Voor de toepassing van deze verordening wordt onder "bemiddelende instantie" verstaan openbare of particuliere lichamen of diensten die onder de verantwoordelijkheid van de betalings- of beheersautoriteiten optreden of die namens hen taken uitvoeren ten aanzien van de eindbegunstigden of de instanties of ondernemingen die verrichtingen uitvoeren.

2. Openbare lichamen kunnen op basis van deze richtlijn niet worden verplicht een bepaald soort documenten te blijven produceren met het oog op het hergebruik van deze documenten door een particuliere of publieke organisatie.
