(8) A Chinese exporter, Gladstrong Investments Ltd, which did not export to the Community during the reference period requested to be excluded from the application of the duty. Since the Commission was not in a position to make a determination with regard to this exporter, this request could not be accepted by the Council. Nevertheless, the Council notes that the Commission is ready to initiate without delay a review whenever the exporting undertaking can show to the Commission, and supply to that effect sufficient evidence, that it did not export during the investigation period, it started exporting or has the intention to export to the Community after the investigation period and that it is not related to or associated with any of the companies subject to the present investigation for which dumping was found.

(8) Un exportateur chinois, Gladstrong Investments Ltd, qui n'a pas exporté dans la Communauté pendant la période de référence, a demandé à être exclu de l'application du droit. La Commission n'étant pas en mesure de se prononcer en ce qui concerne cet exportateur, cette demande n'a pas pu être acceptée par le Conseil. Néanmoins, le Conseil note que la Commission est prête à ouvrir sans délai une procédure de réexamen lorsque l'entreprise d'exportation pourra lui démontrer, et lui fournir à cet effet des éléments de preuve suffisants, qu'elle n'a pas exporté pendant la période de l'enquête, qu'elle a commencé à exporter ou a l'intention d'exporter dans la Communauté après la période de l'enquête et qu'elle n'est pas liée ni associée à l'une des entreprises faisant l'objet de la présente enquête, auprès desquelles des pratiques de dumping ont été constatées.
