(49) Si deve presumere che la misura a favore delle attività di carattere economico di KBM incida sugli scambi tra gli Stati membri. In base alla giurisprudenza della Corte di giustizia delle Comunità europee nella causa Altmark Trans GmbH e Regierungspräsidium Magdeburg [12] non esiste una soglia o una percentuale al di sotto della quale si possa ritenere che non vi siano effetti sugli scambi tra Stati membri. Né la portata relativamente limitata dell’aiuto né la dimensione relativamente limitata delle imprese beneficiarie permettono infatti di escludere a priori un eventuale pregiudizio agli scambi tra gli Stati membri.

(49) It must be assumed that the measure benefiting KBM’s economic activities is liable to have an impact on trade between Member States. According to the case law of the European Court of Justice in the case Altmark Trans GmbH and Regierungspräsidium Magdeburg [12], there is no threshold and no percentage under which it may be considered that trade between Member States is not affected. Neither the relatively small amount of the aid, nor the relatively small size of the beneficiary undertaking enable to rule out, in principle, the possibility of an impact on trade between Member States.

(33) Nella lettera del 4 aprile 2003, le autorità tedesche citano la sentenza della Corte di giustizia del 24 luglio 2003 nella causa C-280/00 (Altmark Trans GmbH e Regierungspräsidium Magdeburg) [10], nella quale si afferma che le sovvenzioni statali concesse a titolo di compensazione per l’adempimento di obblighi di servizio pubblico in determinate condizioni non costituiscono un aiuto, qualora costituiscano unicamente una contropartita per tale prestazione. Le autorità tedesche reputano che nella fattispecie siano riunite le condizioni sopraindicate.

(33) In its letter of 4 April 2003, Germany quotes the judgment of the European Court of Justice of 24 July in Case C-280/00 (Altmark Trans GmbH and Regierungspräsidium Magdeburg) [10], which rules that State compensatory measures, provided they are merely compensation for the services provided in order to discharge public service obligations, do not, under certain conditions, fall under the heading of State aid. Germany considers that, in the case in hand, those conditions can be considered to be fulfilled.

2) Il diritto comunitario non osta all'applicazione di norme nazionali che subordinano il rimborso di un contributo obbligatorio, come quello previsto dall'art. 12 della legge n. 97-1164, alla prova, incombente all'autore della domanda di rimborso, che il vantaggio tratto dai grossisti distributori dal loro mancato assoggettamento a tale contributo eccede i costi aggiuntivi che essi sopportano per l'assolvimento degli obblighi di servizio pubblico loro imposti dalla normativa nazionale e, in particolare, che non ricorre almeno uno dei presupposti previsti nella sentenza 24 luglio 2003, causa C-280/00, Altmark Trans e Regierungspräsidium Magdeburg.

2. Community law does not preclude the application of rules of national law which make reimbursement of a mandatory contribution such as that provided for in Article 12 of Law No 97-1164 subject to proof by the claimant seeking reimbursement that the advantage derived by wholesale distributors from their not being liable to pay that contribution exceeds the costs which they bear in discharging the public service obligations imposed on them by the national rules and, in particular, that at least one of the conditions laid down in the judgment in Case C-280/00 Altmark Trans and Regierungspräsidium Magdeburg [2003] ECR I-7747 is not satisfied.
