(28) The concession agreement also contains a guarantee by the State that, if AVR Chemie is wound up, the State will pay a maximum of 30% of the removal and follow-up costs of dismantling and decontaminating the installations. This percentage corresponds to the State’s holding in AVR Chemie.

Whereas, according to this procedure, and in particular with regard to Article 13, a Commission Decision was taken on 18 December 1992 (1) enabling the Competent Authority of the Federal Republic of Germany to give consent for the placing on the market of the following product, notified by Vemie Veterinaer Chemie GmbH (Ref. C/D/92/I-1):

(13) According to Germany, CWP has had a registered capital of EUR 288880 (DEM 0,565 million) since December 1998. It is owned by Vopelius Chemie AG (29,2%), Vopelius GmbH (28,3%), Mr Thilo Koth von Vopelius (17,7%) and BVT Industrie GmbH amp; Co. Chemische Werke Piesteritz KG (24,8%).

1. Peroxid Chemie dropped a purely formal argument it had against the statement of objections.2. New documents were provided by Atochem. I agreed to their inclusion in the file and I gave the other parties two weeks in which to send their comments to the Commission. The content confirmed the Commission's position concerning the duration of the infringement.

-Η προθεσμία για την απάντηση στην κοινοποίηση των αιτιάσεων παρατάθηκε για πάνω από δύο εβδομάδες κατόπιν αιτήσεως των μερών, μέχρι τις 17 Ιουνίου 2003. Στις 26 Ιουνίου 2003, πραγματοποιήθηκε η προφορική ακρόαση, κατά την οποία:1. Η Peroxid Chemie διατύπωσε αμιγώς τυπικά επιχειρήματα έναντι των αιτιάσεων.

The beneficiary is Ethylene Pipeline Süd GmbH%amp% Co. KG, a consortium of BASF AG, Borealis Polymere GmbH, Clariant GmbH, OMV Deutschland GmbH, Ruhr Oel GmbH, Vinnolit Gmbh%amp%Co KG and Wacker Chemie GmbH.Pipeline transport is safer and more environmentally-friendly than transport by rail, waterway or road. A well developed pipeline network would carry strategic importance for the producers and consumers of ethylene in the region.

Η μεταφορά μέσω του αγωγού είναι πιο ασφαλής και περισσότερο φιλική προς το περιβάλλον από τις σιδηροδρομικές, πλωτές ή οδικές μεταφορές. Ένα καλά αναπτυγμένο δίκτυο αγωγού θα είναι στρατηγικής σημασίας για τους παραγωγούς και τους καταναλωτές αιθυλενίου στην περιοχή.

(53) As regards the second component of the private contribution, i.e. contributions from the shareholders, Vopelius Chemie GmbH was, according to the 1997 notification, to contribute a loan of EUR 0,15 million (DEM 0,3 million). In its response to the initiation of the formal investigation procedure, Germany explained that this amount related to the hire purchase (Mietkauf) of investment goods for which Vopelius provided a guarantee.

(54) Στην απάντησή της σε συνέχεια της κίνησης της επίσημης διαδικασίας έρευνας, η Γερμανία θεωρούσε επίσης ότι το ίδιο κεφάλαιο ύψους 288879 ευρώ (0,565 εκατ. DEM) θα έπρεπε να εκληφθεί ως συνεισφορά των μετόχων στη χρηματοδότηση των επενδύσεων.

(2) Η Ισπανία έλαβε παρόμοια αίτηση σύμφωνα με το άρθρο 6 παράγραφος 2 της οδηγίας 91/414/ΕΟΚ στις 16 Δεκεμβρίου 1996 από την ISK Biosciences Europe SA σχετικά με την ουσία flazasulfuron. Ο φάκελος χαρακτηρίστηκε πλήρης με την απόφαση 97/865/ΕΚ της Επιτροπής(3).

7.4.1. Market share and sales volume(55) The Community industry represents 100% of Community production in the IP, as there is only one Community producer of potassium permanganate. Until 1998, when it went out of business, there was another Community producer, Chemie AG based in Germany. However, this company has not been considered in analysing the situation of the Community industry, except for the indicator on employment.

(60) Ενώ ο εναπομένων κοινοτικός παραγωγός διατήρησε σταθερή κατάσταση της απασχόλησης όλη την υπό εξέταση περίοδο, πρέπει να ληφθεί υπόψη ότι ένας άλλος κοινοτικός παραγωγός σταμάτησε εντελώς τις δραστηριότητές του την υπό εξέταση περίοδο, με συνέπεια απώλειες της απασχόλησης.

(42) The third interested party, Edelchemie, was concerned about the domestic market. It had developed its own technology for treating photographic and galvanic waste (ECO option) and recovering valuable materials from this waste (including precious metals and obsidian). The measures to assist AVR would not only harm its business but would also stifle technological development. Edelchemie's comments concern AVR Nuts, AVR Chemie and its predecessors as from 1963, providing details on Dutch hazardous waste policy over the years.

(40) Ο πρώτος ενδιαφερόμενος ισχυρίζεται ότι το μέτρο θα στρεβλώσει τον ανταγωνισμό στην ιρλανδική αγορά, δεδομένου ότι η AVR – μέσω της κατά 50% συμμετοχής της σε κοινή επιχείρηση με την ιρλανδική εταιρεία Safeway Warehousing/South Coast Transport – μπορεί να επιτύχει τιμές κάτω του κόστους και κατά πολύ χαμηλότερες των κανονικών τιμών αγοράς.

A favourable decision is hereby taken, according to which, the product Nobi-Porvac Aujeszky live, containing a genetically modified pseudorabies virus (strain Begonia) (gI, tk) in a preparation with Diluvac Forte, modified by Vemie Veterinaer Chemie GmbH (Ref. C/D/92/I-1) and for which consent has been given by a Commission Decision of 18 December 1992 for the placing on the market as a live vaccine for Aujeszky disease to be administered by intra-muscular application only, shall now also be given consent for intra-dermal application as well.

Με την παρούσα εκδίδεται ευνοϊκή απόφαση, σύμφωνα με την οποία το προϊόν Nobi-Porvac Aujeszky Live, που περιέχει γενετικά τροποποιημένο ιό ψευδολύσσας, ποικιλία begonia (gl-, tk-,) σε σκεύασμα με Diluvac Forte, το οποίο κοινοποιήθηκε από τη Vemie Veterinaer Ghemie GmbH (Ref. C/D/92/I-1) και εγκρίθηκε με απόφαση της Επιτροπής της 18ης Δεκεμβρίου 1992 για τη διάθεσή του στην αγορά ως ζώντος εμβολίου για την ασθένεια Aujeszky. Η εκδοθείσα έγκριση αφορούσε χορήγηση μόνο διά της ενδομυικής οδού, ενώ τώρα εγκρίνεται και η διά της ενδοδερμικής οδού.
