COMPETITION AND PREFERENCES

-ES prekybos preferencijos: dėmesys 49 skurdžiausioms šalims (MPŠ – mažiau pažengusios šalys) [2] ir preferencinio statuso suteikimas drabužių pusfabrikačiams;

-EU trade preferences: focusing on the 49 poorest countries (LDCs -Less Developed Countries) [2], and extending preferential status to intermediate clothing products;

kadangi joms turėtų būti priskirtos ir tos šalys bei teritorijos, kurių tam tikriems žemės ūkio produktams taikomos bendrosios muitų tarifų preferencijos;

whereas the countries and territories enjoying generalized tariff preferences for certain agricultural products should be used for this purpose;

šios preferencijos įgavo laipsnišką Bendrojo muitų tarifo muitų mažinimo ir nuo 1978 m. iki 1994 m. gruodžio 31 d. visiško šių mokesčių sustabdymo tendenciją.

these preferences took the form of a gradual reduction of Common Customs Tariff duties and, from 1978 to 31 December 1994, the complete suspension of these duties.

Dėl to Pakistano Islamo Respublika nustatys ir pateiks Bendrijai svarstyti sritis, kuriose Bendrijos bendrosios preferencijos gali būti tobulinamos, ypač atsižvelgiant į Bendrą ketinimų pareiškimą.

In this connection, the Islamic Republic of Pakistan will identify for consideration by the Community the areas in which the Community's generalized preferences can be improved, more especially in the context of the provisions of the Joint Declaration of Intent.

Pagal 1 straipsnyje išvardytus kriterijus toliau nurodytos šalys ir teritorija išbraukiamos iš šalių ir teritorijų, kurioms suteikiamos bendrosios preferencijos, nurodytos Reglamentų (EB) Nr. 3281/94 ir (EB) Nr. 1256/96 III priede, sąrašo:

Under the criteria listed in Article 1, the following countries and territory shall be withdrawn from the list of countries and territories benefiting from the generalized preferences set out in Annex III to Regulations (EC) No 3281/94 and (EC) No 1256/96:

Šis skirsnis mutatis mutandis taikomas nustatant, ar produktai, gali būti laikomi turinčiais eksportuojančių lengvatas gaunančių Respublikų, kurioms taikomos preferencijos, kilmės statusą juos importuojant į Ceutą ir Melilą, ar turinčiais Ceutos ir Melilos kilmės statusą.

This section shall apply mutatis mutandis in determining whether products may be regarded as originating in the exporting beneficiary republics benefiting from the preferences when imported into Ceuta and Melilla or as originating in Ceuta and Melilla.

kadangi tokia metodika yra objektyvi ir aiški, nes joje yra rodiklis, kuris yra mažiausiai prieštaringas ir labiausiai atspindi dabartinę reikalų padėtį šalyse, kurioms suteikiamos bendrosios tarifo preferencijos, ir kartu leidžia toliau siekti vieno iš GSP tikslų, būtent šalių gavėjų eksporto diversifikacijos;

Whereas this approach is objective and clear in that it includes the indicator which is the least controversial and the most representative of the current state of affairs in the beneficiary countries, while at the same time making it possible to maintain one of the objectives of the GSP, namely diversification of the beneficiary countries'exports;

kadangi tokia metodika yra objektyvi ir aiški, nes joje yra rodiklis, kuris yra mažiausiai prieštaringas ir labiausiai atspindi dabartinę reikalų padėtį šalyse, kurioms suteikiamos bendrosios tarifo preferencijos, ir kartu leidžia toliau siekti vieno iš GSP tikslų, būtent šalių gavėjų eksporto diversifikacijos;

kadangi Reglamentų (EB) Nr. 3281/94 [3] ir (EB) Nr. 1256/96 [4] 6 straipsnyje yra nustatyta, kad, remiantis objektyviais, aiškiai apibrėžtais kriterijais, labiausiai pažengusioms šalims, kurioms suteikiamos bendrosios tarifų preferencijos, toji teisė pagal tuos reglamentus netaikoma nuo 1998 m. sausio 1 d.;

