(84) Per definire i diversi tipi di prodotto si è tenuto conto prevalentemente delle materie prime utilizzate per il prodotto in questione (ghisa grigia o ferro dolce, con o senza aggiunta di calcestruzzo), del suo uso (chiusini, coperchi per pozzetti, botole), delle sue dimensioni, dei diversi accessori e della sua conformità con le norme europee EN 124.

(84) The elements taken into account in defining the product types were mainly the raw material used for the product concerned (grey cast or ductile iron with or without added concrete), its use (manhole covers, gully tops or surface boxes), its dimensions and different accessories and its conformity with the EN 124 European standards.

(19) Il prodotto in esame è costituito da alcuni articoli di ghisa non malleabile del tipo usato per coprire e/o dare accesso a sistemi superficiali o sotterranei, e loro parti, lavorati a macchina o no, rivestiti o verniciati o provvisti di altri materiali originari dell’RPC (il "prodotto in esame"), normalmente dichiarati ai codici NC 7325 10 50 e 7325 10 92 e dichiarati occasionalmente al codice NC 7325 10 99. Questi codici NC corrispondono alle diverse presentazioni del prodotto (inclusi chiusini, coperchi per pozzetti, botole). Si è constatato che tutte queste presentazioni sono sufficientemente simili da poter costituire un unico prodotto ai fini del procedimento. Si deve osservare che gli idranti sottosuolo sono considerati prodotti sostanzialmente diversi dalle botole, dati il loro impiego e le loro modalità di fabbricazione, e non rientrano pertanto nella definizione del prodotto in esame.

(19) The product concerned is certain articles of non-malleable cast iron of a kind used to cover and/or give access to ground or sub-surface systems, and parts thereof, whether or not machined, coated or painted or fitted with other materials originating in the PRC ('the product concerned'), normally declared within CN codes 7325 10 50 and 7325 10 92 and occasionally declared within CN code 7325 10 99. These CN codes correspond to the different presentations of the product (including manhole covers, gully tops and surface boxes). All these presentations were found to be sufficiently similar for them to constitute a single product for the purpose of the proceeding. It should be noted that sub-surface fire hydrants are deemed materially different from a surface box, due to their use and construction, and are therefore not considered the product concerned.

A sostegno della loro affermazione, le parti interessate hanno sottolineato che il regolamento che istituisce misure definitive menziona solo un'altra norma (EN 124) applicabile a chiusini e coperchi per pozzetti e che l'inchiesta iniziale si è chiaramente concentrata sui chiusini.

(27) Per quanto riguarda la prima argomentazione, va osservato che sia il prodotto simile sia il prodotto in esame devono conformarsi alle norme EN 124 e alle norme nazionali quando sono venduti sul mercato comunitario. Ciò definisce quindi i criteri da applicare per la determinazione del “prodotto simile”, cioè le caratteristiche fisiche, tecniche e chimiche e le applicazioni o le funzioni finali del prodotto. Si è accertato che i pezzi fusi fabbricati dall'industria comunitaria e venduti sul mercato comunitario, che sono di ghisa grigia o di ferro dolce, presentano le stesse caratteristiche fisiche e tecniche di base e le stesse applicazioni del prodotto in esame. Analogamente, le differenze in termini di norme nazionali non influiscono in alcun modo sulla definizione del prodotto simile, poiché non è possibile fare una netta distinzione tra i prodotti in funzione delle loro caratteristiche fisiche, tecniche e chimiche di base, delle applicazioni finali e della percezione degli utilizzatori. Le caratteristiche fisiche e tecniche del prodotto sono determinate dalla sua funzione, installazione e ubicazione e consistono prevalentemente nella resistenza al carico di traffico, determinata dalla cosiddetta classe di carico, nella stabilità del coperchio e della grata all’interno del telaio e nella sicurezza e facilità di accesso. Il prodotto può essere di ghisa grigia o di ferro dolce; il coperchio e/o il telaio del chiusino possono essere riempiti di calcestruzzo o di altri materiali. Per quanto riguarda le applicazioni del prodotto, i coperchi e i telai fabbricati da pezzi fusi fungono da interfaccia tra le reti interrate e la superficie della carreggiata o del marciapiede. Tutte le caratteristiche di cui sopra si applicano anche al cosiddetto prodotto “Gatic”, che non può essere distinto dal prodotto in esame. Si è quindi respinta la richiesta di esclusione del prodotto "Gatic" dal prodotto in esame.

(27) With regards to the first argument, it has to be noted that when sold on the Community market, both the like product and the product concerned need to comply with EN124 standards and national norms. This thus determines the criteria to be applied in the determination of the “like product”, which are the physical, technical and chemical characteristics, and end uses or functions of the product. Castings produced by the Community industry and sold on the Community market are made of grey iron or ductile iron and were found to have the same basic physical and technical characteristics and uses as the product concerned.Similarly, the differences in terms of national norms have no incidence on the definition of the like product, as no clear distinction can be made between the products in relation to their basic physical, technical and chemical characteristics, to the end use and to the perception of users. Regarding the physical and technical characteristics of the product, they are determined by function, installation and location, and are mainly the traffic load resistance determined by the so-called loading class, the cover and grate stability within the frame and the safe and easy access. The product can be grey or ductile cast iron and the cover and/or the frame of manhole can be filled with concrete or other materials. As for the uses of the product, castings cover and frames provide an interface between buried networks and the road or pavement surface. All of the above characteristics also apply to the so-called gatic product, which can not be distinguished from the product concerned of any of them. The argument for excluding the gatic product from the product concerned was therefore rejected.
