(3) The prohibition of application or re-application of organostannic compounds directly affects the functioning of the internal market in organostannic compounds and it is therefore necessary to approximate the laws of the Member States in this field and consequently to amend Annex I to Directive 76/769/EEC and in particular, Directive 1999/51/EC.

(10) As an immediate follow-up to the AFS-Conference the Commission adopted Commission Directive 2002/62/EC of 9 July 2002 adapting to technical progress for the ninth time Annex I to Council Directive 76/769/EEC on the approximation of the laws, regulations and administrative provisions of the Member States relating to restrictions on the marketing and use of certain dangerous substances and preparations (organostannic compounds)(4) in order to prohibit, with effect from 1 January 2003, the marketing and use of organostannic compounds in anti-fouling systems for all ships, irrespective of their length.

(10) Come risultato immediato della conferenza AFS, la Commissione ha adottato la direttiva 2002/62/CE, del 9 luglio 2002, che adegua al progresso tecnico per la nona volta l'allegato I della direttiva 76/769/CEE del Consiglio concernente il ravvicinamento delle disposizioni legislative, regolamentari ed amministrative degli Stati membri relative alle restrizioni in materia di ammissione nel mercato e di uso di talune sostanze e preparati pericolosi (composti organostannici)(4) al fine di vietare, a decorrere dal 1o gennaio 2003, l'immissione sul mercato e l'uso di composti organostannici nei sistemi antivegetativi destinati a qualsiasi tipo di nave, indipendentemente dalla lunghezza.
