5. Der Beklagte wird verurteilt, dem Kläger den Schaden (hilfsweise: in Höhe des gesetzlichen Zinsfußes) zu ersetzen, der sich aus den seit dem 1. Dezember 1998 zu Unrecht einbehaltenen Teilen seiner Dienstbezüge in Form der doppelten Kinderzulage ergibt.

5. Order the respondent to pay the appellant compensation (in the alternative: the statutory interest which has accrued) in respect of the harm incurred as a result of the fact that parts of his income in the form of double child allowance were unjustly retained since 1 December 1998;

4. Die Entscheidung des Beklagten vom 28. April 2004, mit der die dem Sohn Frederik des Klägers anderweitig gewährte Sonderbeihilfe für Schwerbehinderte zur "Zulage gleicher Art" im Sinne von Artikel 67 Abs. 2 des Statuts wie die dem Kläger zuerkannte doppelte Kinderzulage erklärt wird, wird für nichtig erklärt.

4. Annul the decision of the respondent of 28 April 2004, as a result of which the special aid for the severely handicapped which was granted by another source to Frederik, the son of the appellant, was declared to be an "allowance of like nature", within the meaning of Article 67(2) of the Staff Regulations, to the double child allowance which had been granted to the appellant;

"(1) Der Bedienstete erhält nach Maßgabe der Absätze 2 und 3 für jedes unterhaltsberechtigte Kind eine Kinderzulage in Höhe des Betrages, der in Anhang VII Artikel 2 Absatz 1 des Statuts der Beamten der Europäischen Gemeinschaften vorgesehen ist."

'1. A staff member who has one or more dependent children shall, in accordance with paragraphs 2 and 3, receive an allowance equal to the amount laid down in Article 2 (1) of Annex VII to the Staff Regulations of Officials of the European Communities.'

(4) JEDES IM SINNE DES ANHANGS IV ARTIKEL 7 UNTERHALTSBERECHTIGTE KIND EINES BEDIENSTETEN, DESSEN NICHT ALS BEDIENSTETER BESCHÄFTIGTER EHEGATTE GESTORBEN IST, HAT ANSPRUCH AUF EIN WAISENGELD IN HÖHE DES DOPPELTEN BETRAGES DER KINDERZULAGE.

4. EACH CHILD BEING DEPENDENT WITHIN THE MEANING OF ARTICLE 7 OF ANNEX IV ON A STAFF MEMBER WHOSE SPOUSE, NOT BEING A STAFF MEMBER, DIES SHALL BE ENTITLED TO AN ORPHAN'S PENSION OF TWICE THE AMOUNT OF DEPENDENT CHILD ALLOWANCE.

2. Die Entscheidung des Beklagten vom 26. Juni 2003, mit der dem Kläger von der doppelten Kinderzulage nach Artikel 67 Abs. 3 des Statuts eine an seinen Sohn Frederik anderweitig gezahlte Sonderbeihilfe für Schwerbehinderte abgezogen wird, wird für nichtig erklärt.

2. Annul the decision of the respondent of 26 June 2003, as a result of which the special aid for the severely handicapped which was awarded from another source to the appellant's son Frederik was deducted from the double child allowance granted to the appellant under Article 67(3) of the Staff Regulations;

3. Die stillschweigende Ablehnung des Beklagten, dem Kläger gemäß seinem Antrag vom 4. Juni 2003 die in der Vergangenheit zu Unrecht einbehaltene doppelte Kinderzulage zu erstatten, wird für nichtig erklärt.

3. Annul the implied decision of refusal of the respondent to pay back to the appellant, in accordance with his application of 4 June 2003, the double child allowance which had been unjustly retained in the past;

Der Bedienstete erhält nach Maßgabe der Absätze 2 und 3 für jedes unterhaltsberechtigte Kind eine Kinderzulage von monatlich 1 983 bfrs.

A staff member who has one or more dependent children shall, in accordance with paragraphs 2 and 3 below, receive an allowance of Bfrs 1 983 per month for each dependent child.

Für ein unterhaltsberechtigtes Kind im Sinne dieses Artikels wird die Kinderzulage nur einmal gewährt, auch wenn der Ehegatte des Bediensteten einem Organ der Europäischen Gemeinschaften angehört.

Not more than one dependent child allowance shall be paid in respect of any one dependent child within the meaning of this Article, even where the spouse of the staff member is in the service of an institution of the European Communities.
