(19) Italië betoogt dat het Deggendorf-arrest niet kan worden toegepast op de hier te onderzoeken steun, aangezien de steun uit een andere bron afkomstig is. De bewuste steun is regionaal (de steunverlenende autoriteit is de regio Latium), terwijl de steun die aan het gemeentelijke nutsbedrijf was toegekend, nationale steun is.

(19) Italy claims that the Deggendorf jurisprudence should not apply in this case, given the different origin of the case. The present case is a regional case (granting authority being the Regione Lazio), while the case concerning the municipalizzate was a national case.

While a lot more work is needed prior to any legislative initiative from the Commission -and I welcome Commissioner Bolkestein 's offer of a second round of consultation -the Committee on Economic and Monetary Affairs has laid out its stall, proposing separate core settlement services as a user-owned or public service, governed by the rules of non-profit status.

A pesar de que se necesita trabajar mucho más en ello antes de que la Comisión pueda plantear ninguna iniciativa legislativa- y, en ese sentido, acojo con satisfacción la oferta del Comisario Bolkestein relativa a una segunda ronda de consultas, la Comisión de Asuntos Económicos y Monetarios ha expuesto su opinión, proponiendo servicios de liquidación básicos independientes como un servicio propio de los usuarios o público, regido por las normas derivadas del estatuto no lucrativo.

(8) De begunstigde onderneming was ACEA, het vroegere Romeinse gemeentelijke nutsbedrijf. Na een reeks reorganisaties waarbij diverse andere ondernemingen waren betrokken — onder wie Electrabel — is de begunstigde thans een andere onderneming, AceaElectrabel Produzione (hierna "AEP" genoemd). AEP is voor 50% in handen van Electrabel Italia en voor 50% in handen van AceaElectrabel. Electrabel Italia staat zelf onder de uitsluitende zeggenschap van het Belgische Electrabel. AceaElectrabel is voor 40,59% in handen van Electrabel Italia en voor 59,41% van ACEA.

(8) The undertaking benefiting from the aid was ACEA S.p.A., former municipalizzata of Rome. After a series of reorganisations which involved a number of other undertakings, notably Electrabel, the beneficiary is now a different one, AceaElectrabel Produzione (AEP). AEP is controlled at 50% by Electrabel Italia, and at 50% by AceaElectrabel. The first is controlled at 100% by Electrabel (Belgium). The second is controlled at 40,59% by Electrabel Italia, and at 59,41% by ACEA S.p.A.

(1) Bij brief van 7 januari 2003 (op 10 januari 2003 geregistreerd onder nummer A/30189) heeft Nederland exploitatiesteun ten gunste van AVR Nutsbedrijf Gevaarlijk Afval BV (hierna "AVR Nuts" genoemd) ten behoeve van de verwerking in Nederland van voor verwijdering bestemd gevaarlijk afval aangemeld. Het grootste deel van de steun betrof de verbranding van dit soort afval in twee draaitrommelovens (hierna "DTO's" genoemd). Nederland heeft de toepassing van artikel 86, lid 2, van het Verdrag ingeroepen en heeft de Commissie verzocht te besluiten dat de maatregel geen staatssteun in de zin van artikel 87, lid 1, van het Verdrag vormt, omdat het om een passende compensatie gaat voor de verplichting een dienst van algemeen economisch belang in de zin van artikel 86, lid 2, van het Verdrag te verlenen. De zaak werd als Steunmaatregel nr. N 43/2003 geregistreerd.

(1) By letter of 7 January 2003 (registered as received on 10 January under No A/30189), the Netherlands notified operating aid for AVR Nutsbedrijf Gevaarlijk Afval B.V. (hereinafter "AVR Nuts") for treating hazardous waste in the Netherlands with a view to disposal. The bulk of the aid was for the incineration of such waste in two rotating drum furnaces ("RDFs"). The Netherlands invoked Article 86(2) of the Treaty and asked the Commission to decide that the measure does not constitute state aid within the meaning of Article 87(1) of the Treaty since it represents appropriate compensation for the obligation to provide a service of general economic interest ("SGEI") within the meaning of Article 86(2) of the Treaty. The case was registered under No N 43/2003.

