(202) Opgemerkt zij dat de producent/exporteur geen bewijs heeft aangevoerd voor zijn stelling dat de schade die de bedrijfstak van de Gemeenschap geleden heeft, het gevolg is van de conjunctuurgevoeligheid van de staalmarkt. Bovendien zou de conjunctuurgevoeligheid van de staalmarkt niet alleen gevolgen hebben voor de bedrijfstak van de Gemeenschap, maar evengoed voor de producenten/exporteurs. Een neerwaartse trend op de NBP-markt die de toestand van de bedrijfstak van de Gemeenschap negatief beïnvloedt, zou ook gevolgen hebben gehad voor de omvang van de NBP-invoer uit de vier betrokken landen, zodat ook die zou zijn afgenomen. Zoals in overweging 151 wordt beschreven, is het volume van de gecumuleerde invoer uit de vier betrokken landen tussen 2001 en 2004 ieder jaar opnieuw toegenomen. Daarom luidt de conclusie dat de conjunctuurgevoeligheid van de staalmarkt niet als oorzaak van de door de bedrijfstak van de Gemeenschap geleden schade kan worden beschouwd.

(202) In this respect it is noted that the exporting producer did not submit any evidence to substantiate the claim that the cyclicality of the steel market has caused the injurious situation of the Community industry. In addition, it is noted that the cyclicality of the steel market should have an impact on the Community industry and exporting producers alike. Hence, a downward cycle in the SPT market which allegedly had a negative impact on the state of the Community industry should have also had a negative impact on the volume of SPT imports, i.e. import volumes from the four countries concerned should have decreased. However, as described in recital (151), cumulated import volumes of the four countries concerned increased every single year from 2001 to 2004. Therefore, it is concluded that the cyclicality of the steel market cannot be considered as having caused the injury suffered by the Community industry.

(129) This exemption from the payroll and business property occupation taxes is selective as it applies only to those companies that make no profit. In addition to enterprises in difficulty and those whose principal source of income is derived from capital gains, in any particular year such companies might include, for example, enterprises operating in cyclical business environments, enterprises in the initial stage of their business and companies where profits are eliminated through additional payments to shareholder-employees or to other employees. The Commission cannot accept the United Kingdom's arguments to the effect that the inherent quantitative limitation in the system which exempts unprofitable companies applies in the same way to all companies regardless of their size or sector and is therefore not selective. Although apparently general, certain definable categories of companies benefiting from the exemption from tax can in fact be identified, as will be shown later.

In our joint motion with the PPE-DE Group we urge the proper respect of the SGP.We point out that it would be particularly useful in a year like this one -in which many stability programmes were drafted in expectation of 3% growth, but the out-turn is likely to be less than 2%, as the Commission has said -if there were a commonly agreed measure between the ECB, Ecofin and the Commission of the underlying budget balance, stripping out the impact of the slowdown on taxes and cyclically determined spending and, perhaps, interest rates as well.
