The request was lodged by the Community Federation of Lighting Industry of Compact Fluorescent Lamps Integrated (2 CFLI) ("the applicant").

Dit verzoek werd op 16 augustus 2004 ingediend door Lighting Industry and Trade in Europe (LITE) namens producenten en importeurs van CFL-i's in de Gemeenschap.

The request has been lodged on 16 August 2004 by Lighting Industry and Trade in Europe (LITE) on behalf of producers and importers of CFL-i in the Community.

Het nieuwe onderzoek blijft beperkt tot het aspect dumping en tot één producent/exporteur, namelijk Lisheng Electronic%amp% Lighting (Xiamen) Co., Ltd ("het bedrijf").

The review is limited in scope to the examination of dumping as far as one exporting producer, Lisheng Electronic%amp% Lighting (Xiamen) Co., Ltd ("the company") is concerned.

De European Lighting Companies Federation ("de klagende partij") voerde aan dat bij het onderzoek naar de schade rekening had moeten worden gehouden met de gegevens die betrekking hebben op Philips Lighting B.V.

The European Lighting Companies Federation ("the complainant") claimed that data relating to Philips Lighting B.V.

49. Bij het onderzoek bleek dat Ecopak Lighting in Pakistan over een installatie voor de productie/assemblage van CFL-i’s beschikte. Ecopak Lighting heeft banden met een Chinese onderneming, op wier producten een definitief antidumpingrecht van toepassing is, namelijk Firefly Lighting Co. Ltd.

49. The investigation revealed that Ecopak Lighting had a production/assembly facility for CFL-i in Pakistan. Ecopak Lighting is related to a Chinese company subject to the definitive anti-dumping duty, namely Firefly Lighting Firefly Lighting Co. Ltd.

(49) Bij het onderzoek bleek dat Ecopak Lighting in Pakistan over een installatie voor de productie/assemblage van CFL-i’s beschikte. Ecopak Lighting heeft banden met een Chinese onderneming, op wier producten een definitief antidumpingrecht van toepassing is, namelijk Firefly Lighting Co. Ltd.

(49) The investigation revealed that Ecopak Lighting had a production/assembly facility for CFL-i in Pakistan. Ecopak Lighting is related to a Chinese company subject to the definitive anti-dumping duty, namely Firefly Lighting Co. Ltd.

Na overleg met het Raadgevend Comité is de Commissie tot de conclusie gekomen dat er voldoende bewijsmateriaal is om een gedeeltelijk tussentijds nieuw onderzoek naar dumping door Lisheng Electronic%amp% Lighting (Xiamen) Co., Ltd in te leiden. De Commissie opent derhalve een nieuw onderzoek overeenkomstig artikel 11, lid 3, van de basisverordening.

Having determined, after consulting the Advisory Committee, that sufficient evidence exists to justify the initiation of a partial interim review, limited to dumping aspects as far Lisheng Electronic%amp% Lighting (Xiamen) Co., Ltd is concerned, the Commission hereby initiates a review in accordance with Article 11 (3) of the basic Regulation.

Het verzoek werd op 18 april 2006 ingediend door de federatie 2 CFLI (Community Federation of Lighting Industry of Compact Fluorescent Lamps Integrated) (hierna "de indiener" genoemd) namens producenten die goed zijn voor een groot deel, in dit geval meer dan 25%, van de totale productie van geïntegreerde elektronische compacte fluorescentielampen (CFL-i) in de Gemeenschap.

The request was lodged on 18 April 2006 by the Community Federation of Lighting Industry of Compact Fluorescent Lamps Integrated (2 CFL-i) ("the applicant") on behalf of producers representing a major proportion, in this case more than 25%, of the total Community production of integrated electronic compact fluorescent lamps (CFL-i).

91. Voor de onderneming in Pakistan werd vastgesteld (zie overweging 49) dat zij het antidumpingrecht ontdook in de zin van artikel 13, lid 2, van de basisverordening. Bovendien heeft deze onderneming banden met een onderneming waarop maatregelen van toepassing zijn, Firefly Lighting Co. Ltd.. Daarom kon geen vrijstelling worden verleend overeenkomstig artikel 13, lid 4, van de basisverordening.

91. Finally, as explained in recital (49) and following, the company in Pakistan was found to circumvent the anti-dumping duty in force pursuant to Article 13(2) of the basic Regulation. Moreover, this company is related to a company under measures, Firefly Lighting Co. Ltd.. On this basis, its request for an exemption in accordance with Article 13(4) has to be rejected.

