(41) The market share of the Community industry fell from 33,4% in 1994 to 31,4% in the investigation period. Therefore, the Community industry could not benefit fully from the growth of the market.

(13) Within the category of very serious infringements, the scale of likely fines also makes it possible to set the fines at a level which ensures that they have sufficient deterrent effect, taking into account the size of each undertaking. In this respect, the Commission notes that in 2003, the most recent financial year preceding this Decision, the turnover of UCB was EUR 3 billion, that of Akzo Nobel EUR 13 billion and that of BASF EUR 33,4 billion. Accordingly, the Commission considers it appropriate to multiply the fine for Akzo Nobel with a factor of 1,5 and that of BASF with a factor of 2.

(13) Inom kategorin mycket allvarliga överträdelser gör skalan över rimliga böter det också möjligt att genom att beakta varje enskilt företags storlek fastställa bötesbeloppen till en nivå som säkerställer att en tillräcklig avskräckande effekt uppnås. I samband med detta noterar kommissionen att omsättningen för det senaste räkenskapsåret som föregick beslutet, dvs. 2003, för UCB uppgick till 3 miljarder euro, för Akzo Nobel 13 miljarder euro och för BASF 33,4 miljarder euro. Kommissionen finner det således lämpligt att multiplicera Akzo Nobels bötesbelopp med faktorn 1,5 och bötesbeloppet för BASF med 2.

(76) The Community industry's market share, however, decreased from 37,8% in 1997 to 33,4% during the expiry IP. It decreased steadily between 1997 and 1999, leading to a loss of over 7 percentage points. With the imposition of anti-dumping measures in 2000, a recovery of 2,8 percentage points of market share occurred during the expiry IP. Nevertheless, the overall loss in market share suffered by the Community industry was as high as 4,4 percentage points during the period considered. This decrease in market share is in line with the findings made in recitals 59, 61, 74 and 75.

Den minskade stadigt mellan 1997 och 1999, vilket ledde till en förlust av mer än 7 procentenheter. Med införandet av antidumpningsåtgärder under 2000 kunde marknadsandelen under undersökningsperioden för översynen vid giltighetstidens utgång öka 2,8 procentenheter. Gemenskapsindustrins sammanlagda förlust av marknadsandelar låg dock under skadeundersökningsperioden så högt som 4,4 procentenheter. Denna minskning i marknadsandelen ligger i linje med konstaterandena i skälen 59, 61, 74 och 75.

The major effort to clear outstanding appropriations on actions begun before 2000 was continued: a total of 50 projects were closed in 2004. Some 33,4% of the outstanding appropriations existing at the beginning of the year were paid or subject to decommittment in 2004. By the end of 2004, outstanding appropriations had fallen to just 15% of the annual budget of the Cohesion Fund (against over half at the end of 2002 and 39% at the end of 2003). This effort to reduce outstanding appropriations shall be maintained in 2005 in partnership with the national authorities who are responsible for project implementation and the related payment claims.

Bemödandena att reglera utestående åtaganden för åtgärder som inletts före 2000 fortsatte. Under 2004 avslutades sålunda totalt 50 projekt. Omkring 33,4% av de åtagandebelopp som var utestående i början av året betalades eller drogs tillbaka. I slutet av 2004 hade de utestående åtagandena minskat till endast 15% av Sammanhållningsfondens årsbudget (jämfört med mer än 50% i slutet av 2002 och 39% i slutet av 2003). Bemödandena att minska de utestående åtagandena kommer att fortsätta under 2005 i samarbete med de nationella myndigheter som ansvarar för projektgenomförandet och de därmed sammanhängande betalningsframställningarna.
