(a) vehicles registered in the Community or in countries which are contracting parties to the AETR, for the whole journey;

This Directive shall supplement the provisions of Regulation (EEC) No 3820/85 and, where necessary, of the AETR Agreement, which take precedence over the provisions of this Directive.

The European Agreement concerning the Work of Crews of Vehicles engaged in International Road Transport (AETR) shall apply instead of the present rules to international road transport operations:

-control of driving and rest periods (Council Regulation (EEC) No 543/69 of 25 March 1969 on the harmonisation of certain social legislation relating to roard transport and AETR),

-kontrolo časa vožnje in počitka (Uredba Sveta (EGS) št. 543/69 z dne 25. marca 1969 o uskladitvi nekatere socialne zakonodaje v zvezi s cestnim prevozom in AETR),

whereas the provisions of the European Agreement concerning the Work of Crews of Vehicles engaged in International Road Transport (AETR) of 1 July 1970 should apply to those transport operations;

ker naj se določbe Evropskega sporazuma o delu posadk vozil v mednarodnem cestnem prometu (AETR) z dne 1. julija 1970 uporabljajo za te prevoze;

whereas in the case of vehicles registered in a State which is not a Contracting Party to AETR, those provisions will only apply to that part of the journey effected within the Community;

The provisions of the AETR should be aligned with those of this Regulation, so that the main provisions in this Regulation apply, through the AETR, to such vehicles for any part of the journey made within the Community.

This Directive shall apply to mobile workers employed by undertakings established in a Member State, participating in road transport activities covered by Regulation (EEC) No 3820/85 or, failing that, by the AETR Agreement.

Ta direktiva velja za vozno osebje, zaposleno v podjetjih s sedežem v državi članici, ki opravlja dejavnosti v cestnem prometu v smislu Uredbe (EGS) št. 3820/85 ali sicer Sporazuma AETR.

(b) vehicles registered in a third country which is not a contracting party to the AETR, only for the part of the journey on the territory of the Community or of countries which are contracting parties to the AETR.

For the purposes of this Directive, apprentices and trainees shall be covered by the same provisions on rest time as other mobile workers in pursuance of Regulation (EEC) No 3820/85 or, failing that, of the AETR Agreement.

Za namene te direktive veljajo za pripravnike in vajence enake določbe o času počitka kakor za drugo vozno osebje na podlagi Uredbe (EGS) št. 3820/85 ali sicer Sporazuma AETR.

Amendment 34 removes the provision enabling the Community to negotiate primarily within the context of the AETR agreement to ensure similar enforcement standards are also applied beyond the Union’s borders. This would be a step backwards.

Sprememba 34 črta določbo, ki omogoča Skupnosti, da se pogaja predvsem v okviru sporazuma AETR, da bi zagotovila uporabo podobnih standardov izvrševanja tudi izven meja Unije. To bi bil korak nazaj.

Council Regulation (EEC) No 3820/85 of 20 December 1985 on the harmonisation of certain social legislation relating to road transport (OJ L 370, 31.12.1985, p. 1), or equivalent rules laid down in the AETR Agreement, including amendments thereto.

Uredba Sveta (EGS) št. 3820/85 z dne 20. decembra 1985 o usklajevanju nekatere socialne zakonodaje o cestnem prevozu (UL L 370, 31.12.1985, str. 1), ali ustrezni predpisi iz Sporazuma AETR, vključno z njihovimi spremembami.

(11) If an amendment to the internal Community rules in the field in question necessitates a corresponding amendment to the AETR, Member States should act together to bring about such an amendment to the AETR as soon as possible, in accordance with the procedure laid down therein.

(11) Če sprememba notranjih pravil Skupnosti iz zadevnega področja zahteva ustrezno spremembo AETR, bi morale države članice sodelovati pri čimprejšnji pripravi take spremembe AETR v skladu s postopkom, določenim v zadevnem sporazumu.

(9) In the case of carriage by road using vehicles registered in a third country which is not a contracting party to the AETR, the provisions of the AETR should apply to that part of the journey effected within the Community or within countries which are contracting parties to the AETR.

whereas, however, the particular circumstances in which the AETR negotiations took place warrant, by way of exception, a procedure whereby the Member States of the Community individually deposit the instruments of ratification or accession in a concerted action but nonetheless act in the interest and on behalf of the Community;

The scope of this Directive covers only mobile workers employed by transport undertakings established in a Member State participating in mobile road transport activities covered by Regulation (EEC) No 3820/85 or, failing that, by the European agreement concerning the work of crews of vehicles engaged in international road transport (AETR).

Področje uporabe te direktive vključuje zgolj vozno osebje, zaposleno v prevoznih podjetjih s sedežem v državi članici, ki opravljajo spremljevalne dejavnostih v cestnem prometu v smislu Uredbe (EGS) št. 3820/85 ali sicer Evropskega sporazuma o delu posadke na vozilih, ki opravlja mednarodne cestne prevoze (AETR).

Amendment 13, 14 and 16. These amendments include the definition of driver and the relationship between AETR and Community rules on driving time and rest periods. The common position on the sister proposal on driving times and rest periods has set out a different definition and relationship. These would be valid for the enforcement proposal.

Spremembe 13, 14 in 16. Te spremembe vključujejo opredelitev pojma voznika ter povezavo med AETR in predpisi Skupnosti na področju časa vožnje in časa počitka.
