Aprēķinot procesam nepieciešamo enerģijas daudzumu (PER) vai apdedzināšanai nepieciešamo enerģijas daudzumu (ERF), ņem vērā konkrētos enerģijas nesējus gan attiecībā uz visu uzņēmumu, gan tikai attiecībā uz apdedzināšanas fāzi.

(7) Izmeklēšanā noskaidroja, ka attiecīgais ražojums IP tika importēts arī ar KN kodiem ex 6815 10 10, ex 6902 10 00 un ex 6903 90 90 (līdz 2004. gada 1. janvārim ex 6903 90 20). Taču KN kodi, kas ietilpst 69. nodaļā (keramikas izstrādājumi), ir jāizmanto vienīgi apdedzinātiem izstrādājumiem, nevis attiecīgajam ražojumam, kas ir neapdedzināts. Turklāt KN kods 6815 10 10 attiecas uz ražojumiem, kuru īpašības pamatā nosaka ogleklis, bet attiecīgā ražojuma īpašības pamatā nosaka magnija oksīda saturs. Tādēļ attiecīgā ražojuma imports ar šiem kodiem uzskatāms par nepieņemamu. Lai turpmāk izvairītos no nepareizas klasifikācijas un nodrošinātu pareizu kodu izmantošanu, muitas iestādes ir brīdinātas īpašā riska informācijas lapā.

(7) The investigation has shown that the product concerned was also imported under CN codes ex 6815 10 10, ex 6902 10 00 and ex 6903 90 90 (ex 6903 90 20 before 1 January 2004) during the IP. However, CN codes falling within chapter 69, ceramic products, should only be used for fired products and not for the product concerned which is unfired. In addition, CN code 6815 10 10 includes products which are essentially characterised by carbon, whereas the product concerned is essentially characterised by the magnesium oxide content. Therefore, imports of the product concerned under these codes should be considered unacceptable should they be used. In order to prevent misclassifications in the future, and to ensure that the codes will be correctly used, the customs authorities have been alerted via a special risk information form.

(8) Out of the factors claimed by the parties the main explanation for this price increase seems to be a shortage in roasting capacities, i.e., the capacities to transform molybdenum concentrate into molybdenum oxide (which is then converted into ferro molybdenum). This driving factor explains to a large extent the price increases and the demand-supply imbalance that this has generated in the Community market. On the basis of the information presented, it appears that the roasting capacity shortfall will disappear in all likelihood in the course of 2007 as a result of new roasting capacity coming on stream.
