The aid which Germany is planning to implement for NUW Nordbrandenburger UmesterungsWerke GmbH%amp% Co. KG in the form of an SME bonus is incompatible with the common market. The aid may accordingly not be implemented.

(35) The business purposes of NUW Nordbrandenburger Umesterungswerke Verwaltung GmbH, MUW Mitteldeutsche UmesterungsWerke Verwaltungs GmbH, Mitteldeutsche BioEnergie Verwaltung GmbH and NBE Nordbrandenburger BioEnergie Verwaltung GmbH are to manage and represent other enterprises.

In October 2004, Germany notified regional investment aid for the benefit of NUW Nordbrandenburger UmesterungsWerke GmbH and Co. KG, which is situated in Schwedt, Brandenburg, and would operate in the market of bio diesel.

Em Outubro de 2004, a Alemanha notificou um auxílio regional ao investimento em benefício da NUW Nordbrandenburger UmesterungsWerke GmbH und Co. KG, empresa situada em Schwedt, Brandeburg, que desenvolve actividades no mercado dos biocombustíveis para motores diesel.

The Commission will investigate the relationships between NUW Nordbrandenburger UmesterungsWerke GmbH and Co KG, MUW Mitteldeutsche Umesterungswerke GmbH and Co KG, MBE Mitteldeutsche Bio Energie GmbH and Co KG, NBE Nordbrandenburger BioEnergie GmbH and Co KG, their attached Verwaltungs GmbHs and Sauter Verpachtung GmbH.

A Comissão investigará as relações entre a NUW Nordbrandenburger UmesterungsWerke GmbH und Co KG, a MUW Mitteldeutsche Umesterungswerke GmbH und Co KG, a MBE Mitteldeutsche Bio Energie GmbH und Co KG, a NBE Nordbrandenburger BioEnergie GmbH und Co KG, e as suas empresas associadas Verwaltungs GmbHs e Sauter Verpachtung GmbH.

(18) Whereas Daniela Sauter has a 74% stake in NUW, her holdings in NBE Nordbrandenburger BioEnergie GmbH%amp% Co. KG, MBE Mitteldeutsche BioEnergie GmbH%amp% Co. KG and SBE Swiss BioEnergy AG do not exceed 50%. According to Germany there are no other enterprises linked to NUW.

(18) Enquanto que Daniela Sauter NUW detém uma participação de 74%, a sua participação nas empresas NBE Nordbrandenburger BioEnergie GmbH%amp% Co. KG, MBE Mitteldeutsche BioEnergie GmbH%amp% Co. KG e SBE Swiss BioEnergy AG não excede 50%. A Alemanha indicou que a empresa NUW não está associada a outras empresas.

(50) With the exception of NUW Nordbrandenburger Umesterungswerke Verwaltung GmbH (no turnover, no staff, balance sheet EUR 32000), in which Daniela Sauter has a shareholding of 50%, the Sauter family controls 15 enterprises via majority shareholdings (see paragraph 34 and the Annex).

The aid was registered as notified aid number N 451/2004. In response to a Commisison request for information sent on 6 November 2004, Germany submitted further information on 16 December 2004.

(1) Por carta de 11 de Outubro de 2004, registada a 12 de Outubro de 2004, a Alemanha comunicou à Comissão a sua intenção de aplicar uma medida de auxílio regional a favor da NUW Nordbrandenburger UmesterungsWerke. A medida foi registada com o número N 451/2004 como auxílio notificado. No seguimento do pedido da Comissão de 6 de Novembro de 2004, a Alemanha transmitiu informações adicionais a 16 de Dezembro de 2004.

(7) The recipient of the aid is NUW Nordbrandenburger UmesterungsWerke GmbH%amp% Co. KG ("NUW"), located in Schwedt, in the Land of Brandenburg, Germany, an assisted area pursuant to Article 87(3)(a) of the Treaty. NUW was established on 4 May 2004. Before the implementation of the planned investment it will not carry out any operational activities. Consequently, in October 2004 NUW did not yet have any full-time or part-time employees.

(7) O beneficiário do auxílio é a NUW Nordbrandenburger UmesterungsWerke GmbH%amp% Co. KG (em seguida designada "NUW") com sede em Schwedt, Brandemburgo, Alemanha, uma região assistida nos termos do n.o 3, alínea a), do artigo 87.o do Tratado CE. A NUW foi fundada em 4 de Maio de 2004. Antes da realização do investimento previsto, a empresa não realizará qualquer actividade industrial. Por conseguinte, em Outubro de 2004 a NUW não tinha ainda funcionários a tempo inteiro ou a tempo parcial.
