(2) Wenn daher eine in Anhang I aufgeführte Zuständigkeitsvorschrift in einem Mitgliedstaat aufgehoben wird, ist Anhang I entsprechend zu ändern.

Da Erbsachen vom Anwendungsbereich der Verordnung (EG) Nr.°44/2001 ausgenommen sind, gibt es keine gemeinschaftsrechtlichen Zuständigkeitsvorschriften für Streitigkeiten wegen Trusts, die zur Regelung der Erbfolge errichtet worden sind („Erbschaftstrusts“).

Succession being excluded from the scope of Regulation (EC) No 44/2001, there are no Community rules of jurisdiction for litigation in relation to trusts created in wills, which are not covered by the Regulation.

(13) Bei Versicherungs-, Verbraucher-und Arbeitssachen sollte die schwächere Partei durch Zuständigkeitsvorschriften geschützt werden, die für sie günstiger sind als die allgemeine Regelung.

(13) In relation to insurance, consumer contracts and employment, the weaker party should be protected by rules of jurisdiction more favourable to his interests than the general rules provide for.

Gemeinsame Zuständigkeitsvorschriften sollten demnach grundsätzlich dann Anwendung finden, wenn der Beklagte seinen Wohnsitz in einem dieser Mitgliedstaaten hat.

Accordingly common rules on jurisdiction should, in principle, apply when the defendant is domiciled in one of those Member States.

Die Zuständigkeitsvorschriften dieses Titels finden auf diese Bevollmächtigten im Rahmen der ihnen übertragenen Befugnisse Anwendung.

The rules governing responsibilities adopted under this Title shall apply to such persons within the limits of the powers delegated to them.