Whereas it is laid down in Article 6 of Regulations (EC) No 3281/94 (3) and (EC) No 1256/96 (4) that the most advanced beneficiary countries shall be excluded from entitlement under those Regulations from 1 January 1998 on the basis of objective, clearly defined criteria;

kadangi reikėtų apibrėžti besivystančias šalis, kurių grūdų produktai gali būti įvežti į PUD be importo mokesčio, taikomo remiantis Reglamento (EEB) Nr. 3763/91 2 straipsnyje ir 3 straipsnio 1 dalyje nustatytomis konkrečiomis tiekimo priemonėmis; kadangi joms turėtų būti priskirtos ir tos šalys bei teritorijos, kurių tam tikriems žemės ūkio produktams taikomos bendrosios muitų tarifų preferencijos;

Whereas the developing countries whose cereals products may enter the FOD exempt from the import levy pursuant to the specific supply arrangements established by Articles 2 and 3 (1) of Regulation (EEC) No 3763/91 should be defined; whereas the countries and territories enjoying generalized tariff preferences for certain agricultural products should be used for this purpose;

3. Bendrijos kilmės gaminių importui į Libaną taikomi muitai, įvesti taikant tokias išimtines priemones, negali viršyti 25% ad valorem muitų ir jais turi būti išlaikytas preferencijos Bendrijos kilmės gaminiams elementas. Bendra importuotų gaminių, kuriems taikomos šios gaminių vertės, negali viršyti 20% metinio vidurkio viso pramonės gaminių importo iš Bendrijos per paskutinius trejus metus, apie kuriuos turima statistinių duomenų.

3. Customs duties on imports into Lebanon of products originating in the Community that are introduced by such exceptional measures may not exceed 25% ad valorem and shall maintain an element of preference for products originating in the Community. The total value of imports of the products which are subject to these measures may not exceed 20% of the yearly average of total imports of industrial products from the Community during the last three years for which statistics are available.

(6) laikantis pasiūlymo, padaryto Jungtinių Tautų konferencijoje dėl prekybos ir plėtros (UNCTAD) ir kartu su bendrųjų preferencijų sistema, Europos bendrija 1971 m. įvedė tarifines preferencijas džiuto ir kokoso pluošto produktams, kurių kilmės šalys yra tam tikros besivystančios šalys; šios preferencijos peraugo į Bendrojo muitų tarifo muitų laipsnišką sumažinimą ir nuo 1978 m. iki 1994 m. gruodžio 31 d. – visišką šių muitų sustabdymą;

Vienos šalies ar teritorijos išbraukimas iš šalių ir teritorijų, kurioms, remiantis 1 straipsnyje nurodytais kriterijais, suteikiamos bendrosios preferencijos, sąrašo neturi daryti poveikio galimybei naudoti tos šalies kilmės produktus pagal regioninį kaupiamąjį mechanizmą, taikomą regioninėms grupėms, nurodytoms 1993 m. liepos 2 d. Komisijos reglamento (EB) Nr. 2454/93, nustatančio Tarybos reglamento (EEB) Nr. 2913/92, nustatančio Bendrijos muitinės kodeksą [5], įgyvendinimo nuostatas, 72 straipsnio 3 dalyje, jei šalis yra regioninės grupės narė nuo daugiametės preferencijų sistemos, taikomos atitinkamam produktui, įsigaliojimo ir jei ji nelaikoma galutinio produkto kilmės šalimi Reglamento (EB) Nr. 2454/93 72a straipsnio prasme.

The withdrawal of one country or territory from the list of countries and territories benefiting from generalized preferences by virtue of the criteria set out in Article 1 shall not affect the possibility of using products originating in that country under the regional cumulation mechanism applicable to regional groupings referred to in Article 72 (3) of Commission Regulation (EC) No 2454/93 of 2 July 1993 laying down provisions for the implementation of Council Regulation (EEC) No 2913/92 establishing the Community Customs Code (5), provided that the country has been a member of the regional grouping since the multiannual system of preferences applicable to the product concerned entered into force and is not considered to be the country of origin of the final product within the meaning of Article 72a of Regulation (EC) No 2454/93.
