3.36.3 This means, therefore, that Asturia (area: 10604 km2) is "short" of some 17000 animal carcasses, which had, until then, been a major source of food for vultures, bears, wolves and many other carrion-eaters. Taking 200 kg per animal as a benchmark, this represents a total protein biomass of 3400 tonnes [17]. It remains to be seen whether the November 2002 Spanish royal decree allowing carrion-eaters to be fed the carcasses or by-products of certain animals will make any difference to this situation. No other EU Member State has introduced a national provision of this kind.

3.36.3 In Asturië (met een oppervlakte van 10604 vierkante kilometer) "ontbreken" nu dus ongeveer 17000 dode dieren die tot voor kort een belangrijke voedselbron waren voor gieren, beren, wolven en tal van andere aaseters. Een tekort van 17000 dieren komt — bij 200 kilo per kadaver — neer op 3400 ton minder eiwitrijke biomassa in het landschap. [17] Het is nu afwachten of het in november 2002 in Spanje uitgevaardigde decreet dat het voederen van aaseters met bepaalde kadavers of bijproducten van dode dieren regelt, iets aan deze situatie kan veranderen. De andere lidstaten laten het wat dit soort maatregelen betreft afweten!

3.36.2 In areas of Europe with still-intact populations of wild carrion-eaters, such as vultures, wolves or bears, this poses major problems for species protection. In Asturia, for example, in the 1990s and right up to 2003, around 3000 bodies of domestic animals were, on average, delivered to rendering facilities each year. In 2004, as a result of consistent application of the relevant EU regulation, that figure rose to around 20000.

3.36.2 Wat de biodiversiteit betreft leidt dit tot grote problemen in gebieden waar nog intacte bestanden van in het wild levende aaseters als gieren, wolven of beren voorkomen. In de jaren negentig (tot en met 2003) werden in Asturië bijvoorbeeld per jaar gemiddeld zo'n 3000 stuks vee bij destructiebedrijven afgeleverd. In 2004 was dat aantal door toepassing van de EU-verordening gestegen tot 20000.

(29) In the light of the Panel's findings, for each of the relevant financial contributions in the measure at issue, the Commission has re-examined all of the relevant facts and evidence on the record, taking into account all of the submissions of interested parties, specifically with respect to possible alternative benchmarks, including "junk bonds" and "vulture funds", and, for each relevant financial contribution, redetermined the amount of the benefit to Hynix.

(27) The Panel considered that, as a matter of WTO law, the correct starting point for the EC in this case must be the search for an alternative benchmark as a base for the calculation of the amount of benefit. The Panel particularly referred, at para. 7.213 of its report, to "a comparable commercial loan which the firm could actually obtain on the market" (Article 14(b) SCM Agreement) and "a comparable commercial loan absent the government guarantee" (Article 14(a) SCM Agreement). The Panel also referred, by way of example, to so-called "junk bonds" or "vulture funds" [30].

4. De Lid-Staten nemen passende maatregelen om vervuiling en verslechtering van de woongebieden in de in de leden 1 en 2 bedoelde beschermingszones te voorkomen, alsmede om te voorkomen dat de vogels aldaar worden gestoord, voor zover deze vervuiling, verslechtering en storing, gelet op de doelstellingen van dit artikel, van wezenlijke invloed zijn. Ook buiten deze beschermingszones zetten de Lid-Staten zich in om vervuiling en verslechtering van de woongebieden te voorkomen.
