La Commission a reçu des informations d'Hynix Semiconductor Inc., selon lesquelles toutes les subventions jugées passibles de mesures compensatoires à l'issue de l'enquête ayant abouti à l'institution des mesures par le règlement (CE) no 1480/2003 n'existeraient plus.

The Commission has received information from Hynix Semiconductor Inc. in which it is argued that the effects of all the subsidies that were found to be countervailable in the investigation that led to the imposition of measures by Regulation (EC) No 1480/2003 have ceased to exist.

Eu égard à qui précède, la Commission considère qu'en ce qui concerne les subventions en faveur d'Hynix Semiconductor Inc., il existe des éléments de preuve suffisants établissant que les circonstances relatives aux pratiques de subvention ont sensiblement changé et qu'il est dès lors nécessaire de procéder à un réexamen de la mesure en vigueur.

In light of the above, the Commission considers that, as far as subsidisation of Hynix Semiconductor Inc. is concerned, there is sufficient prima facie evidence that the circumstances with regard to subsidization have changed significantly and, therefore, the measure in force should be reviewed.

La mesure actuellement en vigueur sur les importations de DRAM en provenance d'Hynix Semiconductor Inc. se présente sous la forme d'un droit compensateur définitif institué par le règlement (CE) no 1480/2003 [2] du Conseil sur les importations de DRAM originaires de la République de Corée, modifié par le règlement (CE) no 2116/2005 du Conseil [3].

The measure currently in force on imports of DRAMs from Hynix Semiconductor Inc. is a definitive countervailing duty imposed by Council Regulation (EC) No 1480/2003 [2] on imports of DRAMs originating in the Republic of Korea as amended by Council Regulation (EC) No 2116/2005 [3].

S'il en résulte que la mesure en vigueur sur les importations de DRAM produites par Hynix Semiconductor Inc. doit être modifiée, il conviendra également de réexaminer dans quelles proportions le taux du droit applicable aux importations des produits fabriqués par toutes les autres sociétés mentionnées à l'article 1er, paragraphe 2, du règlement (CE) no 1480/2003 doit aussi être modifié.

If it is determined that the measure in force on imports of DRAMs produced by Hynix Semiconductor Inc. should be amended, the extent to which the rate of duty applicable to imports produced by all other companies as set out in Article 1(2) of Regulation (EC) No 1480/2003 requires to be amended shall also be reviewed.

In order to obtain the information it deems necessary for its investigation, the Commission will send questionnaires to Hynix Semiconductor Inc., to the Korean authorities and any known financial institutions concerned. This information and supporting evidence should reach the Commission within the time limit set in point 5(a) of this notice.

Selon les allégations, les régimes susmentionnés constituent des subventions en ce sens qu'ils entraînent une contribution financière des pouvoirs publics coréens et confèrent un avantage à Hynix Semiconductor Inc.. Dans la mesure où ils sont prétendument limités exclusivement à Hynix Semiconductor Inc., ils sont spécifiques et passibles de mesures compensatoires. Il est enfin allégué que la mesure en vigueur ne permet plus de compenser ces subventions passibles de mesures compensatoires.

It is alleged that the above schemes are subsidies since they involve a financial contribution from the Government of the Republic of Korea and confer a benefit to Hynix Semiconductor Inc. They are alleged to be limited to Hynix Semiconductor Inc. only, and therefore specific and countervailable. It is finally alleged that the measure in force is no longer adequate to counteract these countervailable subsidies.

La Commission a décidé, de sa propre initiative, d'ouvrir un réexamen intermédiaire partiel au titre de l'article 19 du règlement (CE) no 2026/97 du Conseil relatif à la défense contre les importations qui font l'objet de subventions de la part de pays non membres de la Communauté européenne [1] (ci-après dénommé "règlement de base"). La portée du réexamen se limite aux pratiques de subvention concernant la société Hynix Semiconductor Inc.

The Commission has decided on its own initiative to initiate a partial interim review pursuant to Article 19 of Council Regulation (EC) No 2026/97 on protection against subsidised imports from countries not members of the European Community [1] ("the basic Regulation"). The review is limited in scope to the examination of subsidisation as far as Hynix Semiconductor Inc. is concerned.

(2) Deux producteurs-exportateurs établis en République de Corée ont coopéré à l’enquête qui a conduit à l’institution des mesures existantes (ci-après dénommée «enquête initiale»), à savoir Samsung et Hynix Semiconductor Inc., lequel possède également un site de production aux États-Unis. Au moment de l’enquête initiale, l'industrie communautaire se composait de deux producteurs, Infineon Technologies AG, Munich, Allemagne, et Micron Europe Ltd, Crowthorne, Royaume-Uni, qui représentaient une proportion majeure de la production communautaire totale de DRAM.