(91) Voor de onderneming in Pakistan werd vastgesteld (zie overweging 49) dat zij het antidumpingrecht ontdook in de zin van artikel 13, lid 2, van de basisverordening. Bovendien heeft deze onderneming banden met een onderneming waarop maatregelen van toepassing zijn, Firefly Lighting Co. Ltd. Daarom kon geen vrijstelling worden verleend overeenkomstig artikel 13, lid 4, van de basisverordening.

(91) Finally, as explained in recital 49 and following, the company in Pakistan was found to be circumventing the anti-dumping duty in force pursuant to Article 13(2) of the basic Regulation. Moreover, this company is related to a company subject to measures, Firefly Lighting Co. Ltd.. On this basis, its request for an exemption in accordance with Article 13(4) has to be rejected.

55. De eerder beschreven wijziging in de handelsstromen viel samen met de aanvang van de assemblage van CLF-i’s in Pakistan. De in Pakistan geassembleerde CFL-i’s werden vanuit Pakistan naar de EG verkocht, maar de Chinese gelieerde onderneming verkocht naar andere markten rechtstreeks vanuit China. Afnemers van Ecopak Lighting in de EG bestelden CLF-i’s rechtstreeks bij de gelieerde onderneming in China.

55. The above described change in the pattern of trade coincided with the establishment of assembly operations of CFL-i in Pakistan. It was also found that while sales of CFL-i to the Community were made from Pakistan, the Chinese related company continued supplying other markets directly from the PRC. Customers of Ecopak Lighting in the Community directly ordered CLF-i from the related company in China.

Als Lisheng Electronic%amp% Lighting (Xiamen) Co., Ltd de status van marktgericht bedrijf krijgt, kan de Commissie zo nodig de gegevens over de normale waarde in een geschikt land met een markteconomie gebruiken ter vervanging van onbetrouwbare gegevens over de kosten of prijzen in de Volksrepubliek China of bij gebrek aan betrouwbare gegevens. De Commissie is voornemens ook hiervoor Mexico als referentieland te gebruiken.

Furthermore, in the event that Lisheng Electronic%amp% Lighting (Xiamen) Co., Ltd is granted market economy status, the Commission may, if necessary, also use findings concerning the normal value established in an appropriate market economy country, e.g. for the purpose of replacing any unreliable cost or price elements in the People's Republic of China which are needed in establishing the normal value, if reliable required data are not available in the People's Republic of China. The Commission envisages using Mexico also for this purpose.

(55) De eerder beschreven wijziging in de handelsstromen viel samen met de aanvang van de assemblage van CLF-i’s in Pakistan. De in Pakistan geassembleerde CFL-i’s werden vanuit Pakistan naar de Europese Gemeenschap verkocht, maar de Chinese gelieerde onderneming verkocht naar andere markten rechtstreeks vanuit China. Afnemers van Ecopak Lighting in de Europese Gemeenschap bestelden CLF-i’s rechtstreeks bij de gelieerde onderneming in China.

(55) The change described above in the pattern of trade coincided with the establishment of assembly operations of CFL-i in Pakistan. It was also found that while sales of CFL-i to the Community were made from Pakistan, the Chinese related company continued supplying other markets directly from the PRC. Customers of Ecopak Lighting in the Community ordered CLF-i directly from the related company in China.

33. Bovendien werd vastgesteld dat de stijging van de Chinese invoer in 2003 en 2004 hoofdzakelijk moest worden toegeschreven aan de gestegen uitvoer van ondernemingen waarop geen of lage antidumpingrechten van toepassing waren, namelijk Lisheng Electronic%amp% Lighting (Xiamen) Co., Ltd (‘Lisheng’) en Shenzhen Zuoming Electronic Co., Ltd (‘Shenzhen’), terwijl de invoer afkomstig van de overige Chinese ondernemingen in die periode betrekkelijk stabiel bleef.

33. In addition, it was found that the resurge in the Chinese imports in 2003 and 2004 was mainly due to an increase in exports from companies subject to no or low anti-dumping duties -Lisheng Electronic%amp% Lighting (Xiamen) Co., Ltd (‘Lisheng’) and Shenzhen Zuoming Electronic Co., Ltd (‘Shenzhen’)-, while import levels from the remaining companies were relatively stable during the same period.

