The fund, which will have a duration of 10 years and an investment target of €300 million, has been seeded by properties and real estate shares totalling roughly €200 million.

I costi sostenuti nello sviluppo di progetti (relativi ad acquisizioni o cessioni di portafogli immobiliari/societari) sono rilevati come attività immateriali quando è probabile che il progetto avrà successo, tenendo presente la fattibilità commerciale e tecnologica, e che i costi potranno essere valutati attendibilmente.

29) Le controversie che in dipendenza dei rapporti sociali insorgessero tra i soci e fra questi e gli organi della società, oppure fra i soci e la società e così pure le controversie che dovessero insorgere a seguito dell'applicazione di quanto previsto da ogni parte del presente statuto, eccettuate le controversie riguardanti gli oggetti di cui agli articoli 2377, 2393, 2396, 2407, 2409 del Codice Civile, saranno decise inoppugnabilmente da un Collegio di tre arbitri che avrà la sua sede in Milano.

29) Any disputes that should arise regarding corporate relations between the shareholders or between the shareholders and the corporate boards or the company itself, as well as any disputes that should arise following the application of the articles herein, with the exception of disputes regarding Articles 2377, 2393, 2396, 2407, and 2409 of the Italian civil code, are to be irrefutably decided by a board of three arbitrators to be located in Milan, Italy.

Rileva che avrà una crescita dell’indebitamento da Euro 300 milioni a Euro 420 milioni al 30 giugno 2006, dovuta all’acquisto di alcuni immobili ed agli investimenti all’estero da parte della <PROTECTED>, con una previsione al 31 dicembre 2006 sulla base dell’ipotesi di budget di riduzione della posizione finanziaria netta ad Euro 240 milioni.

He reports that the level of debt is expected to increase from €300 million to €420 million at 30 June 2006 as a result of the acquisition of a number of properties and investments abroad by <PROTECTED>, with a forecast as at 31 December 2006 based on the budget for a reduction of net financial position to €240 million.

La locazione avrà durata di 18 anni; se dovesse interrompersi in via anticipata il contratto di locazione o se lo stesso non venisse rinnovato al termine del 18 anno <PROTECTED> acquisirà la proprietà degli interventi di miglioria effettuati ad un valore corrispondente all’ammontare non ancora rimborsato del finanziamento concesso a <PROTECTED>.
