(19) Ariana Afghan Airlines demonstrated a lack of ability to address these safety deficiencies.

Moreover, all restrictive measures against Ariana Afghan Airlines were terminated by UNSCR 1388(2002) of 15 January 2002.

Kromě toho veškerá omezující opatření proti Ariana Afghan Airlines byla ukončena na základě rezoluce 1388(2002) ze dne 15. ledna 2002.

(27) Ariana Afghan Airlines provided information indicating that it has ceased operations with the aircraft Airbus A-310 registered in France with marks F-GYYY, which has been sold.

(27) Dopravce Ariana Afghan Airlines poskytl informace, že přestal provozovat letadlo Airbus A-310 zaregistrované ve Francii pod značkou F-GYYY, které bylo prodáno.

(28) Therefore, the specific conditions applicable to the Community ban to Ariana Afghan Airlines have changed. The air carrier should be subject to a ban to all its operations and therefore remain included in Annex A.

(28) Z toho důvodu se změnily zvláštní podmínky pro zákaz provozovat leteckou dopravu ve Společenství, které pro společnost Ariana Afghan Airlines platily. Letecký dopravce by měl podléhat zákazu provozovat veškerou leteckou dopravu, a proto zůstat zařazený v příloze A.

(18) There is verified evidence of serious safety deficiencies on the part of certain aircraft operated by Ariana Afghan Airlines. These deficiencies have been identified by Germany, during ramp inspections performed under the SAFA programme [6].

(18) Existují ověřené důkazy o závažných bezpečnostních nedostatcích u některých letadel, která provozuje letecký dopravce Ariana Afghan Airlines. Tyto nedostatky zjistil členský stát Německo při inspekcích letištních ramp prováděných v rámci programu SAFA [6].

(21) The competent authorities of Afghanistan, where the aircraft used by Ariana Afghan Airlines is registered, have not exercised a fully adequate oversight of the aircraft used by this carrier in accordance with their obligations under the Chicago Convention.

(21) Příslušné orgány Afghánistánu, v němž jsou letadla, která letecký dopravce Ariana Afghan Airlines používá, zaregistrována, nevykonávají dostatečný dohled nad letadly, která tento dopravce používá, v souladu s jejich povinnostmi vyplývajícími z Chicagské úmluvy.

(20) Ariana Afghan Airlines did not respond adequately and timely to an enquiry by the civil aviation authority of Germany regarding the safety aspect of its operation showing a lack of communication, as demonstrated by the absence of adequate response to correspondence from this Member State.

(20) Ariana Afghan Airlines neodpověděl dostatečně a včas na dotaz úřadu pro civilní letectví Německa ohledně bezpečnostních stránek jeho provozu, což ukazuje na nedostatek komunikace, o kterém svědčí to, že neodpověděl dostatečně na korespondenci tohoto členského státu.

(22) Therefore, on the basis of the common criteria, it is assessed that Ariana Afghan does not meet the relevant safety standards for all the aircraft it operates, with the exception of A310 registration number F-GYYY which is registered in France and subject to the oversight of the French authorities.

(22) Na základě společných kritérií se proto soudí, že Ariana Afghan nesplňuje příslušné bezpečnostní normy u všech letadel, která provozuje, s výjimkou letadla A310 poznávací číslo F-GYYY, které je zaregistrováno ve Francii a podléhá dohledu francouzských orgánů.

(6) The sanctions concerning the flight ban and the embargo on acetic anhydride sale imposed by UNSCR 1267(1999) and 1333(2000) are no longer in force in accordance with paragraph 23 of UNSCR 1333(2000) and paragraph 1 of UNSCR 1390(2002). Moreover, all restrictive measures against Ariana Afghan Airlines were terminated by UNSCR 1388(2002) of 15 January 2002.

(6) Sankce týkající se zákazu letů a embarga na prodej acetanhydridu, uvalené prostřednictvím rezoluce 1267(1999) a 1333(2000), již podle odstavce 23 rezoluce 1333(2000) a odstavce 1 rezoluce 1390(2002) neplatí. Kromě toho veškerá omezující opatření proti Ariana Afghan Airlines byla ukončena na základě rezoluce 1388(2002) ze dne 15. ledna 2002.

(26) Ariana Afghan Airlines submitted a request to be withdrawn from the Community list, provided some documentation in support of this request and showed strong disposition towards cooperation with the Commission and Member States. However, since the full implementation of an adequate corrective action plan by the carrier is not completed, the Commission considers that Ariana Afghan Airlines should be retained in the Community list.

(26) Dopravce Ariana Afghan Airlines předložil žádost o vyřazení ze seznamu Společenství, na podporu této žádosti poskytl určitou dokumentaci a vykázal značnou snahu spolupracovat s Komisí a členskými státy. Protože však tento dopravce nedokončil v plné míře provádění příslušného nápravného akčního plánu, Komise je toho názoru, že společnost Ariana Afghan Airlines by měla zůstat na seznamu Společenství.
