The Regulation on Consumer Protection Cooperation establishes a network of public authorities responsible for the protection of consumer economic interests, partially harmonises their investigation powers and provides for mutual assistance. The OFT will therefore be able to ask its Belgian counterpart to adopt enforcement measures.

Regula par sadarbību patērētāju tiesību aizsardzības jomā izveido tādu valsts iestāžu tīklu, kuras ir atbildīgas par patērētāju ekonomisko interešu aizsardzību, daļēji harmonizē to izmeklēšanas pilnvaras un nodrošina savstarpēju palīdzību. More substantive definition problems have also emerged. In a recent ruling by the European Court of Justice[23] in which the OFT sought a preliminary ruling on the meaning of “transport services”, the Court applied a broader interpretation than the Commission or the OFT advocated and excluded the application of the Directive to car rental services.

The UK Office of Fair Trading (OFT) brought the only case so far. A Belgium company was sending unsolicited mail order catalogues to UK residents along with notification of a prize win. Consumers were led to believe that they had to make a purchase from the catalogue to secure the alleged win. However, prize winners were pre-selected and the vast majority of recipients were unlikely to receive the prize. The OFT claimed that the prize notifications were misleading consumers and sought an injunction from the Belgium courts. The latter ordered the cessation of the advertising.

Apvienotās Karalistes Godīgas tirdzniecības prakses dienests (Office of Fair Trading – OFT) līdz šim ierosinājis tikai vienu lietu. Beļģijas uzņēmums nosūtījis Apvienotās Karalistes iedzīvotājiem nepieprasītus katalogus preču pasūtīšanai pa pastu līdz ar informāciju par iespēju laimēt. Patērētājus rosināja domāt, ka viņiem jāveic pirkums no kataloga, lai saņemtu solīto laimestu. Tomēr balvu ieguvējus izvēlējās iepriekš, un vairums saņēmēju nemaz nevarēja saņemt laimestu. OFT izvirzīja prasību, ka informācija par laimestu maldināja patērētājus, un pieprasīja aizliegumu no Beļģijas tiesas. Tā lika reklāmu izbeigt.

716. The private remedies roundtable focused on discovery and gathering of evidence. This was the first roundtable in the working party on private remedies and additional discussions will follow in 2006. A Committee working party also discussed, following expert presentations, how to measure the harm caused by cartels and how to assess the benefits of competition enforcement. The discussion showed that calculations of damages find their use mostly in private enforcement. Some authorities (e.g. the OFT) are also looking at the impact of cartels to justify their own work.

648. Apaļā galda apspriedēs par privātiem tiesiskās aizsardzības līdzekļiem galvenā uzmanība tika pievērsta pierādījumu atklāšanai un apkopošanai. Tās bija privāto tiesiskās aizsardzības līdzekļu darba grupas pirmās apaļā galda apspriedes, kam 2006. gadā sekos papildu diskusijas. Pēc ekspertu uzklausīšanas Komitejas darba grupa ir apspriedusi karteļu nodarītā kaitējuma un konkurences tiesību aktu piemērošanas pozitīvo rezultātu novērtējuma metodes. Apspriedes rāda, ka zaudējumu aprēķins noder galvenokārt privāta tiesību aktu piemērošanas nodrošinājuma gadījumos.
