La denuncia è stata presentata il 24 settembre 2004 dai seguenti produttori (in appresso: "il denunciante"): Legré-Mante SA, Industria Chimica Valenzana S.p.A, Distilleries Mazzari S.p.a., Alcoholera Vinicola Europea S.A. e Comercial Quimica Sarasa s.l., che rappresentano una quota maggioritaria, nella fattispecie più del 50%, della produzione totale di acido tartarico nella Comunità.

(1) Am 24. September 2004 erhielt die Kommission einen Antrag gemäß Artikel 5 der Verordnung (EG) Nr. 384/96 des Rates vom 22. Dezember 1995 über den Schutz gegen gedumpte Einfuhren aus nicht zur Europäischen Gemeinschaft gehörenden Ländern (nachstehend "Grundverordnung" genannt), der von den Herstellern Legré-Mante SA, Industria Chimica Valenzana S.p.A, Distilleries Mazzari S.p.a., Alcoholera Vinicola Europea S.A. und Comercial Quimica Sarasa s.l. (nachstehend die "Antragsteller" genannt) gestellt wurde, auf die mit mehr als 50% ein erheblicher Teil der gesamten Weinsäureproduktion in der Gemeinschaft entfällt.
