In addition, in support of its claim, the applicant submits that the Commission's method of calculation for determination of the fine was incorrect and that another method should have been used, by which account should have been taken of the fact that the applicant's infringement consists of three distinct periods of time, since the applicant was owned by three different owners (St. Gobain, FLS and Trioplast Industrier) over the time during which the infringement occurred. According to the applicant, the Commission's method gives the result that FLS and Trioplast Industrier's overall joint and several liability exceeds the total fine imposed on the applicant and that in practice FLS and Trioplast Industrier are held jointly and severally liable also to pay for the period when neither company owned the applicant.

Žalobkyně na podporu své argumentace dále uvádí, že Komise použila nesprávný způsob výpočtu výše pokuty a že měla použít jiný způsob, který by přihlédl ke skutečnosti, že porušení ze strany žalobkyně se vztahuje na tři různá období, jelikož žalobkyně měla během období, ve kterém došlo k porušení, tři různé vlastníky (St. Gobain, FLS a Trioplast Industrier). Podle žalobkyně má způsob výpočtu použitý Komisí za následek, že společná a nerozdílná odpovědnost FLS a Trioplast Industrier převyšuje celkovou výši pokuty, která byla uložena žalobkyni, a že těmto dvěma podnikům se v podstatě ukládá společná a nerozdílná odpovědnost rovněž platit za období, ve kterém žádný z těchto podniků nebyl vlastníkem žalobkyně.

(31) It was then examined whether the domestic sales of each of the two cooperating producers in Brazil, Saint-Gobain Materials Cerámicas Ltda and Treibacher Schleifmittel Brasil Ltda, to independent customers had been made in the ordinary course of trade, pursuant to Article 2(4) of the basic Regulation.
