(58) On reexamination of the differences attributed to characteristics such as length, thickness, elongation, tenacity, crimp, shrinkage, lustre and spin finish, it is concluded that the product types within the defined families were sufficiently comparable. On this basis, it is confirmed that the undercutting and underselling exercises at the level of product families are meaningful. In addition, they provide a representative result in terms of number of transactions as laid down by Article 3(3) of the basic Regulation. Furthermore, it is considered that the information per transaction was indeed taken into account in the price comparison exercises. However, it is confirmed that no compensation was made for the amount which did not undercut/undersell Community industry prices in the final comparison at the level of product families. Since no further arguments were put forward, the above claims were rejected.

(58) Pri ponovni preučitvi razlik, ki izhajajo iz lastnosti, kot so dolžina, debelina, raztezek, odpornost, kodravost, krčenje, lesk in priprava za predenje se sprejme sklep, da so tipi izdelka znotraj posameznih družin izdelka zadosti primerljivi. Na podlagi tega se potrdi, da so izračuni za ugotavljanje stopenj ki nelojalno nižajo cene in ciljne cene, na ravni družin izdelka tehtni. Poleg tega dajejo reprezentativen rezultat glede števila poslov, kot je to določeno v členu 3(3) osnovne uredbe. Nadalje se zagovarja stališče, da so se podatki o posameznih poslih upoštevali pri primerjavah cen. Vendar pa se potrdi, da se pri končni primerjavi na ravni družin izdelka ni izvršilo nadomestilo za zneske, ki niso bili pod cenami/ciljnimi cenami industrije Skupnost. Ker ni bil predložen noben drug argument, so se zgornji zahtevki zavrnili.

Whereas the Scientific Committee for Food has reexamined all the extraction solvents listed in Directive 88/344/EEC (4), with a view to replacing the provisional acceptable daily intakes (ADIs) set in 1981 by definitive figures; whereas this has not always been possible because the information needed, although requested from the industry, has not been communicated; whereas, on the basis of the information received, the Scientific Committee for Food has been able to confirm its agreement for the majority of the solvents; whereas the maximum residues of the solvents in certain foodstuffs can be reduced;

(76) In accordance with Article 3(6) of the basic Regulation, it was reexamined whether the material injury suffered by the Community industry, as defined in recital 42, had been caused by the dumped imports from India. In accordance with Article 3(7) of the basic Regulation, the Commission also reexamined other known factors which might have injured the Community industry in order to ensure that any injury caused by those factors was not wrongly attributed to the dumped imports.

(61) The decision to initiate proceedings also considered the possibility of assessing the compatibility of the aid in the light of the OECD rules on credit facilities granted for the building and conversion of vessels [13]. It stated that although the OECD Arrangement and Sector Understanding made provision for guarantees, the provisions of the Arrangement in relation to minimum premium benchmarks did not apply until such time as they had been reexamined by the parties to the Sector Understanding. This is still the case [14].

4.14. The Commission places reservations where it disagrees with the Member State's figures or method, or where it requires evidence to justify the figures or method used, or where the Member State presents no figures. For these reasons their financial impact is seldom easy to estimate with accuracy. Moreover, the Commission would not want such estimation to discourage Member States from performing the sometimes difficult work of producing accurate data and appropriate methods of calculation. The Commission will nonetheless reexamine this question.

4.14 Komisija izraža pridržke, kadar se ne strinja s podatki ali metodami držav članic ali kadar te ne predložijo nikakršnih podatkov. Iz teh razlogov je redkokdaj mogoče natančno oceniti finančni vpliv. Še več, Komisija si ne želi, da bi taka ocena države članice odvrnila od opravljanja včasih težavne naloge pripravljanja točnih podatkov in ustreznih metod za izračun.
