-Loans granted to HSY from public sources;

-Excess financing granted to HSY between 2000 and 2002 through the award of new defence contracts and/or their amendment;

-Waiver by OSE and ISAP of the requirement of the provision of bank guarantees by HSY in relation with railway contracts from 1997 onwards;

With regard to the measures which are the subject of this Decision, as from 2002, the Commission received several letters from a complainant alleging various further State aid measures in favour of HSY. The Greek authorities provided several information letters on these allegations.

Per quanto concerne le informazioni oggetto della presente decisione, dal 2002 la Commissione ha ricevuto numerose lettere da un ricorrente che denuncia varie altre misure di aiuto di Stato a favore di HSY. Le autorità greche hanno fornito numerose lettere contenenti informazioni in merito a dette asserzioni.

HSY is one of the largest shipyards of the eastern Mediterranean and the largest Greek shipyard. In September 1985, the State-owned Hellenic Bank of Industrial Development (hereinafter "ETVA") bought the nearly bankrupt company. Since then, HSY has benefited from State support at several occasions and has been the subject of a number of State aid decisions by the Commission. In May 2002, HSY was acquired by a consortium constituted of HDW and Ferrostaal (hereinafter "HDW/Ferrostaal").

HSY è uno dei più importanti cantieri navali del Mediterraneo orientale e il principale cantiere navale greco. Nel settembre 1985 la Banca ellenica per lo sviluppo industriale (in prosieguo "ETVA"), di proprietà dello Stato, ha acquistato HSY che all'epoca era sull'orlo del fallimento. Il cantiere, nel frattempo, ha beneficiato di aiuti statali in varie occasioni e ha formato oggetto di una serie di decisioni in materia di aiuti di Stato adottate dalla Commissione. Nel maggio 2002 HSY è stato acquistato da un consorzio costituito da HDW e da Ferrostaal (in appresso "HDW/Ferrostaal").

By decision C(2004)1359 of 20 April 2004 [1], the Commission initiated the procedure laid down in Article 88(2) of the Treaty with respect to the amendments made to the investment plan partly financed by an investment aid to Hellenic Shipyards S.A. (hereinafter "HSY") that the Commission authorized on 15 July 1997 in case N 401/1997. The Commission Decision of 20 April 2004 also referred to several loans and guarantees given to HSY by the state-owned bank ETVA and to the failure of the Greek authorities to provide yearly reports.

Con decisione C(2004)1359 del 20 aprile 2004 [1], la Commissione ha avviato la procedura di cui all'articolo 88, paragrafo 2, del trattato nei confronti delle modifiche apportate al piano di investimenti parzialmente finanziato mediante un aiuto all'investimento in favore di Hellenic Shipyards SA (in appresso "HSY") autorizzato dalla Commissione il 15 luglio 1997 nel caso N 401/1997. La decisione della Commissione del 20 aprile 2004 riguardava anche vari prestiti e garanzie accordati ad HSY dalla banca statale ETVA nonché il mancato invio di relazioni annuali da parte delle autorità greche.
