De bevoegde ordonnateur kan ook begunstigden die overeenkomstig artikel 163 een partnerschapskaderovereenkomst hebben gesloten, van deze verplichting vrijstellen.

Met het oog op een gezond en duurzaam beheer van de gefinancierde werkzaamheden zullen de gemeenschappelijke doelstellingen inzake samenwerking en de administratieve en financiële voorwaarden voor de toekenning van subsidies in partnerschapskaderovereenkomsten tussen de ENI en de Commissie moeten worden vastgesteld. Artikel 6 specificeert de wijze van beheer, tenuitvoerlegging en toezicht door de Commissie. Om een gezond en efficiënt beheer te waarborgen, kan de Commissie gebruikmaken van de nodige hulpmiddelen, zoals audits, evaluaties, studies, vergaderingen, voorlichtings-en bekendmakingsacties. Bovendien moeten de doeltreffendheid en het effect van de gefinancierde maatregelen geregeld worden beoordeeld.

In order to ensure sound and sustainable management of financial activities, common cooperation objectives and the administrative and financial conditions for awarding grants will need to be laid down in the framework partnership agreements between the ESOs and the Commission. Article 6 sets out the arrangements concerning management, implementation and monitoring by the Commission. In order to ensure sound and sustainable management, the Commission may make use of necessary support measures, such as audits, evaluations, studies, meetings and information and publication activities. In addition, the effectiveness and impact of the measures which are financed should be assessed on a regular basis.

5. De gemeenschappelijke doelstellingen inzake samenwerking en de administratieve en financiële voorwaarden betreffende de aan de Europese normalisatie-instellingen toegekende subsidies worden vastgesteld in partnerschapskaderovereenkomsten tussen de Commissie enerzijds en de instellingen anderzijds overeenkomstig het Financieel Reglement en Verordening (EG, Euratom) nr. 2342/2002.

5. The common cooperation objectives and the administrative and financial conditions relating to the grants awarded to the European standards organisations shall be defined in the framework partnership agreements signed by the Commission and the organisations respectively, in accordance with the Financial Regulation and Regulation (EC, Euratom) No 2342/2002.

38. Uit financieel oogpunt moet naar vereenvoudiging worden gestreefd om de Europese middelen beter te kunnen afstemmen op projecten voor specifieke doelgroepen (rechters, openbare aanklagers en advocaten). Met name de nationale instituten spelen daarbij een zeer belangrijke rol en hun rechtstreekse betrokkenheid moet ervoor zorgen dat de Europese component van de nationale programma’s wordt versterkt. Om de middellangetermijnplanning van activiteiten te vergemakkelijken kunnen partnerschapskaderovereenkomsten worden gesloten om de betrekkingen met geschikte instituten te stabiliseren; voor sommige grotere projecten kan sporadisch ook een aanbesteding worden uitgeschreven.

38. Financially speaking, there will have to be a degree of simplification to target European financing more clearly on projects that make it possible to reach out to audiences of particular importance (judges, prosecutors and lawyers). Account will be taken in particular of the pre-eminent role of national institutions whose direct involvement should make it possible to strengthen the European components in the national programmes. In addition, in order to facilitate the medium-term planning of activities, general partnership agreements could be put in place to stabilise relations with qualified institutions; calls for tender could also be issued on a one-off basis for certain larger-scale projects.

3.6.3 Artikel 5, ("Financieringswijzen"), lid 5. De hier genoemde partnerschapskaderovereenkomsten tussen de ENI en de Commissie (ex art. 5) moeten volgens het Comité echt op voet van gelijkheid worden gesloten (equal partnership) en mogen niet eenzijdig worden opgelegd. Voorts is het zaak de administratieve procedures en controles te stroomlijnen en stroeve regelingen voor certifiëring en de boekhoudkundige herziening van de toerekenbare kosten te vermijden door gebruik te maken van vaste bedragen waarbij alle marginale kosten gedekt worden.

3.6.3 Article 5. Financing arrangements, point 5. As regards the framework partnership agreements between the ESOs and the European Commission (ex. Article 5), the Committee believes that it would be advisable to ensure that these contracts are the result of a genuinely equal partnership and are not dictated unilaterally. It would also be useful to reduce red tape and administrative supervision, avoiding burdensome certification and auditing procedures of costs incurred, by introducing flat-rate systems, which would cover 100% of all marginal costs.

De specifieke subsidies op basis van partnerschapskaderovereenkomsten worden toegekend volgens de procedures waarin deze overeenkomsten voorzien, met inachtneming van de beginselen van deze titel.

Specific grants based on the framework partnership agreements shall be awarded in accordance with the procedures laid down in those agreements, in compliance with the principles of this Title.

3. De partnerschapskaderovereenkomsten worden, wat de toekenningsprocedure betreft, gelijkgesteld met subsidies; zij vallen onder de in artikel 167 bedoelde procedures inzake voorafgaande bekendmaking.

3. Partnership framework agreements shall be treated as grants for the purposes of the award procedure; they shall be subject to the ex ante advertising procedures referred to in Article 167.

6. De gemeenschappelijke doelstellingen inzake samenwerking en de administratieve en financiële voorwaarden betreffende de aan de Europese normalisatie-instellingen toegekende subsidies worden vastgesteld in partnerschapskaderovereenkomsten tussen de Commissie enerzijds en de Europese normalisatie-instellingen anderzijds overeenkomstig het Financieel Reglement en Verordening (EG, Euratom) nr. 2342/2002. Het Europees Parlement en de Raad worden van de sluiting van deze overeenkomsten in kennis gesteld.

6. The common cooperation objectives and the administrative and financial conditions relating to the grants awarded to European standardisation bodies shall be defined in the framework partnership agreements signed by the Commission and the European standardisation bodies, in accordance with the Financial Regulation and Regulation (EC, Euratom) No 2342/2002. The European Parliament and the Council shall be informed of the conclusion of these agreements.
