(1) Op basis van artikel 4, lid 3, van Gemeenschappelijk Optreden 97/396/JBZ is tijdens een onder auspiciën van het Wetenschappelijk comité van het Europees Waarnemingscentrum voor drugs en drugsverslaving belegde vergadering een verslag opgesteld over de risicobeoordeling in verband met PMMA (paramethoxymethylamfetamine of N-methyl-1-(4-methoxyfenyl)-2-aminopropaan).

(1) A risk assessment report on PMMA (paramethoxymethylamphetamine or N-methyl-1-(4-methoxyphenyl)-2-aminopropane) was drawn up, on the basis of Article 4(3) of Joint Action 97/396/JHA, at a meeting convened under the auspices of the Scientific Committee of the European Monitoring Centre for Drugs and Drug Addiction.

(7) PMMA dient door de lidstaten aan de controlemaatregelen en strafrechtelijke sancties te worden onderworpen waarin is voorzien in de wetgevingen die de lidstaten hebben aangenomen om te voldoen aan hun verplichtingen uit hoofde van het VN-Verdrag inzake psychotrope stoffen van 1971 wat betreft de in de lijsten I en II bij dat Verdrag opgenomen stoffen,

PMMA levert gevaar op voor de gezondheid van personen en zou een bedreiging kunnen vormen voor de volksgezondheid. PMMA is een amfetamineanaloog die sterke gelijkenis vertoont met PMA, dat voorkomt op lijst I bij het genoemde VN-Verdrag van 1971. PMMA heeft geen therapeutische waarde.

(3) PMMA is not currently listed in any of the Schedules to the 1971 United Nations Convention on Psychotropic Substances. PMMA poses health risks for individuals and could pose a threat to public health. PMMA is an amphetamine analogue very close to PMA which is included in Schedule I to the 1971 United Nations Convention. PMMA has no therapeutic value.

De lidstaten treffen in overeenstemming met hun nationale wetgevingen de noodzakelijke maatregelen om PMMA (paramethoxymethylamfetamine of N-methyl-1-(4-methoxyfenyl)-2-aminopropaan) aan de controlemaatregelen en strafrechtelijke sancties te onderwerpen waarin is voorzien in de wetgevingen die de lidstaten hebben aangenomen om te voldoen aan hun verplichtingen uit hoofde van het VN-Verdrag inzake psychotrope stoffen van 1971 wat betreft de in de lijsten I en II bij dat Verdrag opgenomen stoffen.

Member States shall take the necessary measures, in accordance with their national law, to submit PMMA (paramethoxymethylamphetamine or N-methyl-1-(4-methoxyphenyl)-2-aminopropane), to control measures and criminal penalties, as provided for under their legislation complying with their obligations under the 1971 United Nations Convention on Psychotropic Substances with respect to substances listed in Schedules I or II thereto.

(5) PMMA is in combinatie met PMA in verband gebracht met drie sterfgevallen in de Europese Gemeenschap. Uit dierenproeven is gebleken dat de marge tussen de dosis die een uitwerking heeft op het gedrag en de dodelijke dosis van PMMA smal is en dat er bijgevolg sprake is van een groot risico van acute toxiciteit bij de mens die zelfs de dood tot gevolg kan hebben. PMMA schijnt een soortgelijke toxiciteit te vertonen als PMA en MDMA.

(5) PMMA has been associated in combination with PMA with three deaths within the European Community. Experiments on animals indicate that there is a narrow margin between the behaviourally active and lethal dose of PMMA and therefore a high risk of acute toxicity exists. PMMA seems to have a similar toxicity to PMA and MDMA.

(6) Handel in en distributie van PMMA heeft plaatsgevonden in vier lidstaten, en drie daarvan beschikken over informatie ten aanzien van de rol van de georganiseerde misdaad in de handel in PMMA/PMA. Er zijn bij 29 gelegenheden 18870 PMMA bevattende tabletten in beslag genomen. Er is geen sprake van grootschalige productie van PMMA in de Europese Gemeenschap. Er zijn twee laboratoria in beslag genomen in landen in Oost-Europa, en aangenomen wordt dat de productie in die landen voortgaat.

(6) Trafficking and distribution of PMMA have taken place in four Member States and three of these have information on the role of organised crime in the trafficking of PMMA/PMA. 18870 tablets containing PMMA have been seized in 29 incidents. Large scale production of PMMA does not take place in the European Union. Two laboratories have been seized in countries of Eastern Europe and production is believed to continue there.

