25. Kontrollerna på plats skall varje år omfatta minst 5% av stödmottagarna och avse samtliga typer av åtgärder för landsbygdsutveckling som anges i programdokumenten [16]. Dessa kontroller på plats skall spridas över året utifrån en riskanalys för varje landsbygdsutvecklingsåtgärd. Varje kontroll skall omfatta en stödmottagares alla åtaganden och skyldigheter som kan kontrolleras vid besöket.

25. The on-the-spot checks shall cover at least 5% of beneficiaries each year and all the different types of RD measures set out in the programming documents [16]. These on-the-spot checks shall be spread over the year on the basis of an analysis of the risks presented by each RD measure. Each check shall cover all the undertakings and obligations of a beneficiary which can be checked at the time of the visit.

5. Stöd får inte beviljas för kostnader som uppstår efter det femte verksamhetsåret, eller som betalas ut efter det sjunde året efter det att producentorganisationen godkändes. Detta påverkar inte det stöd som beviljas för stödberättigande kostnader som är begränsade till och beror på att en stödmottagares omsättning från ett år till ett annat ökar med minst 30% på grund av att nya medlemmar och/eller nya produkter tillkommer.

5. The aid must not be paid in respect of costs incurred after the fifth year, or paid following the seventh year after recognition of the producer organisation. This is without prejudice to grant aid towards eligible expenses limited to and resulting from a year-on-year increase in turnover of a beneficiary by at least 30% where this is due to the accession of new members and/or the coverage of new products.

Förvaltningsmyndigheten skall ha de arbetsuppgifter som anges i artikel 60 i förordning (EG) nr 1083/2006, med undantag för kontroller av att insatserna och utgifterna följer gällande nationella regler och gemenskapsregler, i enlighet med b i den artikeln. I samband därmed skall den försäkra sig om att varje stödmottagares utgifter har godkänts av den styrekonom som avses i artikel 16.1 i den här förordningen.

The managing authority shall perform the duties provided for in Article 60 of Regulation (EC) No 1083/2006, with the exception of those concerning the regularity of operations and expenditure in relation to national and Community rules, as set out under point (b) of that Article. In this connection, it shall satisfy itself that the expenditure of each beneficiary participating in an operation has been validated by the controller referred to in Article 16(1) of this Regulation.

[26] Samtidigt fördes samtal med stödmottagarare och med värderingsmän som hade fastställt värdet på slaktade djur. Besök gjordes även vid Internationella byrån för epizootiska sjukdomar i Paris, Pirbright-laboratoriet och National Audit Office i London, det nationella revisionsorganet i Förenade kungariket.

[26] Beneficiaries and valuers who had established the value of the slaughtered animals were also interviewed. The Office international des epizooties (OIE) in Paris, Pirbright Laboratory and the National Audit Office (NAO) in London were also visited.

[32] EUGFJ-garanti: I artikel 69 i kommissionens förordning (EG) nr 817/2004 (EUT L 153, 30.4.2004, s. 30) om stöd från Europeiska utvecklings-och garantifonden för jordbruket (EUGFJ) till utveckling av landsbygden anges att kontroller på plats skall omfatta minst 5% av stödmottagarna varje år och avse samtliga typer av åtgärder för utveckling av landsbygden som anges i programdokumenten. Kontrollerna på plats skall spridas över året i enlighet med en riskanalys för varje åtgärd för utveckling av landsbygden. Kontrollerna skall avse en stödmottagares alla åtaganden och skyldigheter som kan kontrolleras vid besöket. De skall utföras i enlighet med avdelning III i förordning (EG) nr 2419/2001.EUGFJ-utveckling: I kommissionens förordning (EG) nr 438/2001 (EGT L 63, 3.3.2001, s. 21) (om förvaltning av strukturfonderna) anges (i artikel 10) följande: "Medlemsstaterna skall genomföra kontroller på ett lämpligt urval av insatser särskilt för att a) kontrollera att förvaltnings-och kontrollsystemen är effektiva, b) selektivt, på grundval av en riskanalys, kontrollera de utgiftsdeklarationer som upprättats på olika berörda nivåer. De kontroller som genomförs innan en stödform avslutas skall omfatta åtminstone 5% av de totala stödberättigande utgifterna och grundas på ett representativt urval av godkända insatser, med beaktande av kraven i punkt 3. Medlemsstaterna skall bemöda sig om att sprida kontrollerna jämnt över den berörda perioden. De skall se till att sådana kontroller på lämpligt sätt skiljs från förfaranden för genomförande av insatser och därmed sammanhängande utbetalningar."

