[5] Set up in February 2002 to conduct investigations and organise the Commission’s disciplinary proceedings. Relations between the Office and IDOC were to be the subject of an agreement that has still not been finalised.

-Award damages for the pecuniary and non-pecuniary loss sustained by her following the breach of the Commission's promise to recruit her to the Investigatory and Disciplinary Office (IDOC) with effect from 1 May 2004 at the latest, that amount being fixed ex aequo et bono at EUR 576593,20;

The memoranda of understanding concluded by OLAF with the Internal Audit Service (IAS)[23] in 2001 and with IDOC[24] in 2004, describing their respective areas of activity, created the conditions for fruitful cooperation between these bodies. Frequent contacts between OLAF and IDOC in 2005 enabled them to coordinate their activities in specific cases.

Protokoly o dohode uzatvorené úradom OLAF s útvarmi interného auditu (IAS)[23] v roku 2001 a s IDOC v roku 2004[24], opisujúce ich jednotlivé oblasti činnosti, umožnili plodnú spoluprácu medzi týmito subjektami. Časté kontakty medzi úradom OLAF a IDOC v priebehu roku 2005 umožnili koordinovať ich akcie v konkrétnych prípadoch.

31. It was difficult to determine how much time is really spent on follow-up. However, the information obtained shows that it is not the main activity of the units concerned. In general, the Office’s follow-up activity has provided little added value, especially where coordination and assistance were concerned (see Annex II). The Office’s role in financial follow-up should be limited to calculating the amounts of the sums to be recovered. Once they are known, it is for the authorising officers in the operational Directorates-General and the authorities in the Member States to issue recovery orders and to ensure that payment is received on the due date. For its part, DG Budget must ensure that recovery orders are registered as soon as they are issued and that the authorising officers observe the timetable for recoveries. Cases of negligence on the part of the authorising officers are to be referred to IDOC by DG Budget. Mobilising OLAF staff after the stage of calculating the amounts of the sums to be recovered is thus a duplication of effort already undertaken by the authorising officers.

31. Bolo veľmi zložité určiť, koľko času sa skutočne vynaloží na následné opatrenia. Dostupné ukazovatele napriek tomu poukazujú na to, že následná kontrola nepatrí medzi hlavné činnosti príslušných jednotiek. Vo všeobecnosti bola efektívnosť následnej kontroly úradu hodnotená ako slabá, najmä v oblastiach, ktoré sa týkali koordinácie a pomoci (príloha II). Úloha úradu v rámci finančných následných opatrení by sa mala obmedziť len na určenie čiastok, ktoré je treba vymôcť. Akonáhle sú tieto čiastky isté, povoľujúci úradníci operačného generálneho riaditeľstva a príslušné orgány členských štátov vydajú príkazy na vymáhanie a ubezpečia sa, že platby boli prijaté v lehote splatnosti. GR pre rozpočet zas musí zaručiť registráciu príkazov na vymáhanie hneď po vydaní a kontrolovať dodržiavanie časového plánu uhradených platieb zo strany povoľujúcich úradníkov. O prípadoch zanedbania zo strany povoľujúcich úradníkov má GR pre rozpočet informovať úrad IDOC. Činnosť zamestnancov úradu OLAF sa teda okrem vyčíslenia čiastok k náhrade výrazne kryje s činnosťou povoľujúcich úradníkov.