(14) Degussa en Atofina met respectievelijk 216 miljoen en 188 miljoen EUR worden in de eerste categorie geplaatst. Lucite, met 105,98 miljoen EUR, is de derde grootste producent en komt in de tweede categorie. ICI, die geen omzetcijfers voor haar bedrijfsafdeling ICI Acrylics kon verstrekken, wordt in de tweede categorie geplaatst, samen met Lucite, aangezien de verkoop van die afdeling aan Lucite een billijke vergelijking mogelijk maakt met de cijfers van Lucite wat de omzet van ICI Acrylics betreft. Quinn Barlo, met 66,37 miljoen EUR voor massieve PMMA-platen alleen, kwam in de derde categorie terecht. Het is niet bewezen dat Barlo deelnam aan enige heimelijke contacten betreffende PMMA-vormmassa of sanitaire PMMA-artikelen aangezien zij niet op de hoogte was of niet noodzakelijk kennis had van het globale plan betreffende de concurrentiebeperkende regelingen. Gezien deze feiten werd het basisbedrag van de boete voor Barlo derhalve met 25% verminderd.

(14) Degussa and Atofina of EUR 216 and 188 million respectively are placed in the first category. Lucite with EUR 105,98 million is the third largest producer and has been placed in the second category. ICI, which has been unable to provide turnover figures for its business unit ICI Acrylics, is placed in the second category with Lucite given that the sale of the former to the latter permits an equitable comparison with Lucite's figures in terms of ICI Acrylics'turnover. Quinn Barlo with EUR 66,37 million in PMMA-solid sheet alone has been placed in the third category. It is not proven that Barlo took part in any collusive contacts concerning PMMA-moulding compounds or PMMA-sanitaryware as it was not aware or could not necessarily have knowledge of the overall scheme of the anti-competitive arrangements. Consequently, given the facts of this case, a reduction of 25% was applied to the basic amount of the fine calculated for Barlo.

(27) Rekening houdend met de door de ondernemingen aangebrachte elementen in hun antwoorden op de mededeling van punten van bezwaar en op de mondelinge hoorzitting, besloot de Commissie ten eerste de punten van bezwaar tegen alle ondernemingen te laten vallen met betrekking tot het MMA-gedeelte van de inbreuk, ten tweede de punten van bezwaar tegen BASF AG, Repsol YPF SA, Repsol Quimica SA, Repsol Brønderslev A/S en Repsol Polivar SpA ook met betrekking tot PMMA-vormmassa, massieve PMMA-platen en sanitaire PMMA-artikelen te laten vallen, ten derde de punten van bezwaar tegen Quinn Barlo Ltd, Quinn Plastics NV, Quinn Plastics GmbH, Quinn Plastics SA met betrekking tot PMMA-vormmassa te laten vallen, en ten laatste de punten van bezwaar tegen Quinn Plastics SA met betrekking tot massieve PMMA-platen te laten vallen.

(27) In view of the elements brought forward by the undertakings in their replies to the Statement of Objections and at the Oral Hearing, the Commission decided firstly to drop objections against all undertakings in relation to the MMA part of the infringement, secondly to drop objections against BASF AG, Repsol YPF SA, Repsol Quimica SA, Repsol Brønderslev A/S and Repsol Polivar SpA also in relation to PMMA-moulding compounds, PMMA-solid sheet and PMMA-sanitaryware, thirdly to drop objections against Quinn Barlo Ltd, Quinn Plastics NV, Quinn Plastics GmbH, Quinn Plastics SA in relation to PMMA-moulding compounds and lastly to drop objections against Quinn Plastics SA in relation to PMMA-solid sheet.

Ten tweede werden de onder de inbreuk vallende producten gereduceerd tot drie producten: PMMA-vormmassa, massieve PMMA-platen en sanitaire PMMA-artikelen. Er werden onvoldoende bewijzen gevonden om de aantijgingen van de verzoeker van immuniteit met betrekking tot MMA te staven; derhalve stelt de Commissie voor de bezwaren met betrekking tot MMA te laten vallen. Voorts besloot de Commissie de punten van bezwaar tegen Quinn Barlo Ltd, Quinn Plastics NV en Quinn Plastics GmbH met betrekking tot PMMA-vormmassa, te laten vallen.

