(8) This Directive is consistent with major international work carried out on reinsurance prudential rules, in particular the IAIS.(9) This Directive follows the approach of Community legislation adopted in respect of direct insurance by carrying out the harmonisation which is essential, necessary and sufficient to ensure the mutual recognition of authorisations and prudential control systems, thereby making it possible to grant a single authorisation valid throughout the Community and apply the principle of supervision by the home Member State.

(9) Η παρούσα οδηγία ακολουθεί την προσέγγιση της κοινοτικής νομοθεσίας που έχει υιοθετηθεί για την πρωτασφάλιση, πραγματοποιώντας την εναρμόνιση που είναι ουσιώδης, αναγκαία και ικανή για την εξασφάλιση της αμοιβαίας αναγνώρισης των συστημάτων έκδοσης αδειών και εποπτικού ελέγχου, καθιστώντας έτσι εφικτή τη χορήγηση μιας και μοναδικής άδειας, με ισχύ σε ολόκληρη την Κοινότητα, και την εφαρμογή της αρχής της εποπτείας από το κράτος μέλος καταγωγής.

(6) The Action Plan for Financial Services has identified reinsurance as a sector which requires action at Community level in order to complete the internal market for financial services. Moreover, major financial fora, such as the International Monetary Fund and the International Association of Insurance Supervisors (IAIS) have highlighted the lack of harmonised reinsurance supervision rules at Community level as an important gap in the financial services regulatory framework that should be filled.

(7) Η παρούσα οδηγία σκοπό έχει τη θέσπιση κανονιστικού πλαισίου για την εποπτεία των αντασφαλιστικών δραστηριοτήτων εντός της Κοινότητας. Αποτελεί δε μέρος του κορμού της κοινοτικής νομοθεσίας στον τομέα των ασφαλίσεων που αποβλέπει στην υλοποίηση της εσωτερικής αγοράς στον τομέα αυτόν.

7.1 The Committee accepts the qualitative prudential rules provided for in Article 34 (the "prudent person principle"). Given the special features and, in particular, the international nature of the reinsurance business, such an approach is more appropriate than a rigid quantitative one. The EU is thus pursuing a modern approach that is also recommended by the International Association of Insurance Supervisors (IAIS). At the same time, however, the Committee recognises that a qualitative approach is not a blank cheque, but requires undertakings to continuously monitor and improve the capital investment process.

5.5 Η ΕΟΚΕ εκτιμά ότι οι απαιτήσεις κεφαλαιακής επάρκειας θα πρέπει να αποσαφηνίζονται στην ίδια την οδηγία και όχι σε μια μεταγενέστερη νομοθεσία της Κοινότητας. Η διαφορά αυτή υποστηρίζεται και στο ισχύον σχέδιο της Συνέλευσης, στο οποίο απαιτείται η ενσωμάτωση των σημαντικών διατάξεων στον κορμό της οδηγίας.
