Instrument może być uruchomiony przez Radę z inicjatywy Komisji (na podstawie art. 119) w porozumieniu z Państwem Członkowskim ubiegającym się o finansowanie ze Wspólnoty lub na bezpośredni wniosek danego Państwa Członkowskiego. Po uruchomieniu instrumentu Rada bada sytuację w Państwie Członkowskim ubiegającym się o pomoc i decyduje a) o przyznaniu lub nie pożyczki lub odpowiedniego instrumentu finansowania, jego wartości i średnim okresie trwania; b) o warunkach polityki gospodarczej związanych ze średnioterminową pomocą finansową, mających na celu przywrócenie trwałej sytuacji w zakresie bilansu płatniczego; i c) sposobie wypłaty pożyczki lub instrumentu finansowania, którego udostępnianie lub pobieranie z zasady odbywa się w formie kolejnych rat. Decyzje Rady o uznaniu pomocy za pomocą instrumentu podejmowane są kwalifikowaną większością na wniosek Komisji, który przedstawiany jest po konsultacji z KEF.

The facility may be activated by the Council on the initiative of the Commission (pursuant to Article 119) in agreement with the Member State seeking Community financing or at the direct request of the Member State concerned. Once the facility has been activated, the Council examines the situation in the Member State seeking assistance and decides (a) whether to grant a loan or appropriate financing facility, its amount and its average duration; (b) the economic policy conditions attached to the medium-term financial assistance with a view to re-establishing a sustainable balance of payments situation; and (c) the techniques for disbursing the loan or financing facility, the release or drawings of which are, as a rule, by successive instalments. Council decisions to provide assistance via the facility are taken by qualified majority on a proposal from the Commission, which is made after consultingthe EFC.

Władze Gruzji zamierzają wykorzystać sprzyjające warunki polityki gospodarczej celem dalszej redukcji swojej pozycji dłużnika netto wobec Wspólnoty, poprawiając tym samym swoją średnioterminową zdolność kredytową. Mając na względzie powyższe, władze Gruzji zwróciły się do UE o kontynuowanie realizacji programu EFA i oczekują, że wsparcie finansowe Wspólnoty może pomóc ich krajowi w zmniejszeniu jego zadłużenia zagranicznego do bardziej zrównoważonego poziomu.

The Georgian authorities are willing to take advantage of the favourable economic policy environment to reduce further the country’s net debtor position towards the Community, thereby improving medium-term debt sustainability. In this perspective, they have already requested from the EU the continuation of the implementation of EFA and expect that financial support from the Community could help the country reduce its external debt to much more sustainable levels.

(38) Co więcej, aczkolwiek art. 21 rozporządzenia podstawowego odnosi się istotnie do konieczności zwrócenia szczególnej uwagi na potrzebę eliminacji skutków szkodliwego dumpingu zakłócającego handel oraz na przywrócenie efektywnej konkurencji, przepis ten powinno się rozpatrywać w szerokim kontekście ustanowionego w wyżej cytowanym artykule ustalenia interesu Wspólnoty. Tak więc należy zbadać i wyważyć skutki ewentualnego nałożenia środków antydumpingowych i ich zaniechania poniesione przez wszystkie zainteresowane strony. W tym względzie należy zauważyć, że istnieje pewna liczba innych eksporterów i producentów konkurujących na rynku światowym, a do pewnego stopnia także na rynku wspólnotowym. Nawet biorąc pod uwagę perspektywę średnioterminową, przemysł wspólnotowy prawdopodobnie nie odniósłby pełnej korzyści z nałożenia możliwych środków, zważywszy na fakt, iż należałoby się spodziewać zwiększenia udziału innych krajów trzecich w rynku wspólnotowym.

(38) Moreover, while Article 21 of the basic Regulation indeed refers to the need to give special consideration to the need to remedy the trade distorting effects of injurious dumping and to restore effective competition, this particular provision has to be seen in the overall framework of the Community interest test as laid down in the aforementioned Article. Thus the effects of imposing measures or not imposing measures on all parties concerned have to be examined and balanced. In this respect it should be noted that there are a number of other exporters and producers in competition on the world market and to a certain extent also on the Community market. Even in a medium term perspective the Community industry would be unlikely to take full benefit of possible measures given that it is to be expected that other third countries would considerably increase their part on the Community market.

Chociaż od czasu przyjęcia rozporządzenia nie zaistniała potrzeba średniookresowej pomocy finansowej, zasada oraz powody uzasadniające istnienie instrumentu nadal obowiązują. Rozszerzenie Unii 1 maja 2004 r. podniosło liczbę kwalifikujących się Państw Członkowskich z trzech do trzynastu. Dopóki te Państwa Członkowskie nie wprowadzą euro, mają one prawo ubiegać się o średnioterminową pomoc finansową Wspólnoty w przypadku problemów z bilansem płatniczym. Bieżący górny pułap niespłaconych pożyczek w ramach instrumentu, w wysokości 12 miliardów euro, został ustalony przez Radę z myślą o przyszłych rozszerzeniach[5]. Podczas gdy bieżący górny pułap oznaczał zmniejszenie wynoszącego 16 miliardów euro pułapu ustanowionego na mocy rozporządzenia z 1988 r., Komisja jest zdania że jest on na dostatecznie wysokim poziomie, aby móc zaspokajać jednoczesne potrzeby kilku Państw Członkowskich. Tym samym na obecnym etapie nie są proponowane żadne zmiany zasad, ustaleń dotyczących działania instrumentu ani górnego limitu niespłaconych pożyczek.

Although the need for medium-term financial assistance has not arisen since the Regulation was adopted, the principle and underlying rationale of the facility remains valid. The enlargement of the Union on 1 May 2004 has expanded the number of eligible Member States from three to thirteen. As long as these Member States have not adopted the euro, they are entitled to seek medium-term financial assistance from the Community in the event of problems in their balance of payments. The current ceiling of €12 billion on outstanding loans under the facility was decided by the Council in anticipation of future enlargements[5]. While the current ceiling implied a reduction from the ceiling of €16 billion provided by the 1988 Regulation, the Commission believes that it remains at a sufficiently high level to satisfy the simultaneous needs of several Member States. Accordingly, no change to the principle, arrangements for operating the facility or to the ceiling on outstanding loans is proposed at this stage.

UE jest największym dawcą pomocy dla Palestyny, jej wkład to ok. 500 mln. EUR rocznie, z czego ponad połowa pochodzi z budżetu Wspólnoty, a pozostała część jest finansowana przez Państwa Członkowskie w ramach umów dwustronnych. Unia jest również ważnym członkiem Kwartetu, co sprawia, że może ona wnieść znaczący wkład w przyszłe utworzenie państwa palestyńskiego pokojowo współistniejącego z Izraelem. Aby skorzystać z tej możliwości, UE powinna obecnie określić całościową średnioterminową strategię w zakresie wspierania postępów na drodze do rozwiązania dwupaństwowego przewidzianego w mapie drogowej oraz w zakresie stosunków z przyszłym państwem palestyńskim.

The EU is the biggest donor of assistance to the Palestinians, providing around € 500 million each year, over half of which comes from the EC budget and the remainder from bilateral EU Member State funding. It is also a key member of the Quartet. As such, the EU has the potential to make a significant contribution to the future establishment of a Palestinian State living at peace with Israel. In order to fulfil this potential, the EU should now define a comprehensive medium-term strategy for supporting progress towards a two-state solution envisaged by the Roadmap and for its relations with a future Palestinian State.
