In duly justified circumstances, for activities where daily noise exposure varies markedly from one working day to the next, Member States may, for the purposes of applying the exposure limit values and the exposure action values, use the weekly noise exposure level in place of the daily noise exposure level to assess the levels of noise to which workers are exposed, on condition that:

3. Council Directive 86/188/EEC of 12 May 1986 on the protection of workers from the risks related to exposure to noise at work (22) is amended as follows:

(3) Työntekijöiden suojelemisesta vaaroilta, jotka liittyvät melualtistukseen työssä 12 päivänä toukokuuta 1986 annetussa neuvoston direktiivissä 86/188/ETY(4) säädetään, että neuvosto tarkastelee komission ehdotuksesta direktiiviä uudelleen kyseisten vaarojen vähentämiseksi ottaen huomioon erityisesti tieteellisen tietämyksen ja teknologian kehityksen.

(3) Council Directive 86/188/EEC of 12 May 1986 on the protection of workers from the risks related to exposure to noise at work(4) made provision for its re-examination by the Council on a proposal from the Commission and with a view to reducing the risks concerned, taking into account in particular progress made in scientific knowledge and technology.

Jos melualtistuksesta aiheutuvia riskejä ei voida ehkäistä muulla tavoin, on työntekijöiden työpaikalla käyttämille henkilösuojaimille turvallisuutta ja terveyttä varten asetettavista vähimmäisvaatimuksista (kolmas direktiivin 89/391/ETY 16 artiklan 1 kohdassa tarkoitettu erityisdirektiivi) 30 päivänä marraskuuta 1989 annetun neuvoston direktiivin 89/656/ETY(14) ja direktiivin 89/391/ETY 13 artiklan 2 kohdan säännösten mukaisesti annettava työntekijöiden käyttöön asianmukaiset, hyvin istuvat henkilökohtaiset kuulonsuojaimet, joita heidän on käytettävä, seuraavin ehdoin:

If the risks arising from exposure to noise cannot be prevented by other means, appropriate, properly fitting individual hearing protectors shall be made available to workers and used by them in accordance with the provisions of Council Directive 89/656/EEC of 30 November 1989 on the minimum health and safety requirements for the use by workers of personal protective equipment at the workplace (third individual Directive within the meaning of Article 16(1) of Directive 89/391/EEC)(14) and Article 13(2) of Directive 89/391/EEC and under the conditions set out below:
