The request is limited in scope to the examination of subsidisation as far as Garware Polyester Ltd is concerned.

(72) On the basis of the above, the proposed duty amounts concerning Garware, expressed on the CIF Community border price, customs duty unpaid, are as follows:

10. In order to obtain the information necessary for its investigation, the Commission sent a questionnaire to Garware, which cooperated by replying to the questionnaire. A verification visit was carried out at Garware’s premises in India.

(9) In order to obtain the information necessary for its investigation, the Commission sent a questionnaire to Garware, which cooperated by replying to the questionnaire. A verification visit was carried out at Garware's premises in India.

(72) One exporting producer, Garware Polyester Ltd, submitted that it had obtained no benefit under this scheme during the investigation period (IP) since the State Authorities of Maharashtra had not yet actually fulfilled its repayment obligation.

(72) Eén exporteur/producent, Garware Polyester Ltd, voerde aan dat deze regeling hen tijdens het onderzoekstijdvak geen voordeel had opgeleverd aangezien de autoriteiten van de staat Maharashtra hun terugbetalingsverplichting nog niet waren nagekomen.

The request pursuant to Article 19 of the basic Regulation is based on the prima facie evidence, provided by the applicants, that, as far as Garware Polyester Ltd is concerned, the circumstances with regard to subsidisation have changed significantly.

Het verzoek op grond van artikel 19 van de basisverordening is gebaseerd op door de indieners van het verzoek verstrekt bewijsmateriaal dat, wat Garware Polyester Ltd betreft, de omstandigheden inzake subsidiëring aanzienlijk zijn veranderd.

6. The applicants alleged that, in regard to imports of PET film from Garware, the level of existing countervailing measures was no longer sufficient to counteract the injurious subsidisation, as the circumstances regarding the subsidisation of Garware had changed significantly.

(5) Volgens de indieners waren de bestaande compenserende rechten op de invoer van PET-folie van Garware niet langer toereikend om de schadeveroorzakende subsidiëring te neutraliseren omdat de omstandigheden met betrekking tot de subsidiëring van Garware ingrijpend waren gewijzigd.