(33) Bovendien werd vastgesteld dat de stijging van de Chinese invoer in 2003 en 2004 hoofdzakelijk moest worden toegeschreven aan de gestegen uitvoer van ondernemingen waarop geen of lage antidumpingrechten van toepassing waren, namelijk Lisheng Electronic%amp% Lighting (Xiamen) Co., Ltd ("Lisheng") en Shenzhen Zuoming Electronic Co., Ltd ("Shenzhen"), terwijl de invoer afkomstig van de overige Chinese ondernemingen in die periode betrekkelijk stabiel bleef.

(23) De European Lighting Companies Federation ("de klagende partij") voerde aan dat bij het onderzoek naar de schade rekening had moeten worden gehouden met de gegevens die betrekking hebben op Philips Lighting B.V. ("Philips") omdat deze onderneming eveneens schade had geleden. De klagende partij verwees naar het verslag van het WTO-panel in verband met beddenlinnen uit India(3) en voerde aan dat volgens het panel de Gemeenschap haar onderzoek naar de schade ten onrechte op verschillende groepen van producenten van de Gemeenschap had gebaseerd.

(23) The European Lighting Companies Federation ("the complainant") claimed that data relating to Philips Lighting B.V. ("Philips") should have been taken into account in the injury analysis, as this company had also suffered injury. It referred to the WTO Panel report on bed linen from India(3), arguing that the Panel found that the Community had wrongly based its injury analysis on different groups of Community producers.

(3) Op 16 augustus 2004 heeft de Commissie een verzoek ontvangen om overeenkomstig artikel 13, lid 3, van de basisverordening een onderzoek te openen naar de mogelijke ontduiking van de antidumpingmaatregelen ten aanzien van CFL-i’s uit China. Het verzoek was ingediend door de Lighting Industry and Trade in Europe ("LITE") namens producenten en importeurs van CFL-i’s in de Europese Gemeenschap. Volgens het verzoek zouden de antidumpingmaatregelen die van toepassing waren op CFL-i’s uit China ontdoken worden door overlading en/of assemblage in Vietnam, Pakistan en/of de Filipijnen.

(3) On 16 August 2004, the Commission received a request pursuant to Article13(3) of the basic Regulation to investigate the alleged circumvention of the anti-dumping measures imposed on CFL-i originating in the People’s Republic of China ("the PRC" or "China"). The request was submitted by the Lighting Industry and Trade in Europe ("LITE") on behalf of producers and importers of CFL-i in the Community ("the applicant"). The request alleged that the anti-dumping measures in force on imports of CFL-i originating in the PRC were being circumvented by means of transhipment and/or assembly operations via Vietnam, Pakistan and/or the Philippines.

52. Bovendien werd vastgesteld dat Ecopak Lighting over twee boekhoudingen beschikte. De boekhouding, inclusief de accountantsverslagen, waren niet in overeenstemming met de internationale boekhoudnormen en werden dus als onbetrouwbaar beschouwd. Derhalve konden geen betrouwbare waarde van de machines (om de afschrijving te kunnen vaststellen die nodig is voor de berekening van de toegevoegde waarde) en geen nauwkeurige waarde van de ingevoerde onderdelen of van de toegevoegde waarde worden berekend. De onderneming heeft niet de gegevens verstrekt die de EG-instellingen in staat zouden hebben gesteld de in artikel 13, lid 2 onder b), vermelde percentages te bepalen.

52. Moreover, it was found that Ecopak Lighting had two sets of accounting documents. The accounting records, including the reports of the auditors, were not in line with international accounting standards and therefore considered unreliable. Therefore, a reliable value of the machinery (needed for the calculation of the depreciation to be included in the value added calculation) could not be assessed, neither the precise value of the imported parts or the value added to these parts. In any event, the company did not provide any information which would have enabled the Institutions to examine the thresholds mentioned in Article 13(2)(b).

(52) Bovendien werd vastgesteld dat Ecopak Lighting over twee boekhoudingen beschikte. De boekhouding, inclusief de accountantsverslagen, waren niet in overeenstemming met de internationale boekhoudnormen en werden dus als onbetrouwbaar beschouwd. Derhalve konden geen betrouwbare waarde van de machines (om de afschrijving te kunnen vaststellen die nodig is voor de berekening van de toegevoegde waarde) en geen nauwkeurige waarde van de ingevoerde onderdelen of van de toegevoegde waarde worden berekend. De onderneming heeft niet de gegevens verstrekt die de EG-instellingen in staat zouden hebben gesteld de in artikel 13, lid 2 onder b), vermelde percentages te bepalen.

(52) Moreover, it was found that Ecopak Lighting had two sets of accounting documents.