(68) La Commission a également recherché des informations sur les perspectives d’avenir du marché des DRAM. Selon les dernières prévisions des World Semiconductor Trade Statistics (voir tableau ci-après), le taux moyen de croissance annuelle du marché mondial des semi-conducteurs entre 2003 et 2005 sera de 15,4%. Les perspectives pour le segment des mémoires (incluant SRAM, DRAM et produits de mémoire non volatile) sont elles aussi favorables. Entre 2003 et 2005, le taux moyen de croissance annuelle du marché mondial des produits de mémoire devrait atteindre 21,6%.

(68) The Commission also requested information on the prospects for the DRAM market. According to the latest forecasts of the World Semiconductor Trade Statistics (see table below), the average annual growth rate of the global market for semiconductors between 2003 and 2005 will be 15,4%. The outlook for the memory segment (including SRAMs, DRAMs and non-volatile memory products) is also positive. The average annual growth rate of the global market for memory products between 2003 and 2005 is expected to be 21,6%.

110 -Motivations et objectifs de la proposition Les circuits intégrés à puces multiples ou «modules puces multiples» constituent une catégorie relativement nouvelle de semi-conducteurs assemblés qui n’existaient pas au moment où le mécanisme de réduction tarifaire de l’ATI (accord de l’OMC sur les technologies de l’information) a été conclu en 1996. Si ces circuits avaient existé au moment où l'ATI a été négocié, il est probable qu'ils auraient bénéficié d'un droit nul dans l'accord. Les cinq membres du forum des gouvernements et des autorités sur les semi-conducteurs (Government/Authorities Meeting on Semiconductors -GAMS), à savoir la Communauté européenne représentée par la Commission européenne, le Japon, la Corée, les États-Unis et le Taipei chinois, ont négocié un accord relatif à l’octroi d’un régime de franchise de droits aux circuits intégrés à puces multiples (ci-après dénommé «accord MCP»). -

110 -Grounds for and objectives of the proposal Multi-chip integrated circuits, or "multi-chip packages" (MCPs), are a relatively new category of assembled semiconductors that did not exist at the time the tariff-cutting mechanism of the ITA (the WTO Agreement on Information Technologies) was concluded in 1996. If MCPs had existed at the time the ITA was negotiated, it is likely that they would have been incorporated into the ITA at zero duty. The five Members of the Government/Authorities Meeting on Semiconductors (GAMS), which are the European Community represented by the European Commission, Japan, Korea, the United States and Chinese Taipei, negotiated an Agreement on Duty-Free Treatment of Multi-Chip Integrated Circuits (MCPs) (hereinafter referred to as the "MCP Agreement"). -

(2) La Commission a négocié au nom de la Communauté un accord relatif à l’octroi d’un régime de franchise de droits aux circuits intégrés à puces multiples (ci-après dénommé "accord"), dans le cadre du GAMS (Government/Authorities Meeting on Semiconductors — Réunion des gouvernements et des autorités sur les semi-conducteurs).

(2) The Commission has negotiated on behalf of the Community an Agreement on Duty-Free Treatment of Multi-Chip Integrated Circuits (MCPs) (hereinafter referred to as "the Agreement"), within the framework of the Government/Authorities Meeting on Semiconductors (GAMS).

En 2004, les principaux producteurs de semi-conducteurs implantés dans l’UE et ailleurs ont demandé à leurs autorités nationales respectives, regroupées au sein du GAMS (Government/Authorities Meeting on semiconductors – Réunion des gouvernements et des autorités sur les semi-conducteurs), d’accorder aux circuits intégrés à puces multiples le même régime qu’aux autres produits couverts par l’ATI. L’UE, le Japon, la Corée, les États-Unis et le Taipei chinois, les cinq membres du GAMS, ont avalisé cette initiative lors du GAMS 2004. Les membres du GAMS ont été en mesure de conclure avec succès, le 15 septembre 2005 à Séoul, des négociations portant sur un accord relatif à l’octroi d’un régime de franchise de droits aux circuits intégrés à puces multiples (dénommé « l’accord »).

In 2004, the major producers of semiconductors based in the EU and elsewhere requested that their respective home jurisdictions, which are grouped together in the Government/Authorities Meeting on Semiconductors (GAMS), grant MCPs the same treatment as other products covered by the ITA. The EU, Japan, Korea, the United States and Chinese Taipei as the five GAMS members endorsed this initiative at the 2004 GAMS meeting. The GAMS members were able to successfully conclude negotiations on an Agreement on Duty-Free Treatment of Multi-Chip Integrated Circuits (the “Agreement”) on 15 September 2005 in Seoul.
