In der Verordnung (EWG) Nr. 1576/89 sind für eine Reihe von Spirituosen (Rum, Branntwein aus Weinbauerzeugnissen, Obstbrand usw.) ein Mindestgehalt an fluechtigen Bestandteilen außer Ethylalkohol und Methanol festgesetzt worden.

Regulation (EEC) No 1576/89 sets minimum levels of volatile compounds other than ethanol and methanol for a series of spirit drinks (rum, spirits of viticultural origin, fruit spirits, etc.).

Es wäre möglich, dass man für diese tschechische Spirituose den Namen Sliwowitz weiterhin nutzt, aber ihn eben entweder als Spirituose bezeichnet und nicht als Obstbrand, oder dass man das Herstellungsverfahren so ändert, dass es eben den Regeln für Obstbrände entspricht.

The Czechs could continue to use the name Slivovitz for these spirits, but they would either have to label them as spirits or change the manufacturing process so that they comply with the rules for fruit spirits.

(1) Gemäß Artikel 1 Absatz 4 Buchstabe i) Unterabsatz 1) Buchstabe b) der Verordnung (EWG) Nr. 1576/89 wird der zulässige Methanolgehalt bei Obstbrand der nachstehenden Früchte auf 1 500 g/hl r.A. erhöht:-Pflaumen (Prunus domestica L.),

1. Pursuant to Article 1 (4) (i) (1) (b) of Regulation (EEC) No 1576/89, the maximum methyl alcohol content of fruit spirits shall be 1 500 grams per hectolitre of alcohol at 100% vol obtained from the following fruits:

Artikel 6der Verordnung (EWG) Nr. 1014/90 der Kommission (3), zuletzt geändert durch die Verordnung (EWG) Nr. 1781/91 (4), begrenzt den Gehalt an Methanol bei Obstbrand kleiner Brennereien auf 1 500 g/hl r.A. Dieser Gehalt gilt bis zum Ende des laufenden Jahres auch für Birnenbrand, jedoch unabhängig von der Brennerei.

Whereas Article 6 of Commission Regulation (EEC) No 1014/90 (3), as last amended by Regulation (EEC) No 1781/91 (4), thus sets the maximum methyl alcohol content of spirits obtained from certain fruits in small distilleries at 1 500 grams per hectolitre; whereas that maximum content applies until 31 December 1992 to obtained from pears in distilleries;

"(4) Gemäß Artikel 1 Absatz 4 Buchstabe i) Unterabsatz 1 Buchstabe b) der Verordnung (EWG) Nr. 1576/89 werden der Methylalkohol-Hoechstgehalt von Obstbrand aus roter und schwarzer Johannisbeere/Ribisel (*) (Ribes species), Vogelbeere (Sorbus aucuparia) und Hollunder (Sambucus nigra) bzw. aus Himbeere (Rubus idaeus L.) und Brombeere (Rubus fruticosus L.) auf 1 350 bzw. 1 200 g/hl reinen Alkohol festgesetzt.

'4. Pursuant to Article 1 (4) (i) (1) (b) of Regulation (EEC) No 1576/89, the maximum methyl alcohol content of fruit spirits prepared from redcurrants and blackcurrants (Ribes species), service berries (Sorbus aucuparia) and elderberries (Sambucus nigra) shall be 1 350 g per hectolitre of alcohol at 100% vol. and the maximum methyl alcohol content of fruit spirits prepared from raspberries (Rubus idaeus L.) and blackberries (Rubus fruticosus L.) shall be 1 200 g per hectolitre of alcohol at 100% vol.

Im jetzigen Stadium sollten die für den Methanolgehalt von in Österreich hergestellten Obstbränden vorgesehenen Hoechstwerte herabgesetzt werden, unter Berücksichtigung der Ergebnisse von Untersuchungen, die in Österreich zur Prüfung der Möglichkeiten durchgeführt wurden, die die Anwendung niedrigerer Methanolgehalte bei den betreffenden Obstbränden bietet. Es empfiehlt sich außerdem, die Auswirkung verschiedener Entwicklungen zu berücksichtigen, die sich im Zusammenhang mit dem Methanolhöchstgehalt derselben, aber in anderen Mitgliedstaaten hergestellten Obstbrände ergeben haben. Überdies ist weiterhin zu prüfen, wie der Methanolgehalt in Obstbrand in Anwendung des technischen Fortschritts unter Berücksichtigung der traditionellen Merkmale der betreffenden Erzeugnisse verringert werden kann.

Whereas new lower limits for the methyl alcohol content of certain spirits produced in Austria should be introduced at this stage in view of the results of Austrian studies on the possibility of reducing the methanol content of the fruit spirits concerned; whereas it is also necessary to monitor the impact of the development of different aspects relating to the maximum methanol content of those fruit spirits because such limits must also be applied to the same fruit spirits produced in other Member States; whereas examination of the possibilities for reducing the methanol content of those fruit spirits should be continued, taking account of the development of techniques while bearing in mind the traditional characteristics of those products;

Was den Sliwowitz betrifft, so stehen dessen Herstellungsverfahren nicht in Einklang mit der Begriffsbestimmung der Gemeinschaft für Obstbrände, wie sie in Artikel 1 Absatz 4 der Verordnung 15/76 festgelegt sind, weil nämlich dem Sliwowitz Äthylalkohol, also Industriealkohol, zugesetzt wird.

As far as Slivovitz is concerned, the manufacturing method used for it does not comply with the Community definition of fruit spirits set out in Article 1(4) of Regulation No 1576, because ethyl alcohol, i. e. industrial alcohol is added to Slivovitz.
