentionnées dans son annexe (à savoir les mêmes que celles figurant à l'annexe du règlement) - sont considérés comme des trésors nationaux de valeur artistique, historique ou archéologique selon les termes de la législation ou des procédures administratives des États membres. Sauf pour les collections publiques et les inventaires des institutions ecclésiastiques, les trésors nationaux qui ne sont pas des «biens culturels» au sens de l'annexe et sont exclus de la directive et sont donc régis par la législation nationale des États membres en conformité avec les règles du traité.
