In the provisional Regulation, the facts established for Hanny Magnetics (Zuhai) Ltd during the Commission's investigation demonstrated that this company is free of government intrusion in the execution of its business operations, and individual treatment was granted.

V připomínkách obou stran se namítalo, že 3,5″ diskety s vyšší kapacitou nejsou výrobky obdobnými běžným 3,5″ disket a měly by se proto vyloučit.

Both submissions argued that the higher-capacity 3,5%quot% microdisks are not a like product with conventional 3,5%quot% microdisks, and should therefore be excluded.

Skutečnosti uvedené v prozatímním nařízení a zjištěné během šetření Komise u firmy Hanny Magnetics (Zuhai) Ltd názorně ukazují, že tato společnost je v podnikatelské činnosti oproštěna od zásahů vlády a individuální přístup byl poskytnut; s ohledem na princip oprávněných očekávání a právní jistoty je Komise toho názoru, že individuální přístup poskytnutý této společnosti by měl být zachován; s ohledem na malý rozdíl nalezený v dumpingovém rozpětí u tohoto výrobce a ostatních výrobců je riziko obcházení cla minimální.

In the provisional Regulation, the facts established for Hanny Magnetics (Zuhai) Ltd during the Commission's investigation demonstrated that this company is free of government intrusion in the execution of its business operations, and individual treatment was granted. In the light of the principle of legitimate expectations and legal certainty, the Commission considers that the individual treatment granted to this company should be maintained. Furthermore, given the small difference found in the dumping margin for this producer and that applicable to the other producers, the risk of circumvention is minimal.