(75) Voorts dient te worden aangetekend dat in ieder geval ACEA niet bijzonder wordt gestraft. De Commissie heeft diverse projecten in de regio-Piemonte goedgekeurd (het in overweging 38 aangehaalde besluit betreffende Steunmaatregel nr. N 614/02). Twee van die goedgekeurde projecten moesten worden uitgevoerd door AEM (het gemeentelijke nutsbedrijf van Turijn) en door ASM (het gemeentelijke nutsbedrijf van Settimo Torinese). In het geval van AEM is nagegaan of het Deggendorf-arrest diende te worden toegepast. De conclusie was uiteindelijk negatief, op grond van de de-minimisregel, daar het om een bedrag 17240 EUR van ging. De lokale autoriteiten hebben zich voorts ertoe verbonden erop toe te zien dat er gedurende een periode van drie jaar geen cumulering zou plaatsvinden met andere de-minimissteun voor een bedrag van in totaal meer dan 100000 EUR. In voorkomend geval zou de steun niet worden uitgekeerd, precies op grond van het Deggendorf-arrest.

(75) Furthermore, it should be pointed out that ACEA is not particularly penalised. The Commission approved (Decision on case N 614/02 mentioned in paragraph 38) a number of projects in the Region Piemonte. Two of the projects approved were to be carried out by AEM, the municipalizzata from Torino, and by ASM, the municipalizzata from Settimo Torinese. In the case of AEM, the decision considered whether the Deggendorf jurisprudence would apply. It finally said no, because of the de minimis rule, the amount in question being limited to EUR 17240. The local authority further took the engagement to verify if there was no cumulation with other de minimis aid over a three years period, for a total amount over EUR 100000, in which case there would have been aid which would not have been granted precisely because of Deggendorf.

(8) De stadia bij de productie van brandstof voor kerncentrales zijn: conversie; verrijking en vervaardiging van brandstof. In een kernreactor wordt energie geproduceerd door de splijting van U-235-atomen, waardoor energie vrij komt in de vorm van warmte. U-235 is de belangrijkste splijtbare isotoop van uranium. De verrijking is het duurste stadium bij de vervaardiging van brandstof voor kerncentrales. Bij de verrijking van uranium wordt het percentage splijtbare U235-isotopen in het uranium verhoogd in vergelijking met de U238-isotopen. Voor de opwekking van elektriciteit in een civiele kerncentrale wordt uranium verrijkt tot een concentratie van 3% tot 5%, en wordt dan licht verrijkt uranium (LEU) genoemd. In de meeste gevallen biedt de verrijkingsfabriek verrijkingsdiensten aan of levert zij verrijkt uranium aan nutsbedrijven door het door het nutsbedrijf verstrekte uranium om te vormen tot LEU dat voldoet aan de internationale normen. In bepaalde gevallen wordt LEU evenwel simpelweg verkocht aan de nutsbedrijven in plaats van het voor hen te verrijken (levering van LEU).

(8) The stages concerned in the production of nuclear fuel are: conversion; enrichment; and fuel fabrication. The production of energy in nuclear reactors results from the fission or splitting of the U-235 atoms, a process which releases energy in the form of heat. U-235 is the main fissile isotope of uranium. Enrichment is the most expensive stage in the fabrication of nuclear fuel. Uranium enrichment consists of increasing the percentage of fissile U235 isotopes in the uranium compared to the U238 isotopes. For civil nuclear electricity generation, uranium is enriched to a 3-5% level and is called Low Enriched Uranium (LEU). In most cases, the enrichment company provides enrichment services or supplies enriched uranium to utilities by transforming the uranium provided by the utility into LEU that meets internationally accepted standards. However, in some cases LEU is simply sold to utilities rather than enriched on their behalf (supply of LEU).
