(50) With regard to the use of preference shares, Italy notes that this is widely practised in Europe and it gives the example of the articles of association of Volkswagen AG and Unilever; it also points to the importance of this type of capital in companies such as Hugo Boss, Henkel and Porsche, where it accounts for 40 to 50% of the shares and, although to a lesser extent, in certain other companies such as Abertis, BMW, MAN and RWE.

Italija priminė, kad privilegijuotųjų akcijų praktika plačiai vykdoma Europoje, ir kaip pavyzdį pateikė "Volkswagen AG" bei "Unilever" įstatus; drauge ji atkreipė dėmesį į šio tipo kapitalo svarbą tokioms bendrovėms, kaip "Hugo Boss", "Henkel" ir "Porsche", kuriose jis sudaro 40 – 50% akcijų, o šiek tiek mažesniu mastu ir kitoms bendrovėms, kaip antai "Bertis", BMW, MAN, RWE.

(102) Only users from the esterquat business for fabric softeners came forward in this investigation. One industrial user, representing around 14% of total US imports during the RIP, replied to the questionnaire, two others made their views known and forwarded information on the cost structure of production of the finished goods. Esterquats are produced on the basis of TEA and are used as fabric softeners, commercialised by the so-called "soapers" such as Procter%amp% Gamble, Unilever, Henkel, Benckiser and Colgate. These industrial users argue that the increase of the TEA price is putting their businesses in danger and that there exists a shortage of supply on the Community market. Both factors would be alleviated if the anti-dumping measures were allowed to lapse. Moreover, the continuation of production in the Community is allegedly in jeopardy if profitability of the esterquat business is not improved.

(102) Šiame tyrime dalyvavo tik pramonės naudotojai, kurie naudoja ketvirtinius esterius medžiagų minkštikliams. Vienas pramonės naudotojas, kuris PTL sudarė apie 14% viso JAV importo, atsakė į klausimynus, kiti du pateikė savo nuomonę ir perdavė informaciją apie pagamintos produkcijos gamybos sąnaudų struktūrą. Ketvirtiniai esteriai yra gaminami iš TEA ir naudojami kaip medžiagų minkštikliai, kuriuos teikia į rinką Procter%amp% Gamble, Unilever, Henkel, Benckiser ir Colgate. Pramonės naudotojų teigimu, didėjant TEA kainoms, kyla grėsmė jų verslui, o Bendrijos rinkoje atsiranda pasiūlos trūkumas. Būtų galima pašalinti abu veiksnius, jei būtų leista nustoti taikyti antidempingo priemones. Be to, jei ketvirtinių esterių verslo pelningumas nepagerės, tolesnei Bendrijos gamybai tariamai kyla pavojus.
