På grundval av den upprättade beräkningen skall kommissionen i det preliminära förslaget till Europeiska unionens allmänna budget ta upp de medel som den betraktar som nödvändiga med avseende på tjänsteförteckningen och storleken på det bidrag som skall belasta den allmänna budgeten, och som den skall förelägga budgetmyndigheten enligt artikel 272 i fördraget.

( The money) can be released after a favourable opinion from Parliaments' committee responsible for the relations with the Court of Auditors, once the Court has given updated information on its current staffing problems and on how additional staff would enable the Court to assess the performance of financial control systems in the candidate countries, improve its cooperation with the national audit institutions( requirement of Treaty of Nice) and establish more detailed specific DAS assessment.

[27] "Moody's Investors Service has today placed the Prime-2 short-term rating of France Telecom (FT) on review for possible downgrade as a result of the rating agency's decision to expand the scope of the ongoing review of FT. The ongoing review for downgrade of the Baa1 long-term debt ratings of both FT and Orange plc will continue. Although Moody's has revised its guidance, indicating that a downgrade of up to two notches is now possible for the long-term ratings, the rating agency expects the ratings to remain investment grade. The review of FT's Prime-2 rating reflects Moody's increasing concerns about FT's ability to execute its debt reduction strategy. The rating agency noted that FT's slow progress in finalising asset sales, coupled with continuing deterioration in capital market conditions in this sector, could further limit FT's ability to improve its financial flexibility and meet its debt reduction targets".

(207) Frågan om uttalandena har gjorts för statens räkning blir aktuell enbart avseende uttalandet från juli. I ett sådant ekonomiskt sammanhang som beskrivits ovan uppsöker den ledande franska finanstidningen Les Echos den behöriga ministern och frågar honom om han har ett meddelande till marknaden, inte vad han anser om det som pågår. Ministerns svar till journalisten är därför varken en slump eller en analys av det som hänt. Ministern, och med honom regeringen, väljer att sända ett tydligt budskap till alla marknadsaktörer. Ministern gör tydliga uttalanden för statens och regeringens räkning (dessutom i en artikelserie om den nya regeringens ekonomiska prioriteringar). Med tanke på omständigheterna råder det inget tvivel om att intervjun med ministern uttrycker regeringens beslut att stödja FT och därför utgör en statlig handling. Såsom anges i punkt 205 har uttalandena till pressen inte heller senare dementerats eller ändrats, vare sig av ministern eller av regeringen.

Investbx will kick-start the creation of an effective local equity market, by connecting companies to investors, offering them a viable, simple, cost effective solution to raising equity, trading their shares and showcasing their activities. This trading facility will be different to traditional stock markets (namely the London Stock Exchange with its "Alternative Investment Market" — AIM) because it will operate through a visible online electronic auction market, matching buyers and sellers at a single price with investment via an online execution-only broker. Online auctions will only be carried out a few times per month. At the same time Investbx will encourage a longer term view of investing, emphasising the main objective of raising money for SMEs in the community rather than the ability to frequently trade shares as provided by the existing London based markets.
