(32) Akzo qualified for a significant reduction of the amount of the fine as it was the third undertaking that provided the Commission with information and evidence that corroborated the existence of the MCAA cartel. Akzo did not contest the facts that the Commission relied upon. The Commission concluded that Akzo fulfilled the conditions set out in Section D. The information and evidence provided by Akzo was detailed, was relied upon by the Commission and this is reflected in the 25% reduction of the fine that would otherwise have been imposed.

The applicants submit that the Court of First Instance (hereinafter the CFI) erred in law where it did not base its assessment on the fact that the contested decision is a binding act producing legal effects bringing about a distinct change in the applicants'legal position.

(14) In reply to these submissions, it is first of all noted that the Community industry did not contest that STAF have different basic physical and technical characteristics. Secondly, as regards sales channels, use, consumer perception and import trends, the Community footwear industry did not put forward any substantiated arguments that could change the findings in recitals 15 to 18 of the provisional Regulation. Furthermore, the claim for an increase of the EUR 9,00 threshold was not further substantiated by any evidence.

Otrkārt, attiecībā uz tirdzniecības kanāliem, lietojumu, patērētāju uztveri un importa apjoma izmaiņu tendencēm Kopienas apavu ražošanas nozare neizvirzīja nekādus pamatotus argumentus, kas varētu mainīt pagaidu regulas 15. līdz 18. apsvēruma secinājumus. Turklāt nav nekāda sīkāka pamatojuma prasībai paaugstināt noteikto 9 EUR slieksni.