Secondly, the products covered by the infringement have been reduced to three: PMMA-moulding compounds, PMMA-solid sheet and PMMA-sanitary ware. Sufficient proof was not obtained to corroborate the allegations made by the immunity applicant with regard to MMA, and therefore the Commission proposes to drop the objections regarding MMA. Furthermore, objections have been dropped against Quinn Barlo Ltd, Quinn Plastics NV and Quinn Plastics GmbH in relation to PMMA-moulding compounds.

(13) De ondernemingen werden in drie categorieën onderverdeeld overeenkomstig hun gecumuleerde omzet voor de drie PMMA-producten samen in de EER in 2000, het recentste jaar waarin de meeste adressaten van deze beschikking actief waren in het kartel.

(13) The undertakings have been divided into three categories according to their 2000 EEA combined turnover in the three PMMA products in 2000, the most recent year of the infringement in which most undertakings to which this Decision is addressed were active in the cartel.

(4) PMMA-vormmassa, massieve PMMA-platen en sanitaire PMMA-artikelen zijn alle drie PMMA-producten die deel uitmaken van een productieketen waarvan methacrylaat-monomeren (MMA) het startpunt en de belangrijkste grondstof vormen. Hoewel deze drie PMMA-producten zowel fysiek als chemisch van elkaar verschillen, kunnen zij beschouwd worden als één homogene productgroep aangezien zij uit dezelfde grondstof vervaardigd worden.

(4) PMMA-moulding compounds, PMMA-solid sheet and PMMA-sanitaryware are part of a production chain with Methacrylate-Monomers (MMA) being the starting point and main raw material of the three PMMA-products. Although these three PMMA-products are all both physically and chemically distinct, they can be considered as one homogenous product group due to a common rawmaterial input.

(5) Uit het onderzoek bleek dat het kartel de gehele EER bestreek. In 2000 bedroeg de marktwaarde in de EER voor de drie PMMA-producten samen ongeveer 665 miljoen EUR voor ongeveer 255000 ton.

(5) The investigation showed that the cartel covered the whole of the EEA. The 2000 EEA market value for all three PMMA-products was ca EUR 665 million for ca 255000 tons.

(9) Hoewel er aanwijzingen zijn dat de eerste concurrentiebeperkende contacten tussen de producenten van de drie PMMA-producten reeds medio jaren tachtig hebben plaatsgevonden, stelde de Commissie als startdatum 23 januari 1997 vast, aangezien op die datum de eerste kartelbijeenkomst plaatsvond waarvoor de Commissie bevestiging heeft gekregen van meer dan één deelnemer. Op deze topontmoeting bespraken vertegenwoordigers van Atofina, Degussa en ICI de tegenvallende winstcijfers met betrekking tot PMMA-vormmassa en massieve PMMA-platen en de mogelijkheden om te zorgen voor een betere coördinatie van het marktgedrag van de concurrenten. Sales managers dienden gedisciplineerd te worden en zich strikter te houden aan vroegere afspraken.

(9) Whilst there are indications that first anti-competitive contacts between producers of the three PMMA-products occurred already in the mid 80s, the Commission sets the starting date with the meeting of 23 January 1997, as this is the first anti-competitive meeting for which the Commission has confirmation from more than one of the participants. At this summit meeting representatives of Atofina, Degussa and ICI discussed the disappointing profit situation relating to PMMA-moulding compounds and PMMA-solid sheet and the possibilities for a further coordination of market behaviour by the competitors, sales managers were to be disciplined to comply more strictly with previous concluded agreements

(10) Uit de algemene structuur van de concurrentiebeperkende overeenkomsten voor de drie PMMA-producten blijkt dat deze beschouwd kunnen worden als één enkele inbreuk waarbij de concurrenten prijzen bespraken, prijsafspraken overeenkwamen, uitvoerden en controleerden, het aanrekenen van extra dienstverleningskosten aan klanten opperden en commercieel belangrijke en vertrouwelijke informatie uitwisselden die relevant was voor de markt en/of het bedrijf.

(10) The overall structure of the anti-competitive arrangements for the three PMMA-products shows that they can be considered as one single infringement whereby competitors discussed prices, agreed, implemented and monitored price agreements, discussed the passing on of additional service costs to customers and exchanged commercially important and confidential market and/or company relevant information.
