The Commission appreciates that in a closer investigation of one of the attacks on the clergy -to which Mrs Malone referred -where the Irish Franciscan Timmons was killed, a suspect has been brought to the Kenyan court and accused of murder.

De Commissie heeft er nota van genomen dat in het kader van het nader onderzoek naar één van de aanvallen op geestelijken -mevrouw Malone heeft daarover gesproken -, waarbij de Ierse Franciscaan Timmons werd gedood, intussen een verdachte voor het Keniaans gerecht is gebracht en inderdaad voor moord is aangeklaagd.

This year we have heard in Ireland, as is obvious from the concern expressed by Irish colleagues here today, of the danger facing Father Brendan Forde, a Franciscan working in the small village of La Ùnion who has chosen to remain with his parishioners at considerable danger to his own life.

Dit jaar bereikten ons in Ierland, zoals mijn Ierse collega's hier vandaag al bezorgd hebben aangegeven, berichten over de benarde situatie van pater Brendan Forde, een Franciscaan die werkzaam is in het dorpje La Unión.Hij heeft ervoor gekozen om met groot gevaar voor eigen leven bij zijn parochianen te blijven.

But the fact is that, since 1997, there have been three murders, the most recent on 8 July of this year, and the Peace Community of La Unión and the Intercongregational Committee for Justice and Peace, including the Irish Franciscan priest Brendan Forde, have had repeated death threats, despite their position of remaining neutral and contributing to bringing peace to the area.

De laatste daarvan vond op 8 juli jongstleden plaats.De Vredesgemeenschap van La Unión en de kerkelijke commissie voor rechtvaardigheid en vrede, waaronder de Ierse pater Brendan Forde, zijn herhaaldelijk met de dood bedreigd, ondanks hun neutrale houding en hun bereidheid om bij te dragen aan een vreedzame oplossing voor het gebied.

Pleas in law: Firstly, infringement of Article 8(1)(b) of Council Regulation No 40/94 as it was concluded that there was a likelihood of confusion between the earlier mark and "ESTANCIA PIEDRA". Secondly, infringement of the procedural requirements since the Board of Appeal accepted, according to the applicant, an invalid and late filed authorisation from Franciscan Vineyards for their representatives and illegitimately extended the time limit for Franciscan Vineyards to file the authorisation.

Aangevoerde middelen: In de eerste plaats, schending van artikel 8, lid 1, sub b, van verordening nr. 40/94 van de Raad, doordat is geoordeeld dat er gevaar van verwarring van het oudere merk en met "ESTANCIA PIEDRA" bestaat. In de tweede plaats, schending van de procedurevoorschriften, doordat de kamer van beroep volgens verzoekster een ongeldige en te laat ingediende vertegenwoordigingsvolmacht van Franciscan Vineyards heeft aanvaard en de termijn voor het indienen van de volmacht door Franciscan Vineyards op onwettige wijze heeft verlengd.
