Op 12 januari 2006 ontving de Commissie een aanmelding van een voorgenomen concentratie in de zin van artikel 4 van Verordening (EG) nr. 139/2004 van de Raad [1] waarin wordt meegedeeld dat de ondernemingen Tessenderlo Chemie S.A. ("Tessenderlo", België), Siemens Project Ventures GmbH ("Siemens Projects", Duitsland) die deel uitmaakt van het Duitse Siemens AG-concern ("Siemens") en Advanced Power AG ("AP", Zwitserland) in de zin van artikel 3, lid 1), sub b), van genoemde verordening gezamenlijk zeggenschap verkrijgen over de onderneming T-Power N.V. ("T-Power", België) door de aankoop van aandelen van een nieuw gestichte vennootschap die een gezamenlijke onderneming is.

On 12 January 2006, the Commission received a notification of a proposed concentration pursuant to Article 4 of Council Regulation (EC) No 139/2004 [1] by which the undertakings Tessenderlo Chemie S.A. ("Tessenderlo", Belgium), Siemens Project Ventures GmbH ("Siemens Projects", Germany) belonging to the German group Siemens AG ("Siemens") and Advanced Power AG ("AP", Switzerland) acquire within the meaning of Article 3(1)(b) of the Council Regulation joint control of the undertaking T-Power N.V. ("T-Power", Belgium) by way of purchase of shares in a newly created company constituting a joint venture.

(9) De aanmeldingen betreffen een pijpleiding voor het vervoer van propyleen van Rotterdam via Antwerpen, Tessenderlo, Geleen en Keulen naar Oberhausen in het Ruhrgebied. Het netwerk zal circa 520 km lang zijn. Het tracé bestaat uit negen secties en volgt zoveel mogelijk de bestaande ethyleenpijpleidingen. De Duitse aanmelding heeft uitsluitend betrekking op de sectie tussen Oberhausen, via Keulen naar de Nederlandse grens ("Pilot 2"). Daar sluit de leiding aan op een andere sectie in het noordelijke Ruhrgebied ("Pilot 1"). Naast de investering in de pijpleiding zou nieuwe opslagcapaciteit worden gebouwd in de Nederlandse en Belgische havens en in Duisburg, Duitsland. Overeenkomstig Richtlijn 85/337/EEG van de Raad van 27 juni 1985 betreffende de milieu-effectbeoordeling van bepaalde openbare en particuliere projecten [5] zal de begunstigde een beoordeling van de milieueffecten van de gehele pijpleiding verrichten.

(9) The notifications concern a pipeline for the transportation of propylene from Rotterdam, via Antwerp, Tessenderloo, Geleen and Cologne to Oberhausen in the Ruhr area. The network will be approximately 520 km long. The pipeline consists of nine sections, following as far as possible existing ethylene pipelines. The German notification concerns only the section between Oberhausen, via Cologne, and the Dutch border (Pilot 2), where it connects to another section in the Northern Ruhr area (Pilot 1). In addition to the investment in the pipeline, new storage capacity will be built in the Dutch and Belgian ports and in Duisburg, Germany. In accordance with Council Directive 85/337/EEC of 27 June 1985 on the assessment of the effects of certain public and private projects on the environment [5], the beneficiary will carry out such an assessment on the pipeline project as a whole.

458. Op 16 maart en 26 juni gaf de Commissie toestemming voor milieusteun aan drie Italiaanse chloorproducenten. Solvay Rosignano, Altair Chimica en Tessenderlo, wilden investeringen steunen die in hun fabrieken een eind moeten maken aan de chloorproductie via kwikelectrolyse en deze vervangen door productie via membraantechnologie (waarvoor geen kwik nodig is). De 13,5 miljoen EUR steun voor Solvay Rosignano betreft een investering van 48 miljoen EUR, Altair Chimica ontvangt zo'n 5 miljoen EUR steun voor een geplande investering van 13,5 miljoen EUR, en Tessenderlo 5,7 miljoen EUR steun voor 19 miljoen EUR investeringen. Dit stemt telkens overeen met 30% van de subsidiabele investeringskosten en, in het geval van Altair, een verhoging met 10% omdat het een middelgrote onderneming betreft. De Commissie oordeelde dat de maatregelen aansluiten bij de Lissabondoelstelling van een duurzame economie waarbij milieukosten in de toekomst worden vermeden. Bovendien lagen de maatregelen ook volledig in lijn met het milieusteunkader en de voor januari geplande EU-strategie om kwikvervuiling terug te dringen.

537. On 16 March and 26 June, the Commission authorised environmental aid to three chlorine producers in Italy. Solvay Rosignano, Altair Chimica and Tessenderlo[274] intended to support investment in their plants to end the production of chlorine based on the mercury technology and introduce the so-called membrane technology for which no mercury is needed. The aid of EUR 13.5 million for Solvay Rosignano, to promote a EUR 48 million investment, about EUR 5 million for Altair Chimica, which planned a EUR 13.5 million investment, and EUR 5.7 million for Tessenderlo, which invested EUR 19 million, represented in each case 30% of the eligible investment cost, plus an additional 10% of the eligible cost in the case of Altair as it is a medium-sized enterprise. The Commission considered that the measures supported the sustainability goal of the Lisbon Strategy by avoiding future environmental costs, and that they were fully in line with the proposed EU strategy of January to reduce mercury pollution and with the Guidelines on aid for environmental protection.
