Treatment of reports submitted following a mission in a third country. Following a Community mission in a third country, a report, countersigned by those taking part in the mission, and the supporting documentation which could be used as evidence are sent to the Member States concerned even if they have not taken part in the mission[51]. The Commission whished to know if the reports and documentation could be used as evidence in a recovery procedure before a national court whether or not the Member State took part on the mission. The Member States replied in the affirmative. However, there may be difficulties with the evidence in a recovery procedure in a Member State that has not taken part in the mission in cases where the third country have not signed the report, something which is not required by the Community regulation.

Trattamento delle relazioni presentate a seguito di una missione in un paese terzo: al termine di una missione in un paese terzo, gli Stati membri interessati, anche nel caso in cui non abbiano partecipato alla missione, ricevono una relazione controfirmata dai partecipanti alla missione e i documenti che possono essere addotti come elementi di prova[51]. La Commissione era interessata a conoscere se le relazioni e i documenti trasmessi potessero essere utilizzati come elementi di prova in un procedimento di recupero davanti a un giudice nazionale, indipendentemente dalla partecipazione dello Stato membro alla missione. La risposta degli Stati membri a questa domanda è stata affermativa, anche se la mancata firma della relazione da parte delle autorità del paese terzo (firma peraltro non richiesta dalla normativa comunitaria) può determinare difficoltà di prova nell'ambito di un procedimento avviato in uno Stato membro che non abbia partecipato alla missione.
