De door Nederland aan voordien in een andere lidstaat geregistreerde motervoertuigen opgelegde technische controles als voorwaarde voor registratie in het nationale kentekenregister is niet gerechtvaardigd in het licht van de in artikel 30 EG genoemde doelstellingen of om te voldoen aan enige dwingende eis als erkend in de jurisprudentie van het Hof.