[32] EAGGF Guarantee: the Commission Regulation (EC) No 817/2004 (OJ L 153, 30.4.2004, p. 30) on support for rural development from the European Agricultural Guidance and Guarantee Fund (EAGGF) sets out in Article 69 that on-the-spot checks shall cover at least 5% of beneficiaries each year and all the different types of rural development measures set out in the programming documents. On-the-spot checks shall be spread over the year on the basis of an analysis of the risks presented by each rural development measure. Checks shall cover all the commitments and obligations of a beneficiary which can be checked at the time of the visit. They shall be made in accordance with Title III of Regulation (EC) No 2419/2001.EAGGF Guidance: Commission Regulation (EC) No 438/2001 (OJ L 63, 3.3.2001, p. 21) (on Structural Funds Management) sets out (Article 10) that "Member States shall organise checks on operations on an appropriate sampling basis, designed in particular to: (a) verify the effectiveness of the management and control systems in place; (b) verify selectively, on the basis of risk analysis, expenditure declarations made at the various levels concerned. The checks carried out before the winding-up of each assistance shall cover at least 5% of the total eligible expenditure and be based on a representative sample of the operations approved, taking account of the requirements of paragraph 3. Member States shall seek to spread the implementation of the checks evenly over the period concerned. They shall ensure an appropriate separation of tasks as between such checks and implementation or payment procedures concerning operations".

36. Kommissionen noterar dessutom att den 31 december 2004 hade tio företag noterats på italienska fondbörser det året (dvs. en ökning med 100% i förhållande till året innan) [8]. Enligt stödordningen har företag som låtit sig börsnoteras rätt till skattefördelar som är proportionella mot deras framtida vinster. De aktuella företagen tillhör olika sektorer som sträcker sig från tillverkning till allmännyttiga tjänster och som är öppna för internationell konkurrens. Varken de italienska myndigheterna eller berörda parter har anfört argument för att visa att vissa stödmottagares särskilda egenskaper skulle kunna ligga till grund för slutsatsen att fördelar som beviljats dem inte snedvrider konkurrensen eller påverkar gemenskapshandeln. På grundval av prognoser om stödmottagarnas vinster under de tre åren närmast före börsnoteringen har kommissionen beräknat att alla de berörda företagen kommer att kunna få betydande skatteminskningar. Kommissionen har till exempel beräknat att den skatteminskning som enbart en av stödmottagarna skulle kunna omfattas av under perioden 2004–2007 skulle kunna uppgå till totalt 75 miljoner euro. Enligt klausulen om begränsning av skattelättnaden i artikel 11 i DL 269/2003 kan fördelen emellertid inte överskrida 11,7 miljoner euro under en treårsperiod. De italienska myndigheterna har dock inte anfört några argument som skulle kunna motivera att de skattelättnader som beviljats till enskilda stödmottagare kan betraktas som stöd av mindre betydelse.

(36) The Commission moreover notes that, as of 31 December 2004, ten companies were admitted to listing on the Italian stock markets (a 100% increase on the previous year) [8]. Under the scheme, the newly listed companies are entitled to tax benefits in proportion to their future profits. The companies obtaining a listing on the Italian stock markets belong to various sectors, ranging from manufacturing to public utilities, which are open to international competition. Neither the Italian authorities nor third parties have argued that, on account of certain specific features of the beneficiaries, the advantages granted to them do not affect competition and intra Community trade. In the light of projections based on the profits generated by the beneficiaries in the three years prior to their listing, the Commission has established that each of the companies could benefit from considerable tax reductions. For example, the Commission has calculated that the tax benefits which would be enjoyed by one beneficiary alone over the period 2004-07 could potentially amount to €75 million. However, because of the above-mentioned clause in Article 11 of DL 269/2003 limiting the benefits, the actual tax concession could not exceed €11,7 million over the three-year period. Italy’s submissions do not, however, demonstrate that the benefits accruing to any individual beneficiary would remain below the limit for de minimis aid.
