(34) The Commission observes that, as far as it concerns this aid for investments for processing and marketing of fishery and aquaculture products intended to be used and processed for purposes other than human consumption, there exist, at this stage of the preliminary examination, as provided for by Article 6 of Council Regulation (EC) No 659/1999 of 22 March 1999 laying down detailed rules for the application of Article 88 of the EC Treaty, serious doubts on the compatibility of this aid with the Guidelines for the examination of State aid to Fisheries and aquaculture and, therefore, with the EC Treaty.(35) In the light of the foregoing conditions, the Commission, acting under the procedure laid down in Article 88 (2) of the EC Treaty and Article 6 of Regulation (EC) No 659/1999, requests the United Kingdom of Great Britain and Northern Ireland to submit its comments and to provide all such information as may help to assess the aid, within one month of the date of receipt of this letter. It requests your authorities to forward a copy of this letter to the recipients of the aid immediately.

Nařízení Rady (ES) č. 659/1999 [1] nestanoví žádnou promlčecí lhůtu pro posouzení protiprávní podpory. Článek 15 uvedeného nařízení však stanoví, že pravomoci Komise ve věci navrácení podpory podléhají promlčecí lhůtě deseti let, že promlčecí lhůta počíná dnem, kdy je podpora udělena příjemci a že běh promlčecí lhůty přerušuje jakékoli opatření přijaté Komisí. Komise se proto domnívá, že v tomto případě není nutné šetřit podporu poskytnutou dříve než deset let předtím, než Komise přijala příslušné opatření. Komise se domnívá, že promlčecí lhůta byla přerušena její žádostí o informace, která byla Spojenému království zaslána dne 24. srpna 2004. Promlčecí lhůta se proto vztahuje na podporu poskytnutou příjemcům před dnem 24. srpna 1994 a Komise níže hodnotí pouze podporu poskytnutou na základě rozhodnutí přijatých v době od 24. srpna 1994 do 14. ledna 2005. V oblasti rybolovu je nutné posuzovat dané opatření podle Pokynů pro posuzování státní podpory v odvětví rybolovu a akvakultury. Podle bodu 5.3 Pokynů se "protiprávní podpora" ve smyslu čl. 1 písm. f) nařízení (ES) č. 659/1999 bude posuzovat podle pokynů platných v době, kdy vstoupil v platnost správní akt, jímž se tato podpora zakládá.
