Considerando que, para melhorar a gestão das medidas, os adiantamentos a pagar aos Estados-membros, nos termos do artigo 7º do Regulamento (CE) nº 296/96 da Comissão (3), com a última redacção que lhe foi dada pelo Regulamento (CE) nº 1391/74 (4), não podem ser deduzidos dos montantes não utilizados no último ano mas sim dos do antepenúltimo ano e que, além disso, a fixação do montante máximo da participação financeira da Comunidade não pode ter lugar antes de as dotações terem sido autorizadas pela autoridade orçamental;

Whereas, in order to improve administration of the measures, the advances to be paid to the Member States under Article 7 of Commission Regulation (EC) No 296/96 (3), as last amended by Regulation (EC) No 1391/97 (4) may not be deducted from the amounts not used in the previous year but in the year before that, and whereas the maximum amount of the Community financial contribution may not be set before the appropriations have been authorised by the budget authority;

O montante máximo fixado em conformidade com o nº 2 do artigo 4º do Regulamento (CE) nº 723/97, reduzido dos montantes pagos a título do antepenúltimo ano eventualmente não utilizados, será considerado como despesas referidas no artigo 7º do Regulamento (CE) nº 296/96 da Comissão, a título do mês em que for fixado pela Comissão.».3. É inserido o artigo 3ºA, com a seguinte redacção:

The maximum amount set as provided for in Article 4(2) of Regulation (EC) No 723/97, as reduced by any unused amount paid in respect of the previous year but one, shall be deemed to be expenditure as referred to in Article 7 of Commission Regulation (EC) No 296/96 under the month in which it is set by the Commission.`3. The following Article 3a is added:

-a antepenúltima frase do primeiro parágrafo do ponto 2.2.4.1.1, « A direcção e o sistema de travagem não devem ter a mesma fonte de energia », passa a ter a seguinte redacção:« Sem prejuízo das disposições da Directiva 76/432/CEE relativa à travagem, se existir uma ligação hidráulica entre o dispositivo hidráulico de direcção e o dispositivo hidráulico de travagem, e se ambos forem alimentados pela mesma fonte de energia, o esforço para accionar o dispositivo de direcção não deve exceder 40 daN em caso de falha de um ou dos dois sistemas ».

-The penultimate sentence of the first paragraph of point 2.2.4.1.1, i.e. 'The steering and braking systems must not have a common source of energy', is replaced by the following: 'Without prejudice to the provisions of Directive 76/432/EEC regarding braking, if there is a hydraulic connection between the hydraulic steering equipment and the hydraulic braking equipment, and if both are supplied from the same energy source, the force required to activate the steering equipment shall not exceed 40 daN if either of the systems should fail'.

11.1. Nos termos do presente Acordo, a contribuição financeira da Suíça para o programa Euratom é fixada anualmente num montante tal que a razão entre este montante e o da contribuição financeira da Euratom para o seu programa corresponda à razão existente entre o produto nacional bruto da Suíça e o total do produto nacional bruto da Euratom e da Suíça no decurso do antepenúltimo ano.

11.1. The financial contribution of Switzerland to the Euratom programme under this Agreement shall be fixed annually at a sum which bears the same relation to Euratom's share of the cost of the Euratom programme as the Swiss gross domestic product bore to the total gross domestic product of both Euratom and Switzerland in the antepenultimate year.

2. Estes pagamentos serão realizados na conta Sapard em euros, em conformidade com os n.os 1, 2, segundo parágrafo, 3, com excepção das alíneas a) e d) e dos antepenúltimo e penúltimo parágrafos, e 4, alíneas a) e b), do artigo 32.o do Regulamento (CE) n.o 1260/1999.

Payments shall be made in euro to the Sapard euro account, and in accordance with the provisions of Article 32(1), th second subparagraph of Article 32(2), Article 32(3) with the exception of subparagraphs (a), (d) and the second and third last subparagraphs, and in accordance with Article 32(4)(a) and (b) of Regulation (EC) No. 1260/1999.

4. No ponto 2, antepenúltima linha, do anexo IV, os termos "no anexo III" são substituídos por "no anexo VII do Regulamento (CE) 213/2001".

b) Os dados provisórios relativos às suas emissões de monóxido de carbono (CO), dióxido de enxofre (SO2), óxidos de azoto (NOx) e compostos orgânicos voláteis (COV) durante o penúltimo ano (ano X-2), bem como os dados definitivos relativos ao antepenúltimo ano (ano X-3);

(b) provisional data on their emissions of carbon monoxide (CO), sulphur dioxide (SO2), nitrogen oxides (NOx) and volatile organic compounds (VOC) during the year before last (year X-2), together with final data for the year three-years previous (year X-3);

3. Para efeitos da contabilidade prevista nos artigos 132.o a 137.o do Regulamento Financeiro e sob reserva do disposto no artigo 213.o, a conversão entre o euro e qualquer outra moeda será efectuada com recurso à taxa contabilística mensal do euro. Esta taxa será fixada pela Comissão com base em qualquer fonte de informação que considere fiável e partindo da taxa do antepenúltimo dia útil do mês que precede aquele relativamente ao qual a taxa é fixada.

3. For the purposes of the accounts provided for in Articles 132 to 137 of the Financial Regulation and subject to Article 213, conversion between the euro and another currency shall be made using the monthly accounting rate of the euro. That accounting rate shall be established by the Commission by means of any source of information it regards as reliable, on the basis of the rate on the penultimate working day of the month preceding that for which the rate is established.

3. Os Estados-Membros comunicarão à Comissão, o mais tardar no dia 30 de Setembro de cada ano, no referente à antepenúltima campanha de comercialização:

No texto italiano há uma contradição na antepenúltima linha, onde se refere que não deve haver distinção entre os custos de cultivo das vinhas de planície e de montanha; pelo contrário, o sentido do trabalho em comissão e, obviamente, o sentido das alterações apresentadas é que, para o cultivo das vinhas de planície e de montanha, os custos devem ser comparáveis aos das vinhas em zonas de colina.

In the Italian text there is a contradiction in the third line from the end where it says that no distinction should be made between the costs of planting vineyards in lowland areas and on mountains.In fact, the sense of the committee's work and, obviously, the sense of the amendments which have been tabled is that the costs of planting vineyards in lowland areas and on mountains should be compared with the costs of hill vineyards.

A terminar, no que diz respeito ao antepenúltimo número do relatório da senhora deputada McKenna, que refere a « promoção da produção de energia em pequenas instalações », talvez a relatora encontrasse maior eco se falasse em encorajar e dar incentivos para a consecução de tais objectivos.

As regards the final paragraph of Ms McKenna 's report, which advocates that 'energy production at small-scale... plants should be promoted', it might carry more weight if mention were made of encouraging and offering incentives to achieve such objectives.
