A) DIE PAUSCHALE ERSTATTUNG IHRER EINRICHTUNGSKOSTEN. DIE HÖHE DIESER ERSTATTUNG BETRAEGT BEI DER AUFNAHME IHRER AMTSTÄTIGKEIT ZWEI MONATSGRUNDGEHÄLTER UND BEIM AUSSCHEIDEN AUS IHREM AMT EIN MONATSGRUNDGEHALT;

(A) AN INSTALLATION ALLOWANCE EQUAL TO TWO MONTHS'BASIC SALARY ON TAKING UP HIS DUTIES AND A RESETTLEMENT ALLOWANCE EQUAL TO ONE MONTH'S BASIC SALARY ON CEASING TO HOLD OFFICE;

Bei Beendigung des Beschäftigungsverhältnisses hat der Bedienstete, der die in Artikel 11 Absatz 1 genannten Voraussetzungen erfüllt, Anspruch auf eine Wiedereinrichtungsbeihilfe, sofern er mindestens vier Dienstjahre abgeleistet hat und in seiner neuen Stelle nicht eine Beihilfe gleicher Art erhält; sie beträgt bei einem Bediensteten, der Anspruch auf die Haushaltszulage hat, zwei Monatsgrundgehälter und bei einem Bediensteten, der nicht Anspruch auf die Haushaltszulage hat, ein Monatsgrundgehalt.

A staff member who satisfies the requirements of Article 11 (1) shall be entitled on termination of service to a resettlement allowance equal to two month's basic salary in the case of a staff member who is entitled to household allowance or to one month's basic salary in other cases, provided that he has completed four years of service and does not receive a similar allowance in his new employment.

(5) ÜBERSTEIGEN DIE NICHT ERSETZTEN AUFWENDUNGEN IN EINEM ZEITRAUM VON ZWÖLF MONATEN EIN HALBES MONATSGRUNDGEHALT DES BEDIENSTETEN ODER EIN HALBES RUHEGEHALT, SO GEWÄHRT DER DIREKTOR DER STIFTUNG NACH ZUSTIMMUNG DER ABRECHNUNGSSTELLE EINE SONDERERSTATTUNG; HIERBEI SIND DIE FAMILIENVERHÄLTNISSE DES BETREFFENDEN UNTER ZUGRUNDELEGUNG DER REGELUNG, AUF DIE ANHANG V ARTIKEL 1 VERWEIST, ZU BERÜCKSICHTIGEN.

5. WHERE THE TOTAL EXPENDITURE NOT REIMBURSED FOR ANY PERIOD OF 12 MONTHS EXCEEDS HALF THE STAFF MEMBER'S BASIC MONTHLY SALARY OR PENSION, SPECIAL REIMBURSEMENT SHALL BE ALLOWED BY THE DIRECTOR OF THE FOUNDATION, WITH THE ASSENT OF THE SETTLEMENTS OFFICE, ACCOUNT BEING TAKEN OF THE FAMILY CIRCUMSTANCES OF THE PERSON CONCERNED, IN MANNER PROVIDED FOR IN THE RULES REFERRED TO IN ARTICLE 1 OF ANNEX V.

DAS MONATLICHE WITWENGELD, DAS DER WITWE EINES BEDIENSTETEN ZUSTEHT, DER IM AKTIVEN DIENST ODER WÄHREND DER BEURLAUBUNG ZUM WEHRDIENST VERSTORBEN IST, BETRAEGT 35 V. H. THE MONTHLY AMOUNT OF THE SURVIVOR'S PENSION PAYABLE TO THE WIDOW OF A STAFF MEMBER WHO DIED IN SERVICE OR ON LEAVE FOR MILITARY SERVICE, SHALL BE EQUAL TO 35% OF THE LAST BASIC SALARY RECEIVED BY THE STAFF MEMBER AND MAY NOT BE LESS THAN THE MINIMUM SUBSISTENCE FIGURE AS DEFINED IN ARTICLE 5 OF ANNEX VI.

Das Monatsgrundgehalt wird für jede Laufbahngruppe, jede Besoldungsgruppe und jede Dienstaltersstufe nach der Tabelle in Anhang II festgesetzt.

Der Kläger, ehemaliger stellvertretender Generaldirektor des Juristischen Dienstes der Kommission, im Februar 2005 in den Ruhestand versetzt, wurde vor seinem Ausscheiden aus dem Dienst in die Besoldungsgruppe A*16 eingestuft und wäre bis Ende 2004 in den Genuss der in Artikel 7 Absatz 4 des Anhangs XIII des Statuts vorgesehenen Anhebung des Monatsgrundgehalts gekommen. Gemäß den am 1. Mai 2004 in Kraft getretenen Änderungen des Statuts spiegelte ein auf sein Monatsgrundgehalt anzuwendender Multiplikationsfaktor von 0,9580274 die Differenz zwischen dem für seine Besoldungsgruppe vorgesehenen Monatsgrundgehalt unter dem alten und neuen Statut wider.

The applicant, former Deputy Director-General of the Commission's Legal Service, who retired in February 2005, was classified, before leaving the service, at grade A*16 and benefited, until the end of 2004, from the increase in salary provided for in Article 7(4) of Annex XIII to the Staff Regulations. In accordance with the amendments to the Staff Regulations which entered into force on 1 May 2004, a multiplication factor of 0.9580274 was applicable to his basic salary, reflecting the difference between the basic salary laid down for his grade and step under the old and new Staff Regulations.
