The request was lodged by the Open Joint Stock Company (OJSC) "Mineral and Chemical Company EuroChem" ("the applicant"), an exporting producer from Russia.

(51) Since the level of co-operation was high (more than 80% of the exports of the product concerned from Ukraine to the Community), the residual margin was set at the same level as the one established for the co-operating exporting producers OJSC Nizhnedneprovsky Tube Rolling Plant (NTRP) and CJSC Nikopolsky seamless tubes plant ‘Nikotube’, namely 97,3%.

(51) Koska yhteistyössä toimimisen aste oli korkea (yli 80 prosenttia tarkasteltavana olevan tuotteen viennistä Ukrainasta yhteisöön), jäännöspolkumyyntimarginaali vahvistettiin samalle tasolle kuin yhteistyössä toimineille vientiä harjoittaville tuottajille NTRP ja Nikotube vahvistettu marginaali eli 97,3 prosentiksi.

(51) Since the level of cooperation was high (more than 80% of the exports of the product concerned from Ukraine to the Community), the residual margin was set at the same level as the one established for the cooperating exporting producers OJSC Nizhnedneprovsky Tube Rolling Plant (NTRP) and CJSC Nikopolsky seamless tubes plant "Nikotube", namely 97,3%.

(51) Koska yhteistyössä toimimisen aste oli korkea (yli 80 prosenttia tarkasteltavana olevan tuotteen viennistä Ukrainasta yhteisöön), jäännöspolkumyyntimarginaali vahvistettiin samalle tasolle kuin yhteistyössä toimineille vientiä harjoittaville tuottajille NTRP ja Nikotube vahvistettu marginaali eli 97,3 prosentiksi.

(138) Subsequent to the disclosure of the essential facts and considerations, on the basis of which it was concluded that the level of the existing anti-dumping margin should be amended, the Ukrainian companies OJSC Nizhnedneprovsky Tube Rolling Plant (NTRP), CJSC Nikopolsky seamless tubes plant "Nikotube" and their related trader/holding company "Interpipe" offered a joint undertaking in accordance with Article 8(1) of the basic Regulation.

(138) Kun olennaiset tosiasiat ja huomiot, joiden perusteella pääteltiin, että voimassa olevan polkumyyntimarginaalin tasoa olisi muutettava, oli annettu tiedoksi, ukrainalaisyritykset NTRP, Nikotube ja niihin etuyhteydessä oleva kauppias/holdingyhtiö Interpipe tarjosivat yhteistä sitoumusta perusasetuksen 8 artiklan 1 kohdan mukaisesti.

(138) Subsequent to the disclosure of the essential facts and considerations, on the basis of which it was concluded that the level of the existing anti-dumping margin should be amended, the Ukrainian companies OJSC Nizhnedneprovsky Tube Rolling Plant (NTRP), CJSC Nikopolsky seamless tubes plant ‘Nikotube'and their related trader/holding company ‘Interpipe'offered a joint undertaking in accordance with Article 8(1) of the basic Regulation.

(138) Kun olennaiset tosiasiat ja huomiot, joiden perusteella pääteltiin, että voimassa olevan polkumyyntimarginaalin tasoa olisi muutettava, oli annettu tiedoksi, ukrainalaisyritykset NTRP, Nikotube ja niihin etuyhteydessä oleva kauppias/holdingyhtiö Interpipe tarjosivat yhteistä sitoumusta perusasetuksen 8 artiklan 1 kohdan mukaisesti.

(4) Accordingly, by Regulation (EC) No 1001/2004 [5], the Commission accepted as a special measure short-term undertakings from: (i) an exporting producer of the product concerned in Ukraine (OJSC "Azot"); (ii) an exporting producer in Russia (OJSC MCC Eurochem in respect of goods produced at its production facilities of JSC Nak Azot, Russia) and sold by its related company (Cumberland Sound Ltd, British Virgin Islands); (iii) two related Russian exporting producers jointly (Joint Stock Company "Acron" and Joint Stock Company "Dorogobuzh").

(4) Komissio hyväksyi siksi erityistoimenpiteenä asetuksella (EY) N:o 1001/2004 [5] lyhytkestoiset sitoumukset i) yhdeltä tarkasteltavana olevan tuotteen Ukrainassa toimivalta vientiä harjoittavalta tuottajalta (OJSC "Azot"), ii) yhdeltä Venäjällä toimivalta vientiä harjoittavalta tuottajalta (OJSC MCC Eurochem niiden tuotteiden osalta, jotka on tuotettu sen tuotantolaitoksessa JSC Nak Azot, Venäjä, ja jotka myy siihen etuyhteydessä oleva yritys Cumberland Sound Ltd, Brittiläiset Neitsytsaaret) sekä iii) kahdelta toisiinsa etuyhteydessä olevalta Venäjällä toimivalta vientiä harjoittavalta tuottajalta yhdessä (JSC "Acron" ja JSC "Dorogobuzh").

1. On 13 October 2006, the Commission received a notification of a proposed concentration pursuant to Article 4 of Council Regulation (EC) No 139/2004 [1] by which the undertakings OJSC Novolipetsk Steel ("NLMK", Russia) and Duferco Participations Holding Ltd ("Duferco", Guernsey), acquire within the meaning of Article 3(1)(b) of the Council Regulation joint control of the undertaking Steel Invest%amp% Finance (Luxembourg) S.A. ("the Joint Venture Company", Luxembourg), to which a group of companies currently solely controlled by Duferco ("the JV companies") will be transferred, by way of purchase of shares.

Komissio vastaanotti 13. lokakuuta 2006 neuvoston asetuksen (EY) N:o 139/2004 [1] 4 artiklan mukaisen ilmoituksen ehdotetusta yrityskeskittymästä, jolla venäläinen yritys OJSC Novolipetsk Steel (NLMK) ja guernseyläinen yritys Duferco Participations Holding Ltd (Duferco) hankkivat asetuksen 3 artiklan 1 kohdan b alakohdassa tarkoitetun yhteisen määräysvallan luxemburgilaisessa yrityksessä Steel Invest%amp% Finance S.A. (luxemburgilainen yhteisyritys), johon tällä hetkellä ainoastaan Dufercon määräysvallassa oleva yritysryhmä (yhteisyritykseen siirrettävät yritykset) siirretään ostamalla osakkeita.
