There shall be no liability on the part of the NCBs/ECB for non-compliance with this Guideline to the extent that, and for so long as, there is an inability to perform the obligations in question under the Guideline, or such obligations are subject to suspension or delay, owing to the occurrence of any event arising from any reason or cause beyond reasonable control (including, but not limited to, equipment failure or malfunction, acts of God, natural disasters, strikes or labour disputes); provided that the above shall not prejudice the responsibility to have in place the back-up facilities required by this Guideline, to carry out the errorhandling procedures, referred to in Article 4(f), as far as possible despite the force majeure event, and to use all reasonable efforts to mitigate the effects of any such event while it is taking place.

Los BCN y el BCE no responderán del incumplimiento de las obligaciones que les incumban de conformidad con la presente Orientación en la medida y por el tiempo en que el cumplimiento de esas obligaciones resulte imposible, se interrumpa o demore por circunstancias que no les sean razonablemente imputables (entre otras, las averías o el mal funcionamiento de aparatos, las catástrofes naturales, las huelgas o los conflictos laborales), sin perjuicio de su obligación de disponer de los mecanismos auxiliares exigidos por la presente Orientación, aplicar el procedimiento de subsanación de errores a que se refiere la letra f) del artículo 4 de la presente Orientación, en la medida de lo posible, a pesar de la fuerza mayor, y hacer todo lo razonablemente posible por mitigar los efectos de esas circunstancias mientras se produzcan.
